Czech Republic – Dukovany and Temelín

German environmentalists have started a petition to demand their government to take action on faulty welding work in the first reactor of the Temelín nuclear power station in the south of the Czech Republic. Over 75,000 signatures will be handed over before summer to environment minister Hendricks. More information is posted at www.change.org/p/stop-temelin-investigate-dangerous-welding-seams

During the European Nuclear Energy Forum (ENEF) in Prague on 23 May, Czech Prime Minister Bohuslav Sobotka declared that he saw no other way for the country's energy mix other than nuclear power. He criticised attempts to diminish its role, hinting at criticism from neighbouring Austria and Germany about Czech plans to expand its nuclear fleet with new reactors in Dukovany and Temelín. He expected the environmental impact assessment for new capacity in Dukovany to be finalised in 2018.

Slovakia – Mochovce 3,4 and New Bohunice

The Slovak Prime Minister Robert Fico announced during the same ENEF meeting that Slovakia will finalise the Mochovce 3,4 project no matter what. According to Euractiv on 26 May, he said that Slovakia will always strive for the further development of nuclear energy: "Our government will never abandon this policy and will always fight for the right to choose the way for the production of energy in the future." The Slovak Industry Minister Peter Žiga said at the same event that although the plan for new reactors at the Jaslovské Bohunice site is technically prepared, current economic conditions are not favourable: "We are waiting for better times, when the prices of electricity at the wholesale market will be a bit higher."

In the run-up to this year's Chernobyl anniversary, Global2000, the Austrian member of Friends of the Earth, found elevated tritium levels near the Mochovce nuclear power station in Slovakia. In the Malé Kozmálovce reservoir they found 1347 Bq/l, around 13 times higher than the drinking water limit.

Hungary – Paks II

According to sources, the Convention on Nuclear Safety (CNS) 7th Review Conference discussed the recent law changes in Hungary that could infringe on the independence of the nuclear regulator HAEA. Also the European Commission continued communication with Hungary on the issue. A final result of its inquiry is expected in the coming months.

The Hungarian government appointed former Paks director and mayor of the city of Paks János Süli as a special minister without portfolio for the Paks II project. Rosatom opened a tender procedure for the turbine building and related accessories.

EnergiaKlub and Greenpeace filed a court appeal on 24 May against the approval of the environmental license for Paks II.

Finland – Olkiluoto 3, Hanhikivi

The owner of the Olkiluoto 3 project, TVO, announced it will drop its compensation claims in the international arbitration court against Areva. This in an attempt to ensure that the Olkiluoto 3 reactor will go into a test phase in the coming year.

The town of Helsinki decided to try to get out of Fennovoima, the company behind the Hanhikivi project. This will not be easy, though, because it is only is a minority shareholder in Vantaan Energia, the company over which it owns shares in Fennovoima.

Nuclear regulator STUK announced recently that it will not be able to process the Fennovoima documentation before the end of 2018. Finland is facing parliamentary elections in April 2018.

Russia – the floating reactors of the "Akademik Lomonosov"

Greenpeace Russia made an assessment of the nuclear regulatory oversight over the construction of a floating nuclear power station in the centre of St. Petersburg, 3.5 km from the Hermitage. It came to the conclusion that there is only one annual pre-announced inspection visit by the Russian nuclear regulator Rostechnadzor. It calls for the same regulatory oversight of the entire project, including construction and transport, as other Russian nuclear power stations. A proposal along those lines from the Yablokov fraction in the town's parliament environmental committee was approved on 1 June and has to be confirmed later this month in a plenary session.

Spain – Santa Maria de Garoña, Almarez

During a seminar in the European Parliament, Spanish and Portuguese Parliament members asked that attention be given to the upcoming life-time extension of the Almarez nuclear power plant in Spain, as well as for the plans to restart Santa Maria de Garoña. They demanded public participation before the final decisions for these life-time extensions.

The restart of Santa Maria de Garoña by regulator CNS been conditional on upgrade investments. While 50% owner Iberdrola already said it wanted to refrain from re-opening the reactor, Endesa, the owner of the other 50%, prefers to wait for the decision of the Ministry of Energy.

Initially, the submission period for a request for life-time extension of the Almarez nuclear reactor would run out on 7 June. However, the Ministry of Energy with the support of CNS changed the procedure so that it now still has two years to do so.

Belgium – Tihange and Doel

Preparations for a human chain from Tihange (Belgium), over Maastricht (Netherlands) to Aachen (Germany) on 25 June over 90 km are in full swing. The event is receiving support from German and Dutch municipalities most affected by the power station, as well as from a broad range of people from culture and media, including the annual Dutch PinkPop rock festival. Belarus – Astravets

During the European Nuclear Energy Forum, 22 May in Prague, Lithuanian vice-minister for the environment Martynas Norbutas heavily criticised the Astravets project, 20 km from the border with Lithuania. He explained among others that the site choice happened without being informed by an environmental impact assessment, and based on population densities in Belarus but excluding Lithuania.

