Denmark: Parliament calls for EURATOM reform

In April, all 10 parties represented in the Danish Folketing announced their support for reform of the Euratom Treaty of 1957, one of the founding treaties in what was then the European Common Market. Like many institutions of that era, the treaty promotes the development of nuclear energy, but not other energy sources. Unlike the other founding treaties of the EU, Euratom has never been updated or amended.

The announcement just happened to coincide with a communiqué from the EU Commission proposing democratization of EU energy policy. Although it falls short of instructing the government to take any specific measures, the unanimous statement of sentiment will surely guide national policy. Sweden, Germany, Austria, Luxembourg, Ireland and Hungary, plus international environmental organizations and industrial organizations in the energy sector are already pushing for reform.

Many Danes have objected to the Euratom Treaty, even before Denmark joined the Union. Criticism has increased with Denmark's growing commitment to renewable energy sources – particularly wind power. The Danes' principal complaint concerns the Union's subsidization of nuclear energy under the treaty – a policy that stands in stark contrast to the EU's overall ban on state support to market actors. Putting nuclear energy on the same footing as other energy sources is the prime reform goal.

Denmark chose not to rely on domestic nuclear power from the start. Yet, as a Member State, Denmark is currently required to contribute about €27,000 each year to the Euratom budget, a good share of which supports the ITER fusion reactor project. Participation in Euratom is mandatory for all Member States.

From Denmark's point of view, levelling the playing field for energy sources would have two main advantages. As Niels Henrik Hooge of NOAH/Friends of the Earth Denmark puts it: "Although the Commission's proposal does not go far enough, a reform of the Treaty to give renewable energy fair terms can boost the expansion of renewable energy technologies in Europe, to the benefit of both the environment and Danish export interests."

Municipalities try to block Danish plans for a final LILW repository.
The five Danish municipalities that host the six sites designated by Danish Decommissioning (DD) as a potential final low- and intermediate-level radioactive waste repository (see In Brief, Nuclear Monitor 727, 27 May 2011) have all refused to host it. On 26 May they sent a letter to the Danish interior and health minister, Bertel Haarder, suggesting that Risø National Laboratory on the island of Zeeland, where almost all of the radioactive waste has been produced at three research reactors, should be the place, where the waste is kept in the future. If that is not possible, a deal should be struck to send the up to 10.000 cubic metre radioactive waste abroad to a country experienced in dealing with it. The municipalities were dissatisfied that they had not been consulted in advance and that they had to hear of DD’s recommendations through the press. The minister dismissed the protests, arguing that the decision where to place the waste is several years off in the future and that there would be plenty of time to discuss the final location. However, locating the waste will not be up to him because the Danish interior and health ministry that has so far overseen the process is expected to give up its responsibilities after the completion of the pre-feasibility studies that has now been submitted. Since 2009 three other ministries have been fighting each other in order not to have to take charge of the project. The whole process has been heavily criticised in the media as well as from political opposition parties. Most recently, the Swedish NGO Office for Nuclear Waste Review (MKG) has criticised DD for not acknowledging that some of the waste is high-level radioactive waste and that it has failed to distinguish between short and long lived intermediate-level radioactive waste. According to MKG, apart from being designed to store only the short lived low- and intermediate-level waste and not the long lived, the planned Danish repository does not live up to Swedish standards, mainly because the safety analysis is too short-term.

Sit-in against Jordan nuclear program in capital Amman.
On May 31, Jordan wittnessed its first anti-nuclear action. Not a spectacle in terms of number of people and methods applied, the participants comprised many concerned Jordanian citizens who are worried of the highly dangerous potential impacts of nuclear energy in Jordan. It included people from various disciplines of life, connected with their fear about the country’s nuclear program, which calls for the establishment of a 1,000 megawatt (MW) nuclear reactor. Wearing black T-shirts reading “No to a nuclear reactor”, the 40 protesters expressed concern over the effects of a nuclear reactor and uranium mining on public health and the environment.

Basil Burgan, an anti-nuclear activist and part of a coalition of 16 NGOs, said the demonstration was the “continuation” of efforts to take Jordan’s nuclear ambitions off-line. “We have come to a point where nuclear power has begun to take priority over solar and wind energy and we want to say that a small desert county like Jordan has no need for a nuclear power program,” he said on the sidelines of the sit-in,

Adnan Marajdeh, a resident of the Hashemiyyeh District near the planned site of the country’s first reactor in Balama, some 40 kilometers northwest of the capital, said there has been growing concern among local residents over the social and environmental impact of the plant. “We already suffer from the effects of the Samra Power Station, the Khirbet Al Samra Plant, a steel factory… now they have to put a nuclear power plant on top of us as well?” added the military retiree, who is president of the Jordan Environment Protection and Prevention Society.

