Vermont Yankee and the collapse of the US nuclear power industry

Only eight months through, 2013 is already a remarkable year for the anti-nuclear power movement in the US. Where Germany is following a deliberate government-mandated path to phase out nuclear power entirely, in the US the atomic industry is simply collapsing on its own − aided by concerted and strategic grassroots organising campaigns and legal actions.

Entergy Corporation's August 27 announcement of the pending shutdown of the Vermont Yankee reactor at the end of its current fuel cycle was just the latest blow to the industry, which already has seen four other reactor shutdowns (the most in one year ever) and the abandonment of six proposed new reactors, not to mention cancellation of several power uprates. And more may be coming.

As economist Marc Cooper of the Vermont Law School's Institute for Energy and the Environment put it, "What we are seeing today is nothing less than the rapid-fire downsizing of nuclear power in the United States. It is important to recognize that the tough times the U.S. nuclear power industry faces today are only going to get worse."

And indeed, there are several − perhaps the word should be many − other reactors, both operating and proposed, that sit on the edge of the same intersection of cost and safety concerns that are bringing the industry down faster than anyone would have imagined just a year ago.

Conventional wisdom holds that it is the current abundance and dirt-cheap prices for natural gas brought about by the fracking boom that is undermining nuclear power, making it impossible for marginal ageing reactors to compete economically, much less for utilities to even consider extraordinarily expensive new reactors. When Duke Energy took a second look at its $24 billion Levy County, Florida project for example, it didn't take long for it to realise it could build the same amount of natural gas-fired capacity for a fraction of that amount.

Conventional wisdom isn't always wrong. And the availability of cheap natural gas is certainly taking its toll on the industry. There is no doubt that Wisconsin's Kewaunee reactor − by all accounts about as problem-free as an old reactor gets − would still be operating today if it could compete with low-cost gas. The UBS investment firm predicted Vermont Yankee's demise months ago, arguing that it couldn't compete in the regional marketplace.

Renewable energy

But over the long term, natural gas isn't what the nuclear industry should be most worried about. Clean alternatives to nuclear power, especially solar and wind, are growing at a frenetic pace as costs plunge. A rooftop photovoltaic system is now being installed in the US every four minutes, and that will become every 90 seconds by 2016.[1].

John Wellinghoff, the chairman of the Federal Energy Regulatory Commission, said in August 2013 that "Solar is growing so fast it is going to overtake everything." If a single drop of water on the pitcher's mound at Dodger Stadium is doubled every minute, Wellinghoff said, a person chained to the highest seat would be in danger of drowning in an hour. "That's what is happening in solar. It could double every two years," he said.[2]

The goal of a nuclear-free, carbon-free energy system by mid-century suddenly seems quite attainable. According to the Energy Information Administration, for the first five months of 2013, renewable energy sources (including hydropower) provided 18.48% more energy to the US than nuclear power. Solar grew by 32.26% from a year ago while wind grew by 20.99%, continuing a trend of the past few years. And this actually underestimates solar power: non-utility and small-scale (residential and commercial rooftop) photovoltaic systems don't show up as electric generation since to the utilities that provide generation statistics they represent only a reduction in demand.

Indeed, no one seems to know just how much rooftop solar power there is in the US, but with a new installation every four minutes, the amount is growing rapidly.

This movement toward small-scale distributed generation is turning the traditional utility model on its head and in the process scaring the pants off of utility officials. David Crane is CEO of NRG Energy, itself a major utility and operator of the two existing South Texas nuclear reactors. But after Fukushima, NRG dropped out of a project to build two new reactors there and is now betting heavily on solar power. Crane recently predicted to Business Week that "in about the time it has taken cell phones to supplant land lines in most U.S. homes, the grid will become increasingly irrelevant as customers move toward decentralized homegrown green energy."[3]

This coming change in the fundamental structure of electric utilities bodes poorly for large baseload power plants of any kind − especially nuclear power which cannot be powered up and down quickly − and has become another reason utilities are scrapping marginal power plants, both nuclear and coal.

Still, dinosaurs thrashing their tails didn't always go down easily, and neither do nuclear reactors. They have to be helped along by effective grassroots opposition.

Grassroots opposition

No one can doubt that Southern California Edison would still be trying to run the San Onofre reactors, even after their botched steam generator repair job, if it weren't for the sustained and stunningly-effective opposition mounted by Friends of the Earth and numerous grassroots groups in southern California, aided by the Nuclear Free California network formed in August 2011.

At Vermont Yankee, the history of protest and opposition dates back to the 1970s. While Clamshell Alliance protests at Seabrook were larger and got more attention, Vermont Yankee was a Clamshell target as well. The New England Coalition has been filing legal challenges in every venue possible for just about as long.

After having successfully closed the Yankee Rowe reactor in nearby western Massachusetts, the Citizens Awareness Network turned its attention to Vermont Yankee and the first Nuclear Free New England action camp was held there in 1998. Twenty-one people were arrested at the plant gates at the culmination of that camp on August 27, 1998. The reactor closed 15 years later to the day.

During those 15 years, CAN, the New England Coalition, VPIRG and more protested, lobbied, filed legal briefs, and never let up. New groups were formed, like the Shut It Down affinity group − composed entirely of women over 70 − which held monthly protests for more than eight years and often were arrested and the Sage Alliance, an umbrella group which brought together perhaps the largest Vermont Yankee protest ever in March 2012, more than 1,000 people in Brattleboro (which has a population of about 12,000), resulting in more than 130 arrests.

By the end, just about the entire state of Vermont was united against the reactor. The State Senate had voted 26-4 to close the reactor. The Governor wanted it shut, so did the entire Congressional delegation. Entergy had fought vigorously against all these efforts, and in early August had pretty much won a court victory that determined the state could not close the reactor on safety grounds, and that it was safety issues that had dominated the Senate's vote (though the decision left open the door for some different state actions that might have closed the reactor).

Some believe that Entergy closed the reactor now to keep that court victory as a precedent and prevent other state action that might also be viewed as precedent − Entergy also owns the much larger Indian Point reactors near New York City, where another major grassroots campaign, supported by Governor Andrew Cuomo, is underway to prevent relicensing and close them permanently.

The nuclear "renaissance" in the US began in the summer of 2007, when the first license application in more than 30 years was filed with the Nuclear Regulatory Commission, for the Calvert Cliffs-3 reactor in Maryland. On March 11, 2013 − the second anniversary of the Fukushima disaster − the NRC Commissioners upheld the denial of a license for that reactor, the first in this year's remarkable sequence of shutdowns, cancellations and abandonments. All that's left are two reactors under construction in Georgia (which state officials now admit they might not have approved in today's climate), two in South Carolina, and one old TVA reactor that's been under construction for three decades.

Instead of a renaissance, the nuclear industry is being routed. Its ageing reactors face safety issues, big repair bills and growing public opposition. Its new reactors are too expensive to build. And, scariest of all for nuclear utilities, their entire business model of large, inflexible baseload power plants is being challenged not by off-the-grid hippies, but by other utility executives who see the writing on the wall.

The 2013 collapse of the U.S. nuclear power industry may seem astounding today. Over the next few years, it's more likely to seem routine.

Two possible suppliers left for Jordan's first.  Jordan's first nuclear power plant will be supplied by either AtomStroyExport of Russia or the Areva-Mitsubishi Heavy Industries joint venture, Atmea.
The past three years have seen the Jordan Atomic Energy Commission (JAEC) whittle down a list of seven offers from four reactor vendors to the two announced on April 30. Jordanian official news agency Petra reported that the JAEC has decided to continue discussions with AtomStroyExport and the Atmea consortium, describing them as the two suppliers "best qualified" with the technology to best meet Jordan's requirements and needs. Both reactors still under consideration are advanced pressurized water reactors (PWRs) offering enhanced active and passive safety systems. The 1150 MWe Atmea 1 represents an evolution of French standard designs, and received preliminary safety approval from French nuclear regulators earlier this year. The AES-92 is a version of the VVER-1000 with enhanced safety and seismic features. Two AES-92 units are under construction at Koodankulam in India, while the closely related AES-91 is under construction at Tianwan in China. The JAEC will now continue discussions with the two shortlisted suppliers to resolve outstanding technical issues including the site selection process.

Charges dropped against Vermont Yankee protesters.
Prosecutors in Vermont are dropping criminal trespassing charges against 136 protesters who were arrested March 22,  at the corporate offices of the Vermont Yankee nuclear power plant. The protesters were arrested at the Entergy Corp. offices in Brattleboro. They refused to leave the property while demonstrating on the first day of the Vermont Yankee plant's operation after the expiration of its 40-year state license. On April 26, Windham County State's Attorney Tracy Shriver decided against moving forward with the charges given the limited resources of her office and the courts. "Weighing the seriousness of the criminal offences committed by the protestors against the time and means necessary to proceed with these cases has led me to decide against moving forward with these cases."

The Vermont Yankee plant, located in Vernon, has a new permit from the Nuclear Regulatory Commission to operate for 20 more years, but its state license is expired. Over a 1000 people took place in the March 22 protest. (see Nuclear Monitor 741: Showdown for Vermont Yankee).