The Lithuanian – Belarussian tensions are expected to influence the Meeting of Parties of the Espoo Convention that takes place June 13‒16 in the Belarussian capital Minsk.

Hungary – Paks II

The Hungarian nuclear regulator issued the site approval for the Paks II nuclear power plant. The preliminary approval of the environmental permit has been sent to some foreign participants in the EIA procedure (e.g. the organisation Calla in the Czech Republic and Terra Mileniul III in Romania) but only in Hungarian. The responsible authority claims no translation is required under Hungarian law. A court case from Hungarian NGOs, among others Energia Klub and Greenpeace Hungary, against the approval of the environmental permit is pending.

The Hungarian government passed law changes in December 2016, including the possibility for the government, the de facto operator of the Paks II project, which is run from the Prime Minister's office, to divert per decree from licensing conditions for the construction of new nuclear capacity and nuclear waste management. The European Commission is currently investigating this under the allegation of breach of the independence of the nuclear regulator as defined under the Euratom Nuclear Safety Directive. Also, the 7th Review Conference of the Convention on Nuclear Safety at the IAEA in Vienna is discussing the matter.

Finland – Hanhikivi

The Finnish nuclear regulator STUK is currently scrutinising the construction documentation for the Hanhikivi nuclear project of the Finnish-Russian conglomerate Fennovoima. STUK criticised Fennovoima, constructor Rosatom and sub-contractors for having too little capacity to deliver the necessary documentation.

Russia – the floating reactors of the "Akademik Lomonosov"

Rosatom is preparing to load two 35 MW power reactors on board the non-propelled barge "Akademik Lomonosov", which is moored at the Baltic Shipyard in the centre of St. Petersburg, 3.5 km from the Hermitage and 2.5 km from the St. Isaac Cathedral.

Greenpeace Russia, the Yablokov Party and Greenpeace Nordic are urging for a transboundary environmental impact assessment to be made before loading, testing and transport of the barge to its final destination in Chukotka. The transport will lead the barge through the exclusive economic zones and/or territorial waters of most countries around the Baltic Sea.

Slovakia – Mochovce 3,4

The shareholders of Slovenské elektrarne ‒ the Slovak state, Italian utility ENEL and the Czech energy holding EPH ‒ have officially increased the budget for the construction of Mochovce 3,4 with €800 million during their Annual General Meeting in late March 2017. Mochovce 3,4 consists of two Rosatom designed VVER440/213 reactors of the second generation that are not equipped with a secondary containment. The total budget is now €5.4 billion or €5620/kWe capacity, which is comparable to the construction costs of the French designed EPR reactors in Olkiluoto, Finland and Flamanville, France. It is unclear who has to finance these extra costs.

Spain – Santa Maria de Garoña

The Spanish government would like to have the EU's oldest nuclear reactor, the Fukushima type GE Mark 1 reactor at Santa Maria de Garoña, restarted. The reactor was shut down in 2015, when its operator Nuclenor (Endesa / ENEL and Iberdrola) did not see an economic future any longer after necessary upgrades. Political pressure on Nuclenor from the side of the Spanish conservative government has been mounting, however.

On the other side, resistance against a restart in the neighbouring Basque Country is growing. During a session of the Basque Parliament on 5 April 2017, legal steps, among others against the lack of public participation, environmental considerations and comparison with viable alternatives, were prepared with parliament-wide support.

Iberdrola has already made clear that it would rather not restart the aging reactor. Endesa and its owner ENEL have yet to react.

Belgium – Tihange and Doel

On 11 March, around 1,000 people demonstrated in Antwerp against the life-time extension of the Doel 1 and 2 and Tihange 1 reactors, for closure of the crack-ridden Doel 3 and Tihange 2 reactors, and phase-out of the remaining two reactors Doel 4 and Tihange 3 in 2025.

The lack of public participation and environmental impact assessment for the life-time extension of Doel 1,2 and Tihange 1 is currently pending before the Council of State as well as civil court on complaints from Greenpeace. The city of Aachen (Germany) and the State of North Rhine – Westphalia (Germany) have started legal proceedings in Belgium against the operation of Doel 3 and Tihange 2.

On 25 June, a human chain from Tihange to Aachen is to follow the protests from March 11.