Despite a resurgent opposition to nuclear power, Jordan is expected to select one of three short-listed vendors - Canadian, Russian and French-Japanese technologies - by June 30 for the construction of the countries first nuclear power plant.

UK: No stress-test for Sellafield.
Media reports early June cited a British government spokesperson as saying that Sellafield would not be one of the 143 nuclear reactors across Europe to undergo a “stress test”. The spokesperson explained that the UK decision was based on the fact that Sellafield was a nuclear processing facility and not a power plant, therefore it did not meet the EU criteria for stress-testing. But Sellafield’s exclusion causes Irish consternation and the "renewed goodwill and neighbourliness between Ireland and Britain that has followed Queen Elizabeth’s successful visit to these shores" is facing fresh peril.

The Irish government do not seem to be taking no for an answer - a spokesperson for Environment Minister Phil Hogan said it was the department’s “understanding and expectation” that the stress test would apply to Sellafield, following a bilateral meeting on the issue in March.

“Sellafield cannot be exempted from vital safety health checks because of a technicality. It remains an active nuclear site and therefore poses risks like any other. The UK authorities should be willing to put Sellafield to the stress test, even if it’s not covered by the EU proposal, as it still represents a major safety concern for Irish citizens,” said the Fine Gael MEP Mairead McGuinness.

EU: directive to export radioactive waste.
EU member states should be able to send their radioactive waste to non-EU countries according to the EU Energy Committee. Voting on a draft directive on the  management of spent fuel, MEPs agreed that countries should be able to export radioactive waste outside of Europe, as long as it is processed in accordance with new EU safety rules.

Under the proposed directive, each EU state must create programs to ensure that spent fuel and waste is "safely processed and disposed of", as well as holding plans for the management of all nuclear facilities, even after they close.

MEPs also backed stricter rules for the protection and training of workers in the industry, agreeing that national governments must ensure sufficient funds are available to cover expenses related to decommissioning and management of radioactive waste under the "polluter pays" principle.

The EU Parliament's final vote on the directive will take place in June.

Albania moves away from nuclear.
Maybe it was unlikely already but Albania moved one step away from nuclear. Albanian Premier Sali Berisha hinted May 7, on the fifth anniversary of the European Fund for Southeast Europe that the country is reconsidering previous plans for the construction of a nuclear power plant. Despite not declaring a definitive step down from the project, Albania’s Prime Minister made reference to the incident at Fukushima and Germany’s decision to close all nuclear plants by 2022 as a sign his government might be moving away from plans to build a nuclear plant. At the same time, according to a report by Top Channel, Berisha asked EFSE to help provide loans to investors willing to build new hydropower plants, meaning that for the time being Albania’s priority will be water generated energy.

France: only 22 % in favor of new reactors.
France is the world's most nuclear-dependent country, producing 80 percent of its power from 58 reactors, but public opposition is growing. An opinion poll published June 4, found just over three-quarters of those surveyed back a gradual withdrawal over the next 25 to 30 years from nuclear technology.

The Ifop survey found only 22 percent of respondents supported building new nuclear power stations,15 percent backed a swift decommissioning and 62 percent a gradual one.

Iran: Busher reaches first criticality
According to Russian builder AtomStroyExport (ASE),  Iran's first nuclear power reactor Bushehr achieved criticality on 8 May 2011 and is now functioning at the minimum controlled power level. Final commissioning tests will now be carried out prior to start of commercial operation. According to Iranian news agency Fars, the plant is expected to be connected to the national grid within the next two months.
Construction work began on two German-designed pressurised water reactors (PWRs) at the Persian Gulf site in the mid-1970s but was abandoned in 1979 following the Islamic revolution when unit 1 was substantially complete. In 1994, Russia's Minatom agreed to complete unit 1 as a VVER-1000 making use of the infrastructure already in place. However, this necessitated major changes, including fabrication of all the main reactor components in Russia under a construction contract with AtomStroyExport. The Atomic Energy Organization of Iran (AEOI) said in 2008 that it was no longer planning to complete Bushehr unit 2. Further delays ensued for negotiations over fuel supply for the plant, but two agreements were signed early in 2005 covering the supply of fresh fuel for the reactor and its return to Russia after use, securing the plant's fuel supply needs for the foreseeable future.
In February 2011, only weeks before operation was expected to start, the discovery of debris from damaged coolant pumps meant that all the fresh reactor fuel had to be unloaded, checked and cleaned, and the reactor internals and main circulation pipeline flushed through. Bushehr will produce about 1000 MWe for the Iranian grid; about 3% of the country's power supply.
The following table shows which countries produced nuclear energy for the first time after the 1970’s. Currently, only 10 countries did so (of which 3 weren't independent countries at that time), and if we look at countries who started construction of their first nuclear power station, we find that only China and Romania did so after the 1970’s (as said, Iran started in the 1970's)