Jaitapur: commemoration of death protestor. 
In India, opposition to nuclear projects is large. Besides the more publicized, but still rather unknown struggle at Koodankulam, the struggle at Jaitapur is fierce. On 18 April 2012, it was exactly one year ago that the people’s expression of anger against the proposed 9900 MW Jaitapur nuclear power project at Madban village of Ratnagiri district in Maharashtra was on full display. People were continuously protesting from 2005 on when the land acquisition was set in motion and against environment clearance granted by the central government. A group of furious women ransacked and burnt papers and furniture at the Nate police station. The tension between the police and the people mounted which culminated in the police firing causing the death of Tarbej Sayekar, a 27 year youth.

The people in the Jaitapur locality observed the first death anniversary of martyr Tarbej Sayekar by observing a bandh (Bandh originally a Hindi word meaning 'closed', is a form of protest. During a Bandh, a political party or a community declares a general strike) and once again opposing the Jaitapur power project. On this occasion, between 3 to 5 in the afternoon, a crowd of about 3000 people gathered together and offered their tributes to martyr Tarbej Sayekar by reading the Koran.

South Africa: environmental campaigner resigns from regulator.
Long-time environmental campaigner Mariette Liefferink has resigned from the NNR (South Africa's National Nuclear Regulator) citing her frustration over the organization's failure to deal with vulnerable communities exposed to dangerous mining waste. In 2009, the Minister of Energy appointed Liefferink, the chief executive of the Federation for a Sustainable Environment, to the board of the regulator to represent the concerns of communities affected by nuclear issues. But now she says: "I see no benefits to remaining on the board because I cannot raise the concerns of communities." "There are 1.6 million people living in informal settlements on or adjacent to radioactive waste... and there are no management plans in place." A number of 36 sites are identified as 'radiological hotspots' in the Wonderfonteinspruit area. These sites are radioactive because of the uraniferous nature of the ore, but "[T]here is still no physical evidence of rehabilitation."

"The communities living in radioactive mine residue areas are mostly informal settlements but no regulatory decisions have been take regarding their protection."

She ends her resignation-letter saying: "It has become evident that there is a fundamental anomaly between what I perceive as the duty of the Board and the NNR and the Board’s and the NNR’s understanding of their duties."

PE planned reactor project now decade delayed.
US: Progress Energy -not long ago considered to be in the forefront of the US's nuclear renaissance- said on May 1, it will delay building its planned Levy nuclear plant in Florida by another three years. The announcement sets back the twin reactor project to a 2025-26 time frame from the original planned date of 2015-17 for the reactors to come online and start generating electricity. The company also updated its cost estimate for the planned Florida reactors from US$17 billion. The new estimate is US$19 billion to US$24 billion. The estimates don't include the cost of debt interest, which would likely add hundreds of millions of dollars to the price tag.
The delay in Florida is also taking place in North Carolina. Progress had originally planned to add two reactors at the Shearon Harris nuclear plant in Wake County by 2020-21. But now those proposed reactors are not in the company's 15-year plan, which means they would not be added until 2027 at the earliest, and possibly much later.

Lithuania: no case for compensation Hitachi before 2015. On May 9, Lithuania's government gave its final approval to several plans aimed at "reducing its dependency on Russian energy sources", including the 1,350 ABWR nuclear power plant which it said could cost up to 7 billion euros (US$9.1 billion).

Lithuania has already initialled an outline plan with Hitachi-GE Nuclear Energy with aim to build it by 2020-2022 for about 5 billion euros. However, the Finance Ministry said in a statement the end cost for the project could be 6.8 billion euros.

Around 4 billion euros would be borrowed and the rest would come from the countries backing the project, Lithuania (38%), Latvia (20%) and Estonia (22%), as well as Hitachi (20%). Poland was originally part of the project, but dropped out.

On April 16, Lithuanian Finance Minister Ingrida Šimonytė, said Lithuania has time until March 2015 to cancel the Visaginas plant without having to pay high compensation to the Japanese company Hitachi. "Based on the information that I have, in the initial design stage, before a final decision to invest and build a nuclear power plant, financial risks, which may be incurred by Lithuania is very limited", said Šimonytė.

According to the President of the Parliamentary Committee on Budget and Finance, Kestutis Glaveckasa, however, Lithuania will be forced to pay billions in damages, if the government withdraws from the contract for the construction of nuclear power plant. But Šimonytė stresses that the Ministry of Finance is at the stage of analyzing the concession agreement, the Lithuanian government signed in late March with a Japanese corporation. Later, a draft agreement will be presented to Parliament.

Why the fuzz? Lauvergeon vs Lauvergeon.
Anne Lauvergeon, the former head of France's state-controlled nuclear group Areva accused French President Nicolas Sarkozy of wanting to try to sell a nuclear reactor to  Muammar Gaddafi's Libya at least until the summer of 2010. In interview published on April 10, on the website of L'Express weekly Lauvergeon said that Sarkozy proposed in July 2007 to sell a nuclear reactor to the Gaddafi government to be used to desalinate ocean water. Gaddafi, who ruled Libya for 42 years, was overthrown and killed in October by rebels backed by a NATO force in which French warplanes played a major role. Lauvergeon said she opposed the idea "vigorously". She said: "The state, which was supposed to be responsible, was supporting this folly. Imagine, if we'd done it, how it would look now!" Nothing new, one would imagine, but the interview received some resonance in the international press.

On July 2, 2007 Sarkozy signed an widely publicized global partnership agreement with Libya: the two countries "agree to enhance cooperation on the peaceful use of nuclear energy, possibly leading to a civilian nuclear power program". It paved the way for the potential export by Areva of an EPR reactor to Lybia. There are no documents showing Lauvergeon, at that time head of Areva, opposed such a deal then. Lauvergeon was fired June last year.

Sarkozy was defeated by socialist party candidate Francois Hollande in the presidential elections on May 6, 2012.

Metsamor operations officially extended.
The Armenian government formally decided on April 19 to extend operations at the Metsamor VVER 440/230 nuclear power reactor, apparently because there is a delay in its planned replacement by a new facility. "Taking into account possible time frames for the launch of the new atomic energy block in the Republic of Armenia and the need to maintain the country´s energy security and independence during that period, it is necessary to extend the exploitation period of the Power Block No. 2," Energy Minister Armen Movisian said at a cabinet meeting that approved the measure.

The government assigned the Ministry of Energy and Natural Resources to draw up by May next year a program of measures to ensure Metsamor´s longer-than-planned operations and their safety. The program will have to be submitted to the government for approval by September 2013. The construction of the new reactor is currently planned in 2013.

Metsamor was due to be decommissioned by September 2016 in accordance with the 30-year design life span. Armenia and in particular the area where Metsamor is located is an extreme seismic active area.

Construction of Ohma nuclear plant indefinitely delayed.
Japan’s Electric Power Development Co has decided to delay the construction of its Ohma nuclear power plant indefinitely. The plant, which is under construction in Aomori prefecture (northern Honshu), was expected to be complete in late 2014. However, construction has been suspended since the Great East Japan Earthquake in March 2011. J-Power said in a statement that it is ‘moving ahead to review safety enhancement measures in response to the accident at Fukushima Daiichi’ and that it would incorporate any necessary measures.

Work started on the Ohma plant, a 1383 MW Advanced Boiling Water Reactor (ABWR) design, in May 2008. Originally due to start up in 2012, J-Power amended its scheduled start date to November 2014 towards the end of 2008. The Ohma plant has been designed to (eventually) run on a full mixed oxide (MOX) core. In 2009 J-Power entered into an agreement with Global Nuclear Fuel Japan to procure the MOX fuel for Ohman, which was to be manufactured in France.

Vermont Yankee: 130 arrests.
More than 1,000 people turned up in Brattleboro to march the 6 km from the town common to Entergy’s offices. Over 130 people trespassed on the company’s property and were arrested. Signs carried by the 1,000 protestors had messages like “time’s up” and “Entergy corporate greed”. March 22, was a monumental day for residents of the tri-state area near the Vermont Yankee nuclear power plant. Forty years after the plant opened, its license expired the day before, but the plant continued to operate pursuant to a federal court order.

The plant’s continued operation sets a precedent nationwide in the nuclear as well as in the legal realm. Earlier this year, federal Judge J. Garvan Murtha issued a ruling finding two Vermont laws requiring legislative approval for the plant to continue operating were unconstitutional as pre-empted by federal law. The plant hasn’t received a new license to replace the one that expired this March. The Vermont Public Service Board has yet to issue an order on the new license and no one has ordered the plant to cease operating in the interim. Entergy does have a license from the Nuclear Regulatory Commission, but its state license is expired. The company argues state law allows it to operate while the Public Service Board proceeding to approve a new license goes on.

Meanwhile the state and Entergy have appealed Judge Murtha’s decision to the Second Circuit Court of Appeals. Legal experts say the case could have national ramifications. (More in Nuclear Monitor 741, 3 Febr. 2012: Showdown time for Vermont Yankee).