Belarus – Astravetz

The government of Lithuania has stepped up its attempts to prevent the construction of the Belarussian-Russian Astravetz nuclear power station just 40 km from the Lithuanian capital Vilnius. Belarus has promised to submit the Astravetz project to a nuclear stress test under supervision of the European Commission and the European Nuclear Safety Regulators Group (ENSREG), in the framework of the European post-Fukushima nuclear stress tests. The watchdog group Nuclear Transparency Watch has asked the European Commission to also facilitate input from civil society in that exercise, as happened during the European stress tests and similar stress tests with European support in Taiwan.

Netherlands – Borssele

The Aarhus Convention Compliance Committee is receiving answers on its last question regarding the lack of proper public participation concerning environmental issues in the decisions leading to the 20-year life-time extension of the Borssele nuclear reactor in 2013. The Committee is expected to finalise its findings in April and submit them to the Meeting of Parties of the Aarhus Convention in September.

In the meantime, the owner of Borssele, EPZ, has sold its grid distribution and water businesses for €900 million. It now has to decide whether this one-off income will be used to operate Borssele with a loss until possibly improved electricity prices might turn a profit in the early 2020s, or to use it to close down the aging reactor.

Decommissioning costs are budgeted at €500 million, but the decommissioning fund currently faces a shortage of over €200 million.

The largest two parties coming out of the Dutch parliamentarian elections in March 2017, VVD and PVV, want to continue operation of Borssele. Potential government candidates D66 and GroenLinks want it closed. The other negotiating party, the christian-democrat CDA, did not mention Borssele in its election programme, whereas another potential government coalition candidate, the Christian Union (CU), would like to see closure.

Czech Republic – Dukovany and Temelín

The Dukovany nuclear power station is gradually receiving permission for 20 years' life-time extension. Austrian NGOs including among others Global2000, ÖkoBüro Wien and the ÖkoInstitut in Vienna have started procedures under the Espoo and Aarhus Conventions against the lack of transboundary EIA with public participation.

A conference of anti-nuclear groups in Germany and the Czech Republic in Munich in March 2017 continued investigations into alleged problems during primary circuit welding work in the Temelín unit 1 in 1993. Greens Fichtelgebirge organiser Brigitte Artmann announced the next steps to allow access for German experts to vital documentation and stated: "As long as we are alive and this issue has not been resolved, it is not closed."

UK – Hinkley Point C, Wylfa and Moorside

The Espoo Convention Implementation Committee found the UK in non-compliance with the Espoo Convention for not notifying other countries of its intention to build the Hinkley Point C nuclear reactors. The UK reacted with a notification to all Espoo Convention parties, and currently, at least the Netherlands, Norway and Germany asked for a transboundary EIA.

The Netherlands and Austria also informed WISE they had been notified by the UK of the intention to build new nuclear capacity at Wylfa in Wales and are awaiting the start of a transboundary EIA procedure. With this, legal complaints from the Friends of the Irish Environment, An Taisce (the Irish Trust), the German member of the Bundestag Greens Sylvia Kötting-Uhl and German citizen Brigitte Artmann, have been successful. The Espoo Implementation Committee even went a step further by calling on the UK to halt construction work at Hinkley Point C until the transboundary EIA has been finalised. Construction work at Hinkley Point has, however, continued with the pouring of the first safety-relevant concrete.

Finland – Olkiluoto 1,2

The aging reactors 1 and 2 at Olkiluoto have received a life-time extension without public participation or an EIA during the decision-making procedures. NGOs are considering legal options.

Espoo Convention – Meeting of Parties

During the Espoo Convention Meeting of Parties 13‒16 May 2017 in Minsk, Belarus, nuclear issues will receive prominent attention. Lithuania and Belarus are involved in an ingrained battle over the quality of the Astravetz EIA (see above). The NGO CEE Bankwatch is organising a side-event to highlight the lack of environmental impact assessment before decisions on life-time extension of nuclear projects in Ukraine, Netherlands, Belgium, Spain, Czech Republic and elsewhere. A special commission is to come with best practices around nuclear decisions, though draft documents do not address life-time extensions.

Fennovoima: start of construction delayed

According to the Austrian website Solidbau ('industry and technology on construction') Fennovoima announced that 'nothing will happen' at the site of the proposed nuclear power plant at Pyhäjoki, northern Finland, before 2014. Fennovoima is owned by a large group of Finnish companies in need of their own electricity supply as well as German energy company E.ON.

Delaying E.ON/Fennovoima project to 2014 means a two year delay before any construction work has started. According to Fennovoima speaker Timo Kallio, this is not a delay but a refinement of the time schedule. However, Jehki Härkönen of Greenpeace, Helsinki, states that it is certainly a 'significant delay' and not 'refining the schedule' as the company needs to ap-ply for construction permission from the government before July 2015 or it will lose the political permission granted by parliament. 