So which country will be next? According to the World Nuclear Association nuclear power is under serious consideration in over 45 countries which do not currently have it. However, that is in most cases more whish than reality. It is difficult to predict which country will start with the construction of its first nuclear reactor next: will it be Poland, Belarus, Lithuania, Turkey, Jordan or after all the United Arab Emirates?

Big antinuclear demonstration Switzerland. An estimated 20.000 people have held a massive demonstration in northern Switzerland against a possible decision by the government to rely on nuclear energy. The demonstration, staged near the Beznau nuclear power plant, was also attended by people from Germany, Austria and France. According to Maude Poirier, spokeswoman for Sortons du nucleaire, the rally was the biggest protest at nuclear power in Switzerland in 25 years.

Over a thousand high school students went on strike and marched to the centre of Bern on May 24Tuesday, to protest against Switzerland's nuclear energy policy, even though local police had not granted permission for the demonstration.

A day later, on May 25, the Swiss cabinet has called for the phasing out of the country’s five nuclear power reactors and for new energy sources to replace them. The recommendation will be debated in parliament, which is expected to make a final decision in June. If approved, the reactors would be decommissioned between 2019 and 2034 after they have reached their average lifespan of 50 years.

But the delay will anger the antinuclear movement, Greens and the Social Democrats (SP) who had called for nuclear reactors to be closed earlier. And indeed, it looks less like a phase-out scenario and more like an attempt to 'save' nuclear power.

The decision is likely to please business groups who had warned that "a premature shut down of Switzerland's nuclear reactors could lead to higher electricity costs and negatively impact the country's energy-hungry manufacturing sector."

Swiss utility companies Axpo, Alpiq and BKW had expressed an interest in building new nuclear plants and decisions on sites had been expected in mid-2012. (more on Switzerland: Nuclear Monitor 726; 13 May 2011)

Six potential locations for Danish LLW & ILW repository.
A major step towards a repository for Denmark's low- and intermediate-level radioactive waste has been made with the submission of three pre-feasibility studies to the Danish interior and health ministry. The first study, prepared by national decommissioning body Dansk Dekommissionering (DD), looks at different disposal concepts in terms of types of repository, waste conditioning, safety analyses, costs and long-term impact assessments. Overall, the studies conclude that a moderately deep repository would be the most appropriate from a security point of view, although this would be more expensive than a near-surface repository. From 22 areas suggested in preliminary studies, the reports recommend that six potential sites are taken forward for further study. The six identified locations will now be narrowed down to a shortlist of two or three by an inter-ministerial working group in a process that will include the affected municipalities and regions.

Denmark never implemented a commercial nuclear power program but operated a total of three scientific research reactors over the period from the late-1950s up to 2000, as well as associated fuel fabrication facilities. All three reactors – DR-1, DR-2 and DR-3 – were located at the Risø National Laboratory north of Roskilde on the island of Zeeland. Most of the used fuel from the reactors has been returned to the USA, but the country still has a sizeable amount of low and intermediate level radioactive waste which is being stored at Risø pending the selection and construction of a final repository.

SKB Turns in application for permit to build a final repository.
On March 16, the Swedish Nuclear Fuel and Waste Management Company, SKB, applied for a permit to build a final repository for spent nuclear fuel and a facility where the fuel will be encapsulated before being transported to the final repository. SKB's application will now be reviewed by the Swedish Radiation Safety Authority and the Environmental Court. The application will subsequently be presented for political decision in the relevant municipalities and by the government. SKB wants to use the so-called KBS-3 method for the repository, in which spent fuel would be placed in copper and steel canisters before being placed in granite bedrock 500 meters below the surface. Bentonite clay would be put around the canisters as a barrier to radioactive leakage. Critics of the plan have repeatedly questioned the choice of copper and its potential for corrosion, among others issues.