Bidding process starts for Olkiluoto-4.
The Finnish nuclear power company Teollisuuden Voima (TVO) has started a bidding process for their Olkiluoto 4 project as a part of the bidding and engineering phase. Bids for the new nuclear power plant are expected at the beginning of 2013. TVO reported on March 23, that there are five plant supplier alternatives at the bidding phase of the OL4 project, namely the French installation company Areva, the American GE Hitachi, Korea Hydro & Nuclear Power in South Korea, as well as Mitsubishi Heavy Industries and Toshiba in Japan. TVO is not willing to take a stand on whether the difficulties and problems experienced by the Olkiluoto 3 project will have any influence on the possibilities of Areva's involvement.

TVO is to submit an application for a building permit by the summer of 2015. In April 2010, Finland's previous government decided to grant a permit to IVO for the construction of a new reactor in Olkiluoto. The decision was approved by Parliament in July 2010. According to TVO, the electric power of the new plant unit will be in the range of 1,450 to 1,750 MWe, while the projected operational life time of the new reactor is at least 60 years.

NRC approves COL for V.C.Summer.
The U.S. Nuclear Regulatory Commission (NRC) on March 30 approved the combined construction and operating licenses (COL) for the V.C. Summer nuclear power plant in South Carolina, just the second construction license approved for a nuclear plant since 1978. The NRC voted 4-1, just as the Commission did for the Plant Vogtle COLs. The NRC is expected to issue the COLs within 10 business days.

South Carolina Electric and Gas Co. and South Carolina Public Service Authority, or Santee Cooper, the owners and operators of the existing single-unit, 1,100 MW V.C. Summer plant, submitted the application for two new 1,117 MW Westinghouse AP1000 reactors to be built at the site in March 2008. The US$10 billion project, adjacent to the company’s existing reactor approximately 40 km northwest of Columbia, S.C., began in 2009 after receiving approval from the Public Service Commission of South Carolina.

The NRC did impose two conditions on the COLs, with the first requiring inspection and testing of squib valves, important components of the new reactors’ passive cooling system. The second requires the development of strategies to respond to extreme natural events resulting in the loss of power at the new reactors.

Search for Jordan's reactor site expands after protests.
The search for a potential site for Jordan's first nuclear reactor in Mafraq has expanded by a 40 kilometer radius. Officials are searching for a site near the Khirbet Samra Wastewater Treatment Plant, which, according to current plans, is to serve as the main water source to cool the 1,000 megawatt reactor.

According to a source close to the proceedings, the government directed the Jordan Atomic Energy Commission (JAEC) to find an alternative to the initially selected site, Balaama, near Mafraq, after coming under political pressure from tribal leaders and prominent local residents.  The announcement of the transferral of the planned site for the Kingdom's first nuclear reactor from Aqaba to Mafraq in late 2010 prompted a backlash from local residents, who held a series of protests and rallies over the past year urging decision makers to go back on their decision.

IAEA: safety concerns over aging nuclear fleet.
A 56-page IAEA document highlights safety concerns of an ageing nuclear fleet: 80%  of the world's nuclear power plants are more than 20 years old, and about 70 percent of the world's 254 research reactors have been in operation for more than 30 years "with many of them exceeding their original design life," the report said. But according IAEA Director General Yukiya Amano nuclear power is now safer than it was a year ago. The report said the "operational level of nuclear power plant safety around the world remains high".

"There are growing expectations that older nuclear reactors should meet enhanced safety objectives, closer to that of recent or future reactor designs," the Vienna-based U.N. agency's annual Nuclear Safety Review said. "There is a concern about the ability of the ageing nuclear fleet to fulfill these expectations."

Japan after Fukushima: 80% distrust government's nuke safety measures.
A whopping 80 percent of people in Japan do not trust the government's safety measures for nuclear power plants. The results are from a nationwide random telephone survey of 3,360 people conducted by The Asahi Shimbun on March 10-11. It received 1,892 valid responses. Fifty-seven percent of the respondents said they are opposed to restarting nuclear reactors currently off line for regular maintenance, compared to the 27 percent in favor. A gap between genders was conspicuous over whether to restart the reactors. Although men were almost evenly split, with 47 percent against and 41 percent in favor, 67 percent of women are opposed, compared with just 15 percent who support the restarts.

Regarding the government's safety steps for nuclear plants, 52 percent said they "do not trust so much," and 28 percent said they "do not trust at all." Although the government has been proceeding with computer-simulated stress tests on reactors, which are necessary steps to reactivate them, people apparently have a deep distrust of the government's nuclear safety provisions.

Tepco: water level reactor #2 wrong by 500%.
Tepco is reporting that the results of an endoscopy into reactor #2 at the Fukushima Daiichi nuclear plant show that water levels are far lower than previously thought. The utility had estimated that water in the reactor, which is required to keep melted fuel cool and prevent recriticality, was approximately three meters deep. In fact, it is only 60 cm deep. Tepco insists that the fuel is not in danger of overheating, and continues to pump in nine tons of water every hour. However, experts say that the low water levels show that leaks in the containment vessel are far greater than previously thought, and may make repairing and decommissioning the crippled reactors even more difficult. Tepco attempted an endoscopy in January, but the effort failed because the scope used was too short.

Tokyo soil samples would be considered nuclear waste in the US.
While traveling in Japan in February, Fairewinds’ Arnie Gundersen took soil samples in Tokyo. He explaines: "I did not look for the highest radiation spot. I just went around with five plastic bags and when I found an area, I just scooped up some dirt and put it in a bag. One of those samples was from a crack in the sidewalk. Another one of those samples was from a children's playground that had been previously decontaminated. Another sample had come from some moss on the side of the road. Another sample came from the roof of an office building that I was at. And the last sample was right across the street from the main judicial center in downtown Tokyo."

Gundersen (an energy advisor with 39-years of nuclear power engineering experience) brought those samples back to the US, declared them through Customs, and sent them to the laboratory. And the lab determined that all of them would be qualified as radioactive waste there in the United States and would have to be shipped to a radioactive waste facility to be disposed of.

Canada: court case against 2 new reactors Ontario.
A group of environmentalists has gone to court to challenge Ontario's plan to build new nuclear reactors, arguing the environmental risks and costs involved haven't been properly assessed. Lawyers for Ecojustice and the Canadian Environmental Law Association have filed arguments in Federal Court on behalf of several green agencies, saying a review panel failed to carry out a proper environmental assessment on building new reactors at the Darlington station in Clarington, Ontario. Despite a push for green energy projects, Ontario remains committed to nuclear energy, which makes up 50 per cent of its energy supply, and is moving forward with the construction of two new reactors. But the groups, which include Greenpeace, Lake Ontario Waterkeeper, Northwatch  and the Canadian Environmental Law Association, argue the government provided only vague plans to the federal government-appointed review panel, which nonetheless recommended the project be approved. They argue that, contrary to the requirements of the Canadian Environmental Assessment Act, the panel also didn't gather the evidence required to evaluate the project's need and possible alternatives.

The groups are asking Federal Court to order the review panel to take a second look at the project. A proper environmental study, the groups add, is especially important after lessons learned from the disaster at Japan's Fukushima nuclear plant. They also note that the government didn't select a specific type of nuclear reactor, making its possible impact difficult to assess. "Despite the profound lack of critical information regarding the project's design and specific means by which the radioactive waste it generates will be managed, the (joint review panel) report purports to conclude that no significant environmental effects are likely," said the court filing, obtained by The Canadian Press. That assumption implies that the "sizable information gaps" will be eventually considered by other bodies, and that "numerous to-be-determined mitigation measures" will be implemented. Such a "leap before you look" approach, the filing adds, "is the antithesis of the precautionary principle, and should not be upheld by this honourable court."

Alla A. Yaroshinskaya describes the human side of theApril 1986 Chernobyl disaster, with firsthand accounts. Twenty-five years later, the author reviews the latest medical data and the changes in the health of 9 million Chernobyl victims in over two decades since the nuclear blast. Dounreay: 'significant' hot particle found on beach.
Experts have discovered the most significant radioactive particle yet on a public beach two miles (approximately 3km) west of the redundant nuclear site of Dounreay, Scotland, UK. Dounreay clean-up contractor DSRL has informed the Scottish Environment Protection Agency of additional tests being carried out on a particle recovered during routine monitoring of a beach near the redundant nuclear site. The particle was detected at the water's edge at Sandside. The beach at Sandside is located. The particle - detected on February 14 - was the 208th to be recovered from the beach at Sandside in the last 15 years.

Provisional checks carried out on the beach indicated the particle had a higher than normal beta dose rate. A spokesman for DSRL said it was the first time a particle classed as significant - the highest classification in terms of radioactivity - had been found on the beach, although many had been found on the seabed and foreshore at Dounreay as well as on the site itself. Any particle with radioactivity above one million Becquerel (Bq) units is classed as significant.

Work is due to resume in May to clear particles from the seabed near the site. More than 1800 have been recovered so far from the seabed where there is evidence of a "plume" from historic effluent discharges dating back 50 years. Particles are fragments of irradiated nuclear fuel.