The project's EIA (Environmental Impact Assessment) prepared in 2008 says construction is supposed to start in 2012 and the application for permission-in-principle which was prepared in 2009 specifies infrastructure work will start in Q3/2012 and construction of the nuclear power plant in Q4/2013 or Q1/2014. Now the infrastructure work is supposed to start in 2014 meaning the nuclear power plant construction could probably only start a year later. They also announced that the reactor provider won't be chosen during this year. The plant will be supplied by Areva (1700 MW EPR) or Toshiba (1600 MW ABWR), according to the company's website. The coastal municipality of Pyhäjoki is located in Northern Ostro-bothnia on the shore of the Baltic Sea.

The delay seems to suggest E.ON is quite uncertain of its plans. In March, German utilities RWE and E.ON decided not to continue with the development of new nuclear power plants in the UK through their Horizon Nuclear Power joint venture.

Waste repository 
But more problems ahead for Fennovoima: The Finnish government has given Posiva (jointly owned by Fortum and TVO, the two Finnish nuclear utilies) permission to expand its planned Onkalo repository, which would enable it to accommodate used fuel from the new Olkiluoto 4 reactor planned by TVO. TVO and Fortum maintain that it could not be extended any further for waste from the Pyhäjoki nuclear power plant, without compromising its longterm safety.

According to Fennovoima's Decision-in-Principle from the Finnish Government in 2010, Fennovoima must by 2016 present either an environmental impact assessment program for an own final disposal facility or present an agreement with Posiva and its owners. E.ON/Fennovoima is engaged in a dispute with the existing Finnish nuclear industry over getting access to their waste project. Currently it seems they are losing this dispute and would need to build one of their own but this is not yet clear. Fennovoima managed to obtain local support for its project by promising the waste would never be deposited in the grounds of the nuclear power plant and it also has no budget for building a repository of its own.

Nuclear activists jailed in Belarus for protesting deal with Russia.
One of the few remaining countries that claims the nuclear renaissance is real is Russia. The renaissance is not so real at home, where the number of planned nuclear power stations always looks impressive, but actual construction slows down. So, Russia looks to the outside world to push new reactors. On July 18 in the Belarusian capital, Minsk, the Russian and Belarusian officials signed a general contract on the joint project that envisions Russia’s Rosatom building a 2,400-MW nuclear power plant in the Belarusian town of Ostrovets in Grodno Region. The contract specified start of operation of Ostrovets unit 1 in November 2018 and unit 2 in  July 2020. A price tag of US$10 billion was put on the turnkey project to build the two NPP-2006 model VVER-1200 pressurized water reactors and all associated power plant  infrastructure.
Several journalists and environmentalists who are critical of the plan wanted to give him a petition. Even before they were on their way to the Russian Embassy in Minsk to deliver the petition, Russian nuclear physicist and journalist Andrey Ozharovsky and his Belarussian colleague and organizer of the petition Tatjana Novikova were arrested. Both were convicted that same day, Ozharovsky was given 10 days in jail and Novikova five days. They were accused of "hooliganism." The only witnesses called were the police people who arrested them. They said Ozharovsky and Novikova had screamed foul language that was audible further than 50 meters away. Well, "hooliganism" is the new magic word to persecute unwelcome political activism in current Belarus and Russia, just remember the members of punkgroup Pussy Riot who are facing a 7-year jail sentence for playing an anti-Putin song at the altar of one of Moscow's main cathedrals. Furthermore, new legislation in Russia oblige nongovernmental groups that receive funding from abroad to register as "foreign agents" or risk heavy fines and jail time.

Renewables to rescue Areva?
Areva's renewable energy division contributed positive operating cash flow for the first time in the first half of this year, highlighting the emerging importance of green energy to the French group as it looks to improve its cash position and pursue costcutting measures. Revenues from the Renewable Energies division hiked four-fold on the year to Eur253 million (US$308.7 million), on growth in offshore wind, solar and biomass sectors, helping drive up group revenues by 8.3% to Eur4.3 billion. "It's an encouraging sign because we know that renewable energy can contribute to the cash generation objective that we have in general for the group," Chief Financial Officer Pierre Aubouin said July 26 at the company's results presentation. The group has undergone a slim-lining program following costly delays for the construction of third-generation nuclear plants, while the Fukushima nuclear disaster has substantially dented the commercial prospects for nuclear reactor makers. "Ongoing efforts begun in late 2011 to reduce operating costs, with savings measures at the end of June 2012 implemented for nearly 20% of the objective set for the group through 2015, on an annual basis, another 45% of the objective being secured in addition," chief executive Luc Oursel said. The group, which also suffered from major write-downs on its uranium mining assets, still believes that nuclear is to remain a reliable source of energy on a long term, notably in Asia. 
Shares in Areva over the past 12 months have lost more than 55% of their value on the worries related to the impact of Fukushima on the group's outlook, as well as the massive write-down on the mining assets.