The Swedish NGO Office for Nuclear Waste Review, or MKG, an organization that opposes the KBS-3 method, said that SKB has “shown arrogance in the face of criticism” about the method. The group called on Swedish politicians to “take responsibility” and require alternative methods to be further reviewed. MKG  favors a so-called deep-borehole repository, which would be deeper underground than the repository planned by SKB.

SKB is applying for permission to build an encapsulation facility in Oskarshamn Municipality and a final repository for spent nuclear fuel at Forsmark in Östhammar Municipality. In December 2009 SKB, the industry's jointly owned company for nuclear waste solutions, published a "preliminary" environmental impact statement (EIS) on the KBS-3 scheme. The report failed to meet even rudimentary requirements of an EIS. In January 2010 the SKB unilaterally declared the termination of public consultations on the project (consultations mandated by the Swedish Environmental Code, 1998). SKB makes no apologies, but simply notes that long-awaited updates will be filed together with the formal application.

The 'greying' of the nuclear industry.
Almost a third of Britain's nuclear inspectors are eligible to retire within three years, leaving a potential 'knowledge gap' within the regulator. The Office for Nuclear Regulation has hired 93 new inspectors since 2008. But of the 217 inspectors, 30 per cent are over the age of 57, 11 per cent are over 60 and 70 could retire by 2015. The regulator said that new recruits were needed soon so that the older generation could pass on their expertise and bridge the knowledge gap. Is that what they mean by saying that the nuclear industry has matured?

Will the climate be nuked - in Mexico?

Ask ten people who attended the climate talks in Copenhagen what the outcome was and you get at least ten different answers. Ask the 50 or so people who were there with a clear anti-nuclear energy focus and the situation is slightly better; maybe 25 different answers. The so-called Copenhagen Accord will be implemented by the parties who have agreed on it. It is not an official agreement of the Conference of the Parties (COP) as such, but rather a side-agreement that has only been "noted" by the Conference. It is only 3 pages long and leaves many questions unanswered.

At the end of two weeks of chaotic negotiations almost all nations accepted the Copenhagen Accord as the best that could come out of it. Just because 4 countries (Venezuela, Bolivia, Sudan and Tuvalu) did not support the text it is not an official UN-agreement.  That does not mean the agreement will not have any effects. One very important and welcomed part of the Accord was the recognition of the scientific view that the increase in global temperature should be below 2 degrees Celsius. This simply means that all countries but the so-called least-developed countries (LDC’s) are bound to take drastic and far-reaching measures to cut emissions of greenhouse-gases.

And then the question of ‘how’ is back on the table. Will nuclear be identified and accepted as tool in the fight against climate change? And if so, will it get financial support from public money via UN-based schemes and mechanisms? Under the current Kyoto-protocol it’s not possible to get (financial) credits by building nuclear power plants, not in your own and not in another country. Although the negotiations in Copenhagen were too far from basic agreements to even come to the detailed discussion on which technologies will be accepted to get support, the nuke-speak was often loudly present in the corridors.

And so was the anti-nuclear movement. With a few actions, both inside and outside the official negotiations venue, with some good programs at the NGO-shadow-conference (well-visited by officials who were locked out of the official venue due to capacity problems) we managed to make our voice heard and make very clear that the global environmental community will - despite being desperate about climate change and the lack of action by political leaders - never accept nuclear energy to be approved as part of the solution.

The Copenhagen Accord also decided that the developed countries will pledge US$ 30 billion for the period 2010 - 2012 to be spent on both adaptation and mitigation in developing countries. And the developed countries “commit to a goal of mobilizing jointly US$ 100 billion dollars a year by 2020 to address the needs of developing countries. This funding will come from a wide variety of sources, public and private, bilateral and multilateral, including alternative sources of finance”….. ”A significant portion of such funding should flow through the Copenhagen Green Climate Fund”.

So the crucial debate will be on which energy-technologies this money will be spent. The Accord is very vague on this. The only agreed-upon language on so-called flexible mechanisms and technology transfer is the following; “In order to enhance action on development and transfer of technology we decide to establish a Technology Mechanism to accelerate technology development and transfer in support of action on adaptation and mitigation that will be guided by a country-driven approach and be based on national circumstances and priorities”.

The decision on how this will work, and how to spend the money, will be taken in Mexico, in December. The ad-hoc umbrella ‘Don’t nuke the climate’ will decide in early spring about its further plans.