Defend democracy; Unite to shut Vermont Yankee down!
In 2010, the citizens and legislature of the State of Vermont, with support from their neighbors in Massachusetts and New Hampshire, decided to close the Vermont Yankee nuclear reactor permanently by March 21, 2012, when VY's 40-year license expires. In 2011, Entergy, the New Orleans mega-corporation that owns Vermont Yankee, sued the State of Vermont, defying the democratic will of the people, to keep their aged, accident-plagued reactor running for 20 more years. On January 19, 2012, federal district court judge J. Garvin Murtha sided with Entergy against the State of Vermont and the people of New England. On February 18, the State of Vermont appealed Murtha's ruling. With the future of VY still hanging in the balance, nonviolent citizen action is more important than ever.

Let us make clear: We will NOT allow unbridled corporate power to deprive us of our inalienable right to live in safety on our homes, and to determine our own energy future – a future that is safe and green for our children and our children's children. Many events have taken place and will take place to shut Vermont Yankee down. The most important one is 'Occupy Entergy HQ' on March 22. There will be a brief rally at the Brattleboro, VT Commons starting at 11:00am, then a walk to Entergy Headquarters on Old Ferry Rd. in Brattleboro (3.5 miles) where there be a direct action, likely to include civil disobedience.

Franco-British nuclear cooperation agreement.
On February 16, UK Prime Minister Cameron met his French counterpart Nicolas Sarkozy in Paris at a joint summit for the first time since their bitter clashes over Europe. The joint declaration on energy made contained a range of goals, the greatest of them being to encourage "the emergence of a Franco-British industry that is highly competitive across the whole supply chain at the international level." Most prominent in this will be the work of France's majority state-owned firms EDF and Areva and their cooperation with privately held UK firms for the construction of new reactors in Britain.

The agreement to co-operate on developing civil nuclear energy is meant to pave the way for the construction of new nuclear power plants. It was accompanied by the news of a deal between Rolls-Royce and French nuclear reactor developer Areva. Areva has asked Rolls to make complex components and provide engineering and technical services for two reactors to be built at Hinkley Point, Somerset.

But not everybody is confident that the agreement will bring much for Britian's industry. According to Tim Fox, head of energy at the Institution of Mechanical Engineers "Although some relatively small contracts are to be awarded to Rolls-Royce and BAM Kier, it looks increasingly likely that the vast majority of the contracts involved in the manufacture and construction of the new nuclear reactors at Hinkley Point and Sizewell will go to France rather than the UK." Friends of the Earth's Energy Campaigner Paul Steedman said: "Cameron's deal today will leave British taxpayers footing a massive bill for new nuclear plants we don't need and can't afford - while EDF continues to rake in huge profits."

Meanwhile at Hinkley Point ….
From Febr. 12 on, following an occupation of trees a week earlier, activists are occupying a farmhouse close to Hinkley Point, to stop EDF Energy trashing land for the planned new nuclear power station. Anti-nuclear campaigners have been joined by members of Seize the Day as the first residents of Edf-Off Cottage which is on the 400-acre site earmarked for two new reactors.

At the High Court on February 27, EDF Energy failed in their bid to impose an injunction to stop an alliance of anti-nuclear groups from protesting on the 400-acre site set aside for two new mega-reactors at Hinkley Point. This injunction was being sought to remove these campaigners, but it was simultaneously designed to restrict future demonstrations. The Orwellian language even prohibits campaigning groups from 'encouraging other persons' to protest at the site. Speaking on behalf of the Stop New Nuclear alliance, Kate Hudson from CND stated "It should be inconceivable that private companies could restrict basic civil liberties in this way. They are not the arbiters of the nuclear debate, nor the guarantors of our freedoms. We will fight to ensure the rights of future generations to peaceful protest and to preserve essential democratic principles."

On 10 and  11 March, one year since the Fukushima nuclear disaster began, antinuclear groups call for a human chain/blockade around the station to show "our determined opposition to new nuclear".

Spain: OK for 41-year old Garona life extension. Spain's nuclear security agency CSN has determined that the country's oldest nuclear reactor, the 468 MW Santa Maria de Garona nuclear power plant, is safe to operate until 2019, in response to a request by the industry minister to review the installation. The approval, disclosed on February 17, clears the way for the recently installed Spanish conservative government to overturn the previous socialist government's 2009 order to have the generator closed in 2013. Although the CSN said there was "no safety or security issue that should impede continued operation of the power plant", the agency added that it would still have to review any formal application by the operator to extend the installation's license, including scrutiny of its latest operating data and future security measures being considered. Garona was first connected to the grid in March 1971!
The CSN in 2009 had given authorization for the station to operate for another 10 years, but the government at the time opted instead for an earlier expiration date. Since then, new regulations have been put in place, particularly following the accident at Japan's Fukushima nuclear power plant early last year.

World oldest reactor (44 years) closed. The world's oldest operating nuclear power reactor – Unit 1 of the Oldbury nuclear power plant in the UK - has been closed after 44 years of power generation on 29 February 2012. Unit 2 was shut down in June 2011, while unit 1 was expected to continue operating until the end of this year. Plant operator Magnox Ltd announced last October that it had decided to end operations ten months early as it was "no longer economically viable."

Beznau now oldest in world; call for closure.
After Oldbury's closure, Switzerland's Beznau nuclear plant holds the dubious record of being the oldest nuclear plant in the world and should be shut down, a group of environmental organizations said on February 23. Switzerland is phasing out nuclear energy but not fast enough, say the groups. They list a number of problems and point out that the company that runs it is planning to increase the earmarked CHF500 million (US$ 557m or 415m euro) to make it safe, money they believe could be better spent shutting it down and moving to safer energy sources.

U.S.: Fourth Legislative Attack on Grand Canyon Uranium Ban Fails… The fourth legislative attempt to block the Obama administration's ban on new uranium development across 1 million acres of public land surrounding Grand Canyon National Park died February 14, when the House rules committee ruled it out of order. The amendment was sponsored by the same three Republican congressmen who sponsored three previous failed anti-Grand Canyon legislative proposals - Jeff Flake, Trent Franks and Paul Gosar, all from Arizona. The most recent amendment sought to overturn a January decision by Interior Secretary Ken Salazar enacting a 20-year 'mineral withdrawal' that bans new mining claims and development on existing claims lacking rights-to-mine across Grand Canyon's million-acre watershed (see Nuclear Monitor 740, 13 January 2012, In Briefs).

In 2010 and again in 2011, Flake, Franks and Gosar sponsored legislation that would have prohibited the Interior Department from enacting the mining ban; in 2011 they attempted to add a rider to a budget bill - their third failed attempt prior to this most recent amendment.

Over the past few years, nearly 400,000 people from 90 countries wrote the Department of the Interior urging it to ban new uranium mining around the canyon after a uranium boom threatened to bring a new wave of destructive mining threatening recreation, tourism, wildlife habitat and waters in Grand Canyon National Park. The mining ban has won wide support among American Indian tribes, regional businesses, elected officials, hunting and angling groups, scientists and conservationists.

….but next attack imminent. The withdrawal of lands in northern Arizona from mining activities is unconstitutional, unlawful and violates the National Environmental Policy Act, said organisations representing the US mining and nuclear industries in a lawsuit against US Interior Secretary Ken Salazar.

The suit has been filed with the US Federal District Court in Arizona by the National Mining Association (NMA) and the Nuclear Energy Institute (NEI), the US nuclear energy industry's organization. The Department of the Interior (DoI), US Bureau of Land Management (BLM), US Forest Service and US Department of Agriculture are named as co-defendants alongside Salazar, in his capacity as Interior Secretary.

The NEI and NMA argue that Salazar does not have the legal authority to make withdrawals of public lands in excess of 5000 acres, citing a landmark 1983 Supreme Court ruling that such withdrawals would be unconstitutional. Furthermore, they claim, the decision to withdraw the land is "arbitrary, capricious, and not in accordance with law." Finally, the environmental impact statement (EIS) and record of decision on the withdrawal violate the terms of the National Environmental Policy Act (NEPA) in failing to take a "hard look" at the economic and environmental consequences of the withdrawal.

Finland: Uranium mine granted permission.
The Finnish Talvivaara mine today gained permission to extract uranium and process it into uranium oxide. The UO4 would be transported away by rail and ships, possibly to Russia. The mine was opened a few years ago mainly as a zinc mine. It's using an experimental biosoaking process to extract small amounts of minerals from the ore. The company has been crippled by scandals from the beginning, with sulphuric acid and other chemicals continuously spilling all over nearby woods and lakes. The company has failed to make any profit so far and its CEO was forced to quit last year.

In a strange technocratic turn of events, the environmental authorities concluded that instead of closing down the mine, it would be beneficial to grant the mine a permission to separate the uranium from the rest of the waste so that the further spills bound to happen at least wouldn't contain radioactive materials. As a last minute effort, environmentalists tried to convince the government to at least demand a description of the separation process so as to ensure this doesn't just produce a lot more radioactive/toxic sludge. The government decided not to do so and instead just granted the permission "because it brings 40 million euros worth of investment to the area".

The local municipality and just about every major business in the area was opposed to the permission after the previous scandals and their trade being spoiled by the smelly pollution in the environment.