Lithuania: Referendum on new nuclear power plant.
On July 16, Lithuanian Parliament decided that there will be a referendum about Visaginas Nuclear  Power Plant project. Text of the referendum will be: "I approve construction of the new nuclear power plant in Lithuania" Yes/No. Sixty-two lawmakers voted in favour of the opposition proposal to hold the referendum, which will not be binding, in tandem with the Baltic state's general election on October 14, while 39 were against and 18 abstained. "Visaginas nuclear power plant will be built on Lithuanian land, with increased danger, therefore we must ask the opinion of the Lithuanian people," said opposition Social Democrat Birute Vesaite. Lithuania's governing Conservatives opposed the referendum plan, accusing the opposition of simply seeking pre-election political gains. The government will not be bound by the results of the referendum, but the vote may add uncertainty to the already-sluggish nuclear project, which lacks strong support from opposition parties that lead the election polls.
At the end of 2009, Lithuania closed its only nuclear power plant, located near Visaginas in the northeast. The shutdown was one of the terms of Lithuania's 2004 admission to the European Union. A referendum on extending the old plant until a new one was ready was held alongside the last general election in 2008, but while 89 percent voted in favour, turnout was only 48 percent, rendering it invalid. 
Now a new wave of propaganda and information about nuclear power is expected. But it is impossible to speak of a level playing field for pro and anti-nuclear organizations, considering the differences in financial means.

Olkiluoto-3 delayed indefinitely.
Finnish electricity company TVO says the Olkiluoto 3 EPR nuclear reactor will not be ready by the latest deadline of 2014 and a new timetable has not yet been set. Olkiluoto 3, originally due to be ready by 2009, is being built by French nuclear company Areva and German  engineering giant Siemens. In a statement, TVO said it was "not pleased with the situation" although solutions to various problems were being found one by one and work was "progressing". It said it was waiting for a new launch date from Areva and Siemens. Work on the site in south-west Finland began in 2005 but has been hit by repeated delays and has run way over budget. TVO has disagreed with the Areva/Siemens consortium over who is responsible for the delays. On July 16, it cited delays in automation system engineering and installation works.
The International Chamber of Commerce's arbitration court is processing the dispute on cost overruns between the consortium and TVO.
A similar project in Flamanville in northern France is itself running four years behind schedule.
China looks set to be the first country to operate an EPR reactor with one due to enter service in 2013. China is building two such reactors at Taishan in the south-east of the country with the first due to enter service at the end of next year and the second a year later.
On August 11, people are going to block the roads to Olkiluoto nuclear power plant in Eurajoki. Previous years have seen people blocking the roads using banners, drumming, performances and peaceful civil disobedience.

Japan: founding Green Party shows strong anti-nuclear feeling.
While a second reactor (Ohi-4) was restarted and resumed supplying to the grid on July 20, anti- nuclear sentiment is still growing. Anti-nuclear campaigners in Japan have launched the country's first green party. Greens Japan, created by local politicians and activists, hopes to satisfy the legal requirements to become an officially recognised political party in time for the general election, which must be held by next summer but could come much earlier. The party said it would offer voters a viable alternative to the two main parties, the ruling Democratic party of Japan and the minority opposition Liberal democratic party [LDP] both supported the nuclear restart. Akira Miyabe, Greens Japan's deputy leader, said voters had been deprived of the chance to support a party that puts nuclear abolition and other green policies at the top of its agenda. "We need a party that puts the environment first," he said at a launch event in Tokyo. Meanwhile, anti-nuclear protest is continuing. The Friday evening demonstration in Tokyo usually attracts over 100.000 people and a human chain against the Diet building on Sunday July 29 again brought ten of thousands to the streets. In a rare move by a former Japanese prime minister, Yukio Hatoyama joined a anti-nuclear demonstration outside his old office on July 19, another sign that the ruling party he once led is fracturing over energy and other policies. Also in other Japanese cities regularly demonstration take place.

Nuclear power? No way!
Olkiluoto Blockade Camp 6th - 13th August 2012

Olkiluoto Blockade Camp in Eurajoki, western Finland, will bring together people from the anti-nuclear movements in Finland and internationally. The camp will be an opportunity to discuss nuclear power projects, including uranium mining, and to share experiences, skills and tools for struggles against the nuclear energy industry and for encouraging truly sustainable, decentralized forms of energy.     