Rosatom-owned company accused of selling shoddy equipment to reactors.
Russian Federal Prosecutors have accused a company owned by the country’s nuclear energy corporation, Rosatom, with massive corruption and manufacturing substandard equipment for nuclear reactors under construction both at home and abroad.  The ZiO-Podolsk machine building plant’s procurement director, Sergei Shutov, has been arrested for buying low quality raw materials on the cheap and pocketing the difference as the result of an investigation by the Federal Security Service, or FSB, the successor organization to the KGB. It is not clear how many reactors have been impacted by the alleged crime, but reactors built by Russia in India, Bulgaria, Iran, China as well as several reactor construction and repair projects in Russia itself may have been affected by cheap equipment, given the time frame of works completed at the stations and the scope of the investigation as it has been revealed by authorities.

The future of the Vermont Yankee reactor remains murky following a federal judge’s January 19 ruling against state laws that would have required the shutdown of the reactor at the end of its original license period on March 21, 2012.

U.S. District Judge J. Garvan Murtha ruled that two state laws intended to prevent Vermont Yankee from operating after that date are pre-empted by the Atomic Energy Act, which gives all power to the federal Nuclear Regulatory Commission for regulation of nuclear power on safety or radiological grounds and forbids states from enacting their own laws on such issues.

That would appear to be a clear-cut victory for the Entergy Corporation, which owns the troubled reactor. But as is often the case with nuclear power issues, the outcome of this ongoing saga remains uncertain.

At Nuclear Monitor presstime, the state had not yet announced whether it would appeal the decision -and there do appear to be some grounds for appeal. Judge Murtha’s ruling was based not on the actual language of the Vermont laws, but on the fact that many state legislators had frequently and publicly expressed serious concern about the safety of the reactor during deliberations on the laws. In other words, Judge Murtha went after what he perceived as the motivations for the laws, rather than the laws themselves. Considering that there may be multiple motivations for nearly every law a legislature enacts, this would seem to be on slippery ground.

A little background: in 2002, Entergy agreed that the Vermont Public Service Board would have to issue a new Certificate of Public Good (CPG) to allow Vermont Yankee to continue operating, even if a license extension were granted by the Nuclear Regulatory Commission. The Public Service Board does not deal with nuclear safety issues; rather it focuses on rates, quality of service, environmental matters generally, and radioactive waste storage and decommissioning issues -which courts have ruled can fall under state authority.

In 2006, with Vermont Yankee’s operations under mounting criticism within the state, the Vermont legislature passed a law requiring approval from both houses of the legislature for the Public Service Board to issue a CPG. And in February 2010, following revelations of radioactive tritium releases and other problems, the Vermont Senate voted 26-4 against allowing the Board to issue the CPG.

It was the 2006 law, and another related law, that the judge struck down. However, the judge also ruled against Entergy on another issue, and determined that the Vermont Public Service Board must still issue the CPG for Vermont Yankee to continue operating. Entergy has now applied for the CPG; it isn’t known at this point whether the Board will reflect the overwhelming sentiment of Vermonters and deny the Certificate, or whether it will allow the reactor to continue operating.

Meanwhile, in a separate legal proceeding, the State and the grassroots New England Coalition on Nuclear Pollution have gone to court to argue that the NRC’s license extension for Vermont Yankee should be nullified because Entergy did not apply for a needed permit under the federal Clean Water Act. Entergy and the NRC have responded that the company did have a different but similar permit. States have a clear right to regulate water discharges from nuclear reactors.

Judge Murtha’s decision was met with outrage by those who have been fighting Vermont Yankee for years. Protests have taken place across the state—from the reactor gates in the south to a march by Occupy Burlington in the north. A number of actions will take place throughout March, including a mock evacuation on March 11 (Vermont Yankee is a Fukushima-clone GE Mark I reactor), a “retirement party” for Vermont Yankee on March 21 and nonviolent civil disobedience the next day, culminating in a major rally on April 1 in Brattleboro just a few miles from the reactor site. The actions are being coordinated by the SAGE Alliance (of which NIRS is a member) and more information can be found at http://sagealliance.net/action_center. The Alliance is also asking grassroots groups across the country to support Vermont Yankee shutdown efforts by holding support rallies at Entergy-owned facilities everywhere during March.

Refueling vermont yankee to continue

Entergy Corporation has announced that its board of directors has voted to continue with a planned refueling of the Vermont Yankee Nuclear Power Plant (Vermont, USA). The board has approved the US$60 million refueling during despite failing to receive a 20-year extension of its license to operate the nuclear plant from Vermont's legislature. Vermont Yankee's current operating license is due to expire March 2012.

On February 24 2010, in a move that sent shock waves through the nuclear power industry, the Vermont State Senate voted overwhelmingly (24-6) to close the Vermont Yankee reactor when its current operating license expires in March 2012. Later that same year, on November 2, the people of Vermont elected Peter Shumlin as Governor. Shumlin is a well known opponent of extending the Vermont Yankee license past its expiration date in 2012.

Vermont is the only state in the country with a law giving its Legislature a say over a nuclear plant's re-licensing. In the memorandum of understanding (MOU) that Entergy signed when it bought the plant in 2002, it agreed to seek a state-issued Certificate of Public Good and not sue the state if the CPG was denied. The Vermont Senate voted last year to direct the Public Service Board not to issue a Certificate of Public Good (CPG) for the plant. Despite all that, Entergy received a 20-year license extension from the U.S. Nuclear Regulatory Commission (NRC) in March 2011.

In April, two of Entergy's units, Entergy Nuclear Vermont Yankee LLC and Entergy Nuclear Operations Inc., filed a complaint in U.S. District Court for the state of Vermont seeking a judgment to prevent the state of Vermont from forcing the plant to cease operation on March 21, 2012. On July 18, the Court issued a decision denying a preliminary injunction motion filed by the two units.

Federal law does not forbid individuals from raising safety or reliability concerns, said Parenteau, nor does it block lawmakers from addressing these concerns in the legislative process. However, the law does forbid nuclear safety regulation by the states. “The NRC will decide if that plant is safe, whether we like it or not.” The U.S. Supreme Court ruled on states’ power to regulate a nuclear power plant in the 1983 Pacific Gas & Electric v. State Energy Commission case. In its ruling, the court stated clearly that states can shut power plants for non-radiological safety reasons. But that same PG & E case also gives companies grounds to sue if a state enacts a law that blocks a plant. Entergy did not sue Vermont in 2006 over the Legislature gaining the right to vote on the awarding of a CPG.

The Court Case is due to start in September.

On June 30, fifteen women, included three women in their nineties (Valerie Mullen, 90; Frances Crowe, 92 and Lea Wood, 94) of the Shut It Down Affinity Group were arrested at the Vermont Yankee nuclear power plant  and charged with trespass after advocating for replacing nuclear power with solar power.

IAEA-DG: less watchdog, more lobby.

International Atomic Energy Agency Director General Yukiya Amano presenting his first report to the UN General Assembly on November 8, said that he aims to change the widespread perception of the agency as the world's "nuclear watchdog." The label "does not do justice to our extensive activities in other areas, especially in nuclear energy, nuclear science and applications, and technical cooperation." Established by the UN in 1957 as the "Atoms for Peace" organization, the Vienna-based IAEA gained its reputation as the world's nuclear watchdog from its nuclear verification activities and reports of "non-compliance" by states that have failed to abide by the safeguards imposed by the agency. As countries consider introducing nuclear energy and expanding their nuclear power, the IAEA will need to cement its role in assisting such developments. "When countries express an interest in introducing nuclear power, we offer advice in many areas, including on how to put the appropriate legal and regulatory framework in place and how to ensure the highest standards of safety and security, without increasing proliferation risks," he said.  Amano added that "access to nuclear power should not be limited to developed countries but should be available to developing countries as well."

The IAEA chief encouraged international lending institutions to place greater consideration in funding nuclear power projects, as he drew the Assembly's attention to practical applications of nuclear energy. Meanwhile, cables leaked by Wikileaks show cosy US relationship with IAEA chief. When Yukiya Amano took over as the head of the UN nuclear watchdog last year, American diplomats described him as "director general of all states, but in agreement with us"

 A radioactive rabbit was trapped on the Hanford nuclear reservation (USA), and Washington state health workers have been searching for contaminated rabbit droppings. The Tri-City Herald reports that officials suspect the rabbit sipped some water left from the recent demolition of a Cold War-era building used in the production of nuclear weapons. The rabbit was trapped in the past week and was highly contaminated with radioactive cesium. It was killed and disposed of as radioactive waste.

Only one rabbit sipped from that water? No because a few weeks later, radioactive mouse-droppings were found. It has been difficult to find mice in the current cold and snowy weather. Sixty mouse traps were set, but the two mice reported trapping and killing the holiday were not contaminated. Now PETA, People for the Ethical Treatment of Animals, is asking to stop killing mice in search for contaminated ones. “Live traps should be used to catch mice and then they can be released or humanely euthanized as appropriate after they are checked for radioactivity,” PETA writes. Hanford currently is the most contaminated nuclear site in the United States and is the focus of the nation’s largest environmental cleanup. Last year, 33 contaminated animals or animal materials such as droppings were found on the site.

US: Vermont elects Governor that wants Vermont Yankee closed.

In an extremely close race on the November 2 House of Representatives elections, Peter Shumlin (D) defeated Brain Dubie (R) and will be the next Governor of the state of Vermont. Shumlin is an avowed opponent of extending the license of the Vermont Yankee nuclear power plant in Vernon past its expiration in 2012, citing the plant's leaks and other problems and its owners' poor record in dealing with state officials. Dubie was open to granting the plant an extension to operate and wanted decisions about the Vermont Yankee’s future made by "experts" at the Nuclear Regulatory Commission and the Vermont Public Service Board.
In February, in a 26 to 4 vote, the Vermont Senate decided that the continued operation of the 38-year-old nuclear reactor was not in the best interest of Vermonters. Entergy, which owns the decrepit 38 year old reactor, has vowed to challenge the state and attempt to relicense the reactor.When Entergy bought the reactor, the corporation agreed that the State of Vermont would decide whether splitting atoms beyond the 40 year license was in the best interest of Vermonters.
Within hours of the election of Peter Shumlin as the next Governor of Vermont, Entergy put the aging Vermont Yankee nuclear plant up for sale. According to Entergy, dumping the aged reactor from their books would benefit their stockholders. But Entergy's announcement has everyone wondering, who in their right mind would buy this rust bucket of a reactor?

Just days after the announced sale, Vermont Yankee was forced into an emergency shutdown due to radioactive leaks, this time inside the nuclear plant. Entergy should behave like a responsible corporate citizen and begin preparations to permanently shut down Vermont Yankee as scheduled.

First victory for Finnish campaign on nuclear investors.

Early November, Greenpeace started a campaign aimed at a group of investors in the E.ON/Fennovoima nuclear project. One of them, with a 3% share, is Finland's largest retail & service chain called S-Ryhmä ("S Group"). On November 25, two of their regional subsidiaries, including the Helsinki area one with most weight, have pulled out. This is a very quick result, quicker than expected. The pulling out is financially small but psychologically very important. There was a major feeling of apathy and inevitability and a lot of people thought there is no more fight to be fought. With at least a year to go to the investment decision, with the cost doubled from 4 to 8 billion euro and timetable pushed back by a couple of years, there is a good chance of splitting the investor coalition. This result will show the movement and the local groups that nothing is cemented and the investors can be swayed. The first, ongoing campaign push is aimed at Christmas sales so the timing could not be better to energize the movement.

Czech Republic: CEZ to pay its regulator?

The Czech Green Party has voiced its alarm at government proposals to change the law so that nuclear companies - principally the semi-state owned energy giant CEZ - would directly finance the budget of the state watchdog responsible for regulating their activities. The plans to amend the Atomic Act, which are still in the draft stage but could become  government policy within months, envisage saving 500 million Czech Koruna (Kc) (US$27.9  million or 25.1 million euro) from public spending over the next decade by asking nuclear firms to finance the State Office of Nuclear Safety (SUJB). Under the proposal, for example, the cost of the three permits needed to open a nuclear reactor would be increased to a total of 250 million Kc, with an annual operating fee of 30 million Kc thereafter. The opening and operation of new uranium mining facilities would also face additional fees, as would the storage of spent nuclear fuel.

The Green Party (SZ) has strongly criticized the proposals, saying the nuclear company should not be allowed to directly fund its own regulation and arguing the state is already being governed by CEZ rather than the other way round. "If it is the case that direct funding of SUJB would be moved under CEZ, that is obviously alarming," SZ spokesman Tomáš Průša said to the ‘The Prague Post’. CEZ and other semi-state firms should be taxed like private companies, he said it was important to maintain a system of indirect funding under which "the state collects fees that then become part of state budget revenue." "An independent regulator can never be under the direct financial influence of the regulated." The Greens believe that CEZ, the country's largest energy firm, was already under-regulated even before this proposed change.

Germany: higher cancer rates near Asse radwaste dump.

Newly published figures from the Lower Saxony state cancer registry show that in the area around Asse, the site of the controversial nuclear waste dump Asse, some cancer rates are higher than normal. Between 2002 and 2009 there were 12 cases of leukemia in the greater Asse region. The area had twice the rate expected for men. While there was no significant  increase in leukemia for women, their rate of thyroid cancer was three times as high as normal. The government has not yet determined if the increase is related to the proximity to the nuclear waste site. A working group of representatives from Lower Saxony’s environment, social, and health ministries as well as the federal agency for radiation protection is set to meet to take a closer look at the data. Asse was originally a salt mine. Between 1967 and 1978 around 126,000 drums of low- and intermediate level waste were stored in the facility. More recently it's been declared unstable because of a danger of collapse and water leaks and is due to be emptied out and shut down.

Kenya (Kenya?) seeks sites for nuclear power plant.

The government of Kenya has formed a committee to help identify sites for the construction of a nuclear power plant along its coast, and ensure that all terms and conditions of the International Atomic Energy Agency (IAEA) necessary for the approval of a nuclear power plant are met. "Prepare and endorse a detailed road map for the realisation of these terms and conditions indicating the milestones and time lines for approval by the IAEA," Energy Minister Kiraitu Murungi said in the notice, outlining the mandate of the 13-member committee. Earlier this year, Kenya's National Economic and Social Council (NESC) recommended that east Africa's biggest economy embark on a program to start generating nuclear energy by 2020 to meet its growing demand for electricity. Kenya relies on hydropower to generate about 65 percent of its electricity but has began channelling investments towards geothermal plants and wind farms to diversify energy sources.

Kenya's main electricity producer, KenGen, is already hunting for a partner to produce nuclear power by 2022 to help match-up rising demand and diversify from hydropower. The power producer projects that Kenya as a whole could produce some 4,200 megawatts (MW) using nuclear by 2022.

Court greenlights lawsuit seeking to open Yucca.

A federal appeals court has ruled that a lawsuit seeking to relaunch plans for a Yucca Mountain nuclear dump can go forward. The lawsuits had been on hold while the District of Columbia Circuit Court of Appeals waited for the Nuclear Regulatory Commission to decide whether DOE had the authority to withdraw its license application for Yucca Mountain. In June, an NRC legal panel ruled that DOE must move forward with the license, but the NRC commissioners have not issued a required decision since then. The Department of Energy has until Jan. 3 to file a brief defending its authority to shut down the site. The states of Washington and South Carolina and the National Association of Utility Regulators filed the suit that insists only Congress can decide Yucca Mountain's fate. The plans were to bury at least 77,000 tons of highly radioactive spent nuclear fuel 90 miles northwest of Las Vegas.

RWE wins ‘Worst EU Lobbyists 2010’ Award!

RWE (npower), Goldman Sachs and derivatives lobby group ISDA have been given the  dubious honour of being named the Worst EU Lobbyists of 2010. The results of the dual climate and finance categories of the Worst EU Lobbying Awards 2010 were revealed on November 2, during a ceremony outside the ISDA office in Brussels. Citizens across Europe participated in an online public vote for the most deserving of the climate and finance nominees.

In the climate category, German energy giant RWE’s subsidiary npower, nominated for claiming to be green while lobbying to keep its dirty coal- and oil-fired power plants open, won with 58% of the total vote. BusinessEurope, nominated for its aggressive lobbying to block effective climate action in the EU while claiming to support action to protect the climate, took second place with 24% of the total votes and Arcelor-Mittal, the steel Industry “fat cat”, came in third with 18% of the total votes. Nina Katzemich, speaking for the organisers of the 2010 Worst EU Lobbying Awards, said: "These awards show that people around Europe are fed up with deceptive lobbying practices used by big business when it comes to climate regulation. RWE claims to be green but has pulled out all the stops to keep its dirty power plants open, promoting their profits over public interests. If the European Commission is serious about tackling climate change, it must stop listening one-sidedly to corporations.

Another location for Indonesia’s first nuclear power reactor.

The Indonesian government hopes to relocate the planned site of the country’s first nuclear power plant to Bangka island in Bangka Belitung province from Muria, Jepara, Central Java due to strong opposition from the local people. Public resistance has long been the main constraint for the government to build nuclear power plants. The previous plan to build a nuclear power plant in Muria, Jepara, Central Java, faced strong opposition from the local people and non-governmental institutions. Most people, particularly those living near planned nuclear power plant sites, have deep suspicion and distrust concerning the issues of the plant's operational safety.

National Atomic Energy Agency’s spokesman, Ferhat Aziz, said that people's rejection most likely came from negative opinions disseminated by anti-nuclear groups that prompted people to remember the nuclear reactor accidents on Three Mile Island, the United States, in 1979 and in Chernobyl, Ukraine, in 1985 (uh, again?). To address the public's negative perception of nuclear technology, he continued, his agency had to assist people to understand the urgency and benefits of having such technology for future electricity supply in the country.

Israel stops Mordechai Vanunu getting Carl von Ossietsky Prize in Berlin.