On August 11, Olkiluoto Blockade action day, people are invited to come and block the roads to the Olkiluoto nuclear power plant by civil disobedience. Year 2012 will mark the third annual blockade. Previous years have seen people blocking the roads using banners, drumming, performances and peaceful civil disobedience. You can join the demonstration in any way you like, with no obligation to participate in civil disobedience.

The Olkiluoto power plant consists of two reactors owned by Teollisuuden Voima (TVO). Additionally, TVO and French Areva are currently building a third reactor, which will be the world's largest and first EPR reactor. Despite the countless problems with the EPR's construction so far, the Finnish parliament has granted the company a license to build a fourth reactor at the site. Another pioneer project in Olkiluoto is Onkalo ("the Cave"), the world's first permanent underground storage for highly radioactive waste.   

Nuclear power cannot solve the climate crises, but rather it feeds the economic system where short-term profit-making sacrifices common safety and environmental issues.

RWE abandoning nuclear power (well…, new construction). 
RWE AG, Germany's second-biggest utility, is abandoning plans to build new nuclear power plants outside its home market, where the government decided last year to phase out nuclear power. "We will not invest in new nuclear power plants," incoming Chief Executive Peter Terium said. Like E.ON and peer EnBW, RWE had to close nuclear power plants after Fukushima and by the German government's decision to phase out nuclear power generation, which, actually was a turn back to the year 2000 phase out schedule. "We can no longer afford the financial risks and the surrounding conditions for nuclear power plants." 
Meanwhile, RWE is one of the four German utilities that are going to the Federal Constitutional Court  (Bundesverfassungsgericht) in order to get a 15 billion euro 'compensation' for the nuclear phase out. Remember: the same four utilities agreed to this phase out plan on June 14, 2000. The Court will examine the compensation claims in the coming weeks. Its decision is not expected until late 2013, after Germany's next federal parliamentary election. It will first consult with both houses of the German parliament as well as 63 other organizations, including Greenpeace and the Federation of German Industry (BDI). The constitutional court must then decide whether Germany's exit from nuclear energy violated the constitution before civil courts can rule on possible damages.

Siemens can return to nuclear in 2012, EC rules. The European Commission has closed an antitrust investigation of the arrangement that prevents Siemens from selling nuclear products and services, following its withdrawal from the Areva NP business. The Commission has accepted an agreement between the two companies to allow Siemens to sell core products and services later this year. In 2001, Areva and Siemens created the joint venture Areva NP and agreed on a specific non-compete obligation. This obligation was meant to apply for up to 11 years beyond the duration of the joint venture itself. The joint venture came to an end following Siemens' exit in 2009, when Areva acquired sole control over Areva NP. In December 2011, the European Commission expressed concerns that the non-compete obligation and a confidentiality clause may infringe EU antitrust rules. In response to the Commission's concerns, Siemens and Areva offered commitments. They agreed to limit the duration of the clause to three years following Areva's acquisition of sole control over Areva NP in relation to the joint venture's core products and services. They also agreed to remove it completely for all other products and services. The same commitments apply to the confidentiality clause.
Now, the European Commission has made these commitments legally-binding after market-testing them, and has closed its investigation. However, Siemens' next move is unclear, as it publicly announced in 2011 that it had pulled out of the nuclear market altogether.

The checkered history of high-temperature gas-cooled reactors

Princeton University academic M.V. Ramana has written a useful summary of the troubled history of high-temperature gas-cooled reactors (HTGR) including the pebble-bed reactor sub-type. In the past, both Germany and the United States spent large amounts of money to design and construct HTGRs, four of which fed electricity into the grid. Other countries have also invested in HTGR technology. Ramana's analysis is of more than historical interest as several countries are either considering the construction of new HTGRs or pursuing research into the field.

Ramana writes:

"Proponents of HTGRs often claim that their designs have a long pedigree. ... But if one examines that very same experience more closely – looking in particular at the HTGRs that were constructed in Western Europe and the United States to feed power into the electric grid – then one comes to other conclusions. This history suggests that while HTGRs may look attractive on paper, their performance leaves much to be desired. The technology may be something that looks better on paper than in the real world ...

"Although Germany abandoned this technology, it did migrate to other countries, including China and South Africa. Of these, the latter case is instructive: South Africa pursued the construction of a pebble-bed reactor for a decade, and spent over a billion dollars, only to abandon it in 2009 because it just did not make sense economically. Although sold by its proponents as innovative and economically competitive until its cancellation, the South African pebble-bed reactor project is now being cited as a case study in failure. How good the Chinese experience with the HTGR will be remains to be seen. ...