Israel has barred Mordechai Vanunu, who spent 18 years in jail for revealing secrets of the country's nuclear program, from going to Germany to accept a prize, organisers said on December 10. Accoding to a spokesman for the International League for Human Rights Vanunu was to be awarded the Carl von Ossietsky Prize in Berlin two days later, for his work promoting disarmament but has not received permission to leave Israel. The League decided to cancel the ceremony and held a protest rally on behalf of the 56-year-old former nuclear technician instead. The group had previously appealed to Israeli leaders to allow Vanunu to come to Berlin. The medal, which the League has bestowed annually since 1962, is named after a German pacifist who was awarded the Nobel Peace Prize in 1935 and died in a Nazi concentration camp in 1938. Vanunu served time for disclosing the inner workings of Israel's Dimona nuclear plant to Britain's Sunday Times newspaper in 1986. He was kidnapped and sentenced, released in 2004 but was banned from travel or contact with foreigners without prior permission.

Research report "The Uncertain Future of Nuclear Energy".

In late October, the International Panel on Fissile Materials (IPFM) has released a new research report ‘The Uncertain Future of Nuclear Energy’. The report provides an overview of the status of nuclear power worldwide, with country studies for China, India, Japan, South Korea, the United States and Western Europe. It discusses why the International Atomic Energy Agency and the OECD Nuclear Energy Agency project nuclear power as approximately maintaining but not greatly increasing during the next two to four decades its 14% of global electric power generation in 2009. The reasons include the currently very limited capacity to build nuclear power plants, high capital costs in North America and Western Europe, the perception by the private sector that nuclear power plants are risky investments, and continuing public mistrust of the nuclear industry despite the passage of two and a half decades since the Chernobyl accident. Frank von Hippel is the editor and lead author of the report, which includes contributions by Matthew Bunn, Anatoli Diakov, Tadahiro Katsuta, Charles McCombie, M.V. Ramana, Ming Ding, Yu Suyuan, Tatsujiro Suzuki, and Susan Voss.

Argentina reactivates enrichment plant.
Argentina has formally reactivated its gaseous diffusion uranium enrichment plant at Pilcaniyeu over two decades after production there halted. The plant is expected to become operational in September 2011. Plans to recommission the Pilcanyeu plant, which operated from 1983 to 1989, were announced in 2006 and form part of Argentina's ambition to build a self-sufficient nuclear fuel cycle. Work has been underway to refurbish and upgrade the plant, which uses gaseous diffusion, using Argentina's own technology. The first stage of the refurbishment has involved the construction of an advanced prototype of 20 diffusers, and the plant is expected to be able to produce its first enriched uranium for nuclear fuel use by September 2011 according to the CNEA. President Fernandez said that in reactivating the plant, Argentina was recovering lost time. She described uranium enrichment as "a right that we should never have resigned." The project was "a source of great pride" for the country, she said. The original Pilcaniyeu plant had a modest enrichment capacity of 20,000 SWU per year, although plans call for the upgraded plant ultimately to reach a capacity of some 3 million SWU.

INES 20 years old.
Jointly developed by the IAEA and the Nuclear Energy Agency (of the OECD) in 1990, in the aftermath of the Chernobyl accident, the International Nuclear and radiological Event Scale (INES) helps nuclear and radiation safety authorities and the nuclear industry worldwide to rate nuclear and radiological events and to communicate their safety significance to the general public, the media and the technical community. INES was initially used to classify events at nuclear power plants only, but since 2008, INES has been extended to any event associated with the transport, storage and use of radioactive material and radiation sources, from those occurring at nuclear facilities to those associated with industrial use. INES has mainly become a crucial nuclear communications tool. Over the years, national nuclear safety authorities have made growing use of INES, while the public and the media have become "more familiar with the scale and its significance". According to the OECD Nuclear Energy Agency "this is where the true success of INES stands, having helped to foster transparency and to provide a better understanding of nuclear-related events and activities".

International Uranium Film Festival 2011 in Brazil.
For the first time in history Brazilians will be able to see international independent Nuclear-Energy and Uranium-Documentaries in cinema. The film and video festival Uranio em Movi(e)mento - 1st International Uranium Film Festival 2011 will help to bring the Uranium- and Nuclear question into the national and international public. The deadline  for entries is January 20, 2011. The Uranium Film Festival wants to inform especially the Brazilian and Latin American societies and stimulate the production of independent documentaries and movies about the whole nuclear fuel cycle, about the dangers of radioactivity and especially about the environmental and health risks of uranium exploration, mining and processing. The Uranium Film Festival will be held from May 21 to 28, 2011 in the city of Rio de Janeiro and from June 2 to 9 in the city of Sao Paulo.

Until today most of the documentaries about uranium and the nuclear risks are mainly in English, German or French - but not in Portuguese. So the second advantage of our Uranium Film Festival is to subtitle the films to create the so called Yellow Archives. Yellow is the color of Uranium and for that a symbol for the whole nuclear industry.

The Yellow Archives will be the first-ever film library in Brazil and Latin America dedicated to films about the whole nuclear fuel chain organized by the Uranio em Movi(e)mento Festival. Believing that awareness is the first step in making positive changes to better our environment, the Yellow Archives hopes to increase public awareness especially in Brazil and in other Portuguese speaking countries like Portugal or Angola and Mozambique. The DVDs will be used for non-profit, educational and research purposes. Especially schools, universities, environmental groups and other grass root movements will have access to the Yellow Archives.

India: antinuclear activists arrested.
On October 6, eleven activists of "Paramanu Bidyut Birodhi Prachar Andolan" (Campaign against Nuclear Power) were forcefully seized by the local police while distributing leaflets opposing the proposed Haripur nuclear power plant, in the vicinity of Saha Institute of Nuclear Physics in Kolkata, where Dr. Srikumar Banerjee, the Atomic Energy Commission Chairman, had arrived to preach the merits of setting up of a 'nuclear park' at Haripur. The handful of activists present had not even entered the institute campus and were distributing leaflets on the road outside. First one activist was forced into a police jeep and hauled away to the local police station. The rest were pushed away from the immediate vicinity of the Saha Institute. But when the activists continued distributing their leaflets, a police van was brought in, the police suddenly pounced, herded the activists into a police-van and taken to the local station. The activists were held for over 6 hours in the name of interrogation. However, no actual interrogation was conducted. For the real reason for detention, which the officers divulged off-the-record, was to keep the activists away from the site (where the vast benefits of nuclearisation was being preached). That, in their minds, was the ideal way of handling critics and criticism.

Vermont Yankee tritium leaks into aquifer.
The leaking radioactive tritium from Vermont Yankee has now leaked into the aquifer that drinking water is pulled from in and around the town of Vernon, Vermont. Entergy Louisiana, the corporate owners of Vermont Yankee, could do more to contain the contamination but are refusing. The Vermont Department of Health and the Agency of Natural Resources are doing nothing to require Entergy to increase the cleanup effort. More is needed to pressure the state agencies into action. When the Oyster Creek Nuclear Reactor in New Jersey contaminated the ground water with radioactive tritium the NJ Department of Environmental Protection took enforcement action. When the Braidwood Station Nuclear reactor in Illinois contaminated the ground water and then the drinking water aquifer of the local community the Illinois EPA took enforcement action. Entergy Vermont Yankee, likely leaked radioactive materials into our state's ground water for two or three years and now it is clear that at least some of that contamination has also gotten into the local drinking water aquifer. Continued pumping, at deeper depths, should be able to keep hundreds of thousands if not millions of gallons of contaminated water from migrating further into the aquifer and yet there has been no talk from your agencies about requiring even this simple step.  Instead Entergy Vermont Yankee is planning on ending all of their pumping in December. Ultimately, the contaminated soil needs to be removed and that can't happen until the plant is retired and cleaned up.

Vermont Yankee is scheduled to close in March of 2012. It is one of the oldest reactors in the country but its owners, Entergy Corporation, want to run it for 20 years past its expiration date. Poor management and old age have lead to a string of accidents and safety concerns.
Entergy has refused to add money to the reactor's clean-up fund, potentially leaving Vermonters with most of a $1 billion dollar clean-up bill in addition to the nuclear waste that is being stored on the banks of the Connecticut River.
On February 23, 2010, and by a margin of 26 to 4 the Senate voted to retire the Vermont Yankee nuclear plant as scheduled. This historic vote marks the first time a state legislature has been able to deny a nuclear plant a 20-year life extension. In March, fifteen towns voted on town meeting to close Vermont Yankee as scheduled. That combined with the 36 towns that voted in 2009, a total of 51 towns, have spoken -- they want Vermont Yankee to close as scheduled.

The public sentiment expressed by the town meeting votes this year and last show overwhelming opposition to continued operation of Vermont Yankee after 2012 and very strong support for requiring Entergy to fully fund the cleanup and for safe, clean and renewable sources of electricity.

The resolution calls for the plant's closure in 2012 and for Entergy-- the owner of Vermont Yankee-- pay for the full cost of decommissioning the plant. A vast majority of Vermonters know Entergy cannot be trusted.

U.S.A.: Hanford cleanup; new deadlines.
Washington state and federal officials have agreed on a new schedule for the cleanup of the Hanford nuclear reservation. The good news is that the federal government could no longer ignore cleanup deadlines with impunity. The bad news is that the agreement would push the deadlines forward by more than two decades. Under the new cleanup schedule, 53 millions gallons of radioactive waste stored in 177 underground tanks near the Columbia River would not have to be emptied until 2052. That's a 24-year delay from the existing timetable. (see more on the Hanford tanks, Nuclear Monitor 696, October 23, 2009). Thirty-five of those tanks are double-walled and considered 'reliably safe'.  All of the 142 single-walled tanks would have to be emptied by 2047 under this new schedule. And the tanks of most concern — the 67 single-walled tanks known to be leaking — would be emptied by 2014. It's estimated that more than 1 million gallons (1 US gallon is 3.787 liter) of radioactive waste already have leaked. Some of that waste has made it into the groundwater and is slowly moving toward the nearby Columbia River.