"From these experiences in operating HTGRs, we can take away several lessons – the most important being that HTGRs are prone to a wide variety of small failures, including graphite dust accumulation, ingress of water or oil, and fuel failures. Some of these could be the trigger for larger failures or accidents, with more severe consequences. ... Other problems could make the consequences of a severe accident worse: For example, pebble compaction and breakage could lead to accelerated diffusion of fission products such as radioactive cesium and strontium outside the pebbles, and a potentially larger radioactive release in the event of a severe accident. ...

"Discussions of the commercial viability of HTGRs almost invariably focus on the expected higher capital costs per unit of generation capacity (dollars per kilowatts) in comparison with light water reactors, and potential ways for lowering those. In other words, the main challenge they foresee is that of building these reactors cheaply enough. But what they implicitly or explicitly assume is that HTGRs would operate as well as current light water reactors – which is simply not the case, if history is any guide. ...

"Although there has been much positive promotional hype associated with high-temperature reactors, the decades of experience that researchers have acquired in operating HTGRs has seldom been considered. Press releases from the many companies developing or selling HTGRs or project plans in countries seeking to purchase or construct HTGRs neither tell you that not a single HTGR-termed "commercial" has proven financially viable nor do they mention that all the HTGRs were shut down well before the operating periods envisioned for them. This is typical of the nuclear industry, which practices selective remembrance, choosing to forget or underplay earlier failures."

All Belgians likely to be issued with iodine tablets

The entire population of Belgium is likely to be issued with iodine tablets, which help reduce radiation build-up in the thyroid gland in the event of a nuclear accident or terrorist attack.

"Before, the iodine pills were only given to people living in a perimeter of 20 kms — now we are going to take measures for people within 100 kms," Health Minister Maggie De Block said on April 28. "We will provide iodine pills in the whole country."

All 11 million Belgians live within 100 km of a nuclear power plant when reactors in Belgium, France and the Netherlands are taken into account.

The announcement followed advice from Belgium's Superior Health Council. The Health Ministry said it would take the advice into account as it revises safety protocols to be finalized before the end of the year, but the Minister's statements indicate that a firm decision to accept the advice has already been taken.

"We are a very small and densely populated country surrounded by nuclear power plants both in our country and neighboring countries" and iodine pills are "cheap and efficient," said Nele Scheerlinck, a spokeswoman for the Federal Authority for Nuclear Control.

Belgium's nuclear industry has been subject to numerous security threats and scares as discussed in Nuclear Monitor #822. In addition, there are serious safety concerns including multiple cracks discovered in the Doel 3 and Tihange 2 pressure vessels and a controversial decision to allow the reactors to restart. German Environment Minister Barbara Hendricks said last month that Belgium should take offline Doel 3 and Tihange 2, which are close to the German border, because of safety concerns.

Protesters break into Finnish nuclear site, police attack

On Chernobyl Day, April 26, anti-nuclear protesters broke in to a Finnish construction site for a nuclear reactor to be supplied by Russia's Rosatom. Protesters said more than 100 people participated, while police estimated that close to 50 protesters gathered near the Fennovoima site and around 40 were detained. One group broke into the site while others lay down on the road leading to the site's entrance.

"We want to remind people that the Chernobyl plant was built by Rosatom's predecessor. I wouldn't do business with anyone with that kind of history," said Venla Simonen from the Stop Fennovoima protest group.

Site works have been ongoing for one year, and a protest camp has recently celebrated its first anniversary. The camp was able to stay inside the construction area over five months and was able to slow down construction works. During the summer of 2015, dozens of blockades took place. In September, after an eviction that lasted eight days, the camp moved outside the construction site to continue its activities with help from local supporters. Blockades and other activity against nuclear power did not stop at any point.

Protesters organized multiple actions in the week around Chernobyl Day. They blocked the road to the Fennovoima-Rosatom site on April 28 before the police attacked. Some people locked themselves together with pipelocks and some of the people locked on to heavy barrels. The activists had locked themselves to locks inside the barrels, and there were activists locked on to the barrel-activists, so they formed a human chain to block the traffic on the road.

It took almost three hours for the police to arrive at the blockade. But when they came there was a lot of them and they had riot equipment and police dogs. A helicopter circulated around the area. Police used rubber bullets and pepper spray and dismantled the blockade. Many protesters were taken to the custody. Police also attacked and destroyed two protest camp sites at the Fennovoima site.

Protesters said: "We don't accept giving in to repression and police violence, and the struggle against Fennovoima will continue. Now we'll need everyone to help build up the camp again, and to continue the fight and actions against Fennovoima. We invite comrades to this fight where ever you are – let's aim our actions towards the companies which are working with Fennovoima, the embassies of Finland, or the local police."