The state has long sought to make Hanford cleanup deadlines enforceable in court. Until now, the federal government has steadfastly refused to do so and now the government finally agreed to the court-enforceable deadlines. This accountability has become critical. Without it, there can be little confidence that the government would adhere to any cleanup schedule. The federal government has failed to meet numerous deadlines established in the 1989 Tri-Party Agreement signed by the Energy Department, the Environmental Protection Agency and the state of Washington. It's not as though the state has refused to be flexible. Washington has agreed to more than 400 changes in the Tri-Party Agreement. Yet as recently as last year, the government missed 23 project deadlines.

South Africa: six reactors up and running in 2023.
On October 7, The department of Energy of South Africa published an ambitious plan to reduce SA reliance on coal by almost half by 2030 and to more than double the use of nuclear energy The proposals, which are part of the department's draft integrated electricity resource plan (IRP), show the government's preferred energy mix for the next 20 years. They provide prospective investors with an indication of the shape of South African future energy industry. The integrated resource plan is a 20-year electricity capacity plan that gives an outcome of projected future electricity demand, how the demand would be met and at what cost.

In the draft IRP, the department is proposing that coal contribute 48% to the energy mix by 2030, followed by renewable energy (16%), nuclear (14%), peaking open cycle gas turbine (9%), peaking pump storage (6%), mid-merit gas (5%) and baseload import hydro (2%).  Coal currently accounts for over 90% of electricity generation. Eskom's two nuclear reactors at the Koeberg power station supply 1800MW or 6% of SA's electricity needs. The renewable energy industry is yet to take off in SA. The draft plan envisages average gross domestic growth of 4,6% on over the next 20 years, which would require 52 248 MW of new power generation capacity to be brought on line. The government plans to build six new nuclear power stations which are expected to be up and running by 2023. Only  a few months ago, the government stopped the PBMR-nuclear project after it poured billions in it over the last decades.

CEZ delays Temelin reactors.
CEZ AS, the Czech Republic's largest power producer, will delay the construction of two  additional reactors at its Temelin nuclear power plant, Hospodarske Noviny reports, citing Industry and Trade Minister Martin Kocourek. The construction could be delayed by as much as several years, the newspaper said,citing an unidentified person from the company. The main reason is uncertain demand for electricity after 2020, according to the report. CEZ selected Westinghouse Electric Co., Areva SA and a Russian-Czech consortium led by ZAO Atomstroyexport as the three bidders for the contract.

This is good news for the whole CEE region. Until recently, CEZ has been agresivelly pushing construction of 5 new reactors in the region (2 in Czech Republic, 1 in Slovakia,  other 2 to be determined). But now the plans are put to ice, citing less demand and lower  prices on electricity markets, as well as less optimistic rating outlook of the utility. But there are more interesting details in original Hospodarske Noviny article: Quoting for example an internal CEZ document: "The expansion plans were based on increasing of our [CEZ] debt. But we are not anymore sweetheart of the markets, we are not considered as a stable and growing corporation, we are getting first signals from rating agencies..."

Similarly to EdF, CEZ already had to reduce its investment program by 2015 from 425 to 333 billion CZK [ca 13 billion EUR], and this is not enough - it admits the cuts will have to be deeper.

New press for reactor pressure vessels.
A major new facility has been commissioned in Germany for the production of large reactor components. The 12,000 ton press installed at Völklingen by Saarschmiede GmbH Freiformschmiede can handle ingots of up to 370 tons - enough to make all but the largest reactor pressure vessels. The time for construction was only two years. Due to its geometrical dimensions," the company said, the press is "able to deal with all parts of the AP1000." It estimated that some four to six sets of heavy forgings for AP1000s could be made annually at the facility, given certain other expansions. Vermont Senate shocks industry with 26-4 vote to close Vermont Yankee

In a move that sent shock waves through the nuclear power industry, the Vermont State Senate voted overwhelmingly February 24 to close the Vermont Yankee reactor when its current operating license expires in 2012. Coming just a week after President Obama’s announcement of an US$8.3 billion loan for construction of two new reactors in Georgia, the 26-4 vote carried a message -bolstered later by two new public opinion polls- that the public is not sold on the notion that nuclear power is either safe or clean.

The Vermont Senate vote followed weeks of revelations about growing radioactive tritium leaks at the site -culminating in a February 6 measurement of 2.45 million picocuries per liter of water, nearly the amount found in reactor process water. Federal limits of tritium concentrations in drinking water -often criticized as far too lax- are 20,000 picocuries per liter. At this point, Vermont Yankee’s owner, Entergy Corp., says that the tritium contamination has not migrated offsite.

 

But Entergy’s claims are taken with a grain of salt, since another major factor in Vermont’s disillusionment with Vermont Yankee was the fact that Entergy officials had told the legislature last summer that there were no buried pipes at all on the site. In fact, it was exactly such a buried pipe found to be leaking the tritium.

And Entergy, which is in the process of attempting to put all of its nuclear reactors into a new limited liability holding company called Enexus, also lost points with Vermont lawmakers because the reactor’s decommissioning fund is far short of what is needed, and Entergy’s plans to add to the fund rely solely on running the reactor as long and hard as it can. But lawmakers pointed out that Enexus would be undercapitalized, would more likely take money out of the decommissioning fund than put it in, and that it appeared the entire corporate structure of Enexus is to keep Entergy from being liable for future decommissioning obligations.

Already, Vermont’s action has caused New York State regulators, where Entergy owns the Indian Point reactors, to consider placing new restrictions on Enexus, perhaps forcing Enexus to drop Vermont Yankee from its holdings and possibly even scuttling the deal entirely. The State is currently involved in litigation before the Nuclear Regulatory Commission and asking for a denial of Indian Point’s request for a license extension.

Still, nuclear power issues drag on and on, and Vermont Yankee is no exception, despite the surprising margin of the Senate vote. The reactor is licensed until 2012, and Entergy says it plans to continue operating it until then. State legislative elections will be held this November, and Entergy is clearly hoping that if it can clean up its act a little -and it has fired or reassigned several top Vermont Yankee officials- it can reverse the vote in a new legislature next year.

Even if that doesn’t work, Entergy may try to challenge the vote on pre-emption grounds. In the U.S., the federal government has sole authority over all safety and radiation issues -the states cannot close, or prevent construction of- a reactor for those reasons. But it also clear that the states do have the power to regulate on economic grounds, as well as lack of access to a radioactive waste site, which is the basis for several state laws prohibiting new reactor construction. And indeed, while the radioactive tritium releases sparked growing public opposition to the reactor (which in Vermont is overwhelmingly in favor of shutdown), the vote was based on reliability and economic issues, especially related to the decommissioning shortfall.

Vermont was already in a unique situation, in that the state had negotiated a deal with Entergy some years back that it would have the power to approve or deny a license renewal for the reactor. Although that deal was in contract form, rather than legislative, it appears likely that deal will hold up in court if necessary.

At this point, Entergy is still seeking a 20-year license extension from the NRC, and the agency seems likely to grant it despite the tritium leaks and other problems with the reactor (in 2007, for example, a cooling tower simply collapsed due to inadequate maintenance). But the state still could find itself defending its position in court if Entergy chooses to do so, and could be in the awkward position of seeking to close a reactor that the NRC has agreed to relicense.

Grassroots groups are well aware of the potential pitfalls ahead, and are continuing their efforts to assure this victory is not overturned. Two groups, the Conservation Law Foundation and New England Coalition, already have petitioned to close the reactor now and not wait until 2012.

Meanwhile, two new public opinion polls released in March indicate that a nuclear revival is not as popular as some politicians seem to believe. A UPI poll found that new reactor construction is supported by less than a majority (48%) of the public, although only 31% were listed as opposed -the rest didn’t know. But that same poll found that more than 70% of the public is concerned about nuclear accidents and routine radiation releases from reactors, and nearly 80% is concerned about radioactive waste. A Pew poll found 52% support new reactors with 41% opposed, but that was still the least popular choice for new energy development -behind even offshore oil drilling. The vast majority -by a 78-17% margin- support renewable energy and energy efficiency development, just as the public has for the past two decades. While nuclear power remains controversial and highly divisive, genuinely safe, clean, sustainable energy has retains vast support. Are you listening, Mr. President?

Legislatures in West Virginia and Arizona defeat pro-nuclear measures. West Virginia’s official ban on the construction of nuclear power plants is staying put. A bill to repeal that state's ban on new nuclear construction was defeated in the state legislature on February 25. Although the bill had already passed the Senate's Energy and Mining Committee, it received only one vote in the Senate Judiciary Committee and is now dead for the year.
On the same day in Arizona, a bill to classify nuclear power as renewable energy was withdrawn following heavy lobbying from the solar power industry and environmental community.