Ecological destruction in Finland

The Hanhikivi Cape in Finland is being ruined to make way for Fennovoima's nuclear power plant. In addition to damage that has already been done, Fennovoima has permits to cut down about 100 hectares of ecologically valuable area by the end of April, which is one-fifth of the whole Hanhikivi Cape.

The Finnish government's approval of the plant is conditional. There are many unresolved issues such as whether there will be enough Finnish or European stakeholders in the project, and nuclear waste management plans. If the nuclear plant is never built, the ecological destruction will be for nothing.

Local NGO Pro Hanhikivi has worked to protect the area and resist the nuclear project for eight years. Friends of the Earth Finland is organising a 'Better power!' camp to be held in June.

Finland: 15 shareholders withdraw from new reactor project

Fifteen shareholders − one-quarter of the total number − of the Finnish nuclear consortium Fennovoima announced on November 14 that they are withdrawing from the project to build a nuclear power plant in Pyhäjoki, western Finland. Taking into account earlier withdrawals, around half of all shareholders have withdrawn.[1]

About 45 companies remain as partners to the project, but their involvement is conditional as Fennovoima is still negotiating with Russia's Rosatom.[1]

Rosatom intends to take a 34% share in Fennovoima. (Last year, German utility E.ON sold its 34% stake in the consortium.[1]) Fennovoima is negotiating with Rosatom's export subsidiary Rusatom Overseas with a view to building one 1200 MWe AES-2006 VVER pressurised water reactor. Fennovoima says the companies are aiming to sign a plant supply contract by the end of this year.[2]

Six AES-2006 VVER reactors are under construction in Russia and units are also planned in Turkey and Belarus.[3]

In August, the Finnish Radiation and Nuclear Safety Authority (STUK) warned that Rosatom's AES-2006 reactor design would need upgrades to meet Finnish safety standards.[4]

One complication is that Fennovoima has nowhere to dispose of high-level nuclear waste. Posiva Oy, a joint venture between TVO and Fortum, plans a deep geological repository on Olkiluoto Island but those plans do not include accommodation for spent fuel from Fennovoima's new plant. Posiva, TVO and Fortum have repeatedly said they will not accept Fennovoima as a partner.[5]

Posiva President Reijo Sundell said last year: "We're not trying to be nasty. But the simple fact is that there is not enough room. We can't expand the site under the sea. We can't create another deeper level because then it might not withstand the pressure of an ice age. And we can't build a shallower level because the underground water there is saltier and therefore more corrosive."[6]

Making the Olkiluoto bedrock repository bigger to accommodate waste from Hanhikivi would cost about 200 million euros, whereas building a separate facility would cost far more.[5]

One of the remaining consortium members is mining company Talvivaara, which is heavily in debt.[7,8,9,10] In November 2012, a massive spill from Talvivaara's nickel and zinc mine polluted wide areas of wetlands with thousands of cubic meters of toxic and radioactive waste water.[11] The company has been planning to produce uranium from the Talvivaara mine in addition to nickel and zinc. However that plan may be jeopardised by the company's financial troubles as well as low uranium prices.

Finland currently has four operating nuclear reactors, including two Russian-designed VVER-440 reactors, and a 1600 MWe EPR is under construction on Olkiluoto Island.[3] The EPR is seven years behind schedule and the estimated cost has ballooned from three billion euros to eight billion. In late October, the Areva-Siemens consortium increased its claim against Finnish utility TVO to 2.6 billion euros (US$3.5 billion) in relation to the delay and cost overruns of the Olkiluoto EPR, up from the previous claim of 1.9 billion euros (US$2.6 billion). In 2008, TVO submitted a claim to Areva-Siemens for compensation for "losses and costs incurred due to the delay" in completing the project.[12]

Stop import of nuclear electricity from Russia

Russian and Norwegian environmental NGOs oppose increased electricity trade between Russia and western countries, as long as common environmental and safety standards are absent. They urge the Finnish government to stop future import of nuclear electricity from the new Leningrad Nuclear Power Plant-2 (LNPP-2) in Russia. This import will be facilitated by the new power cable between Sosnovy Bor (St. Petersburg region, Russia) and Vyborg (Russia).

The Russian company JSC Edinaya Energeticheskaya Sistema (Unified Energy System of Russia), in cooperation with the State Corporation on Nuclear Energy (Rosatom), is laying an underwater 1000 MW power cable from the  new Leningrad nuclear reactor -2 (LNPP-2, under construction) on the south shore of the Gulf of Finland, to a point south of the city of Vyborg on the north shore. A public hearing of the environmental impact assessment (EIA) of the cable project was held in Sosnovy Bor in December 2011.

The cable will have a capacity of 1000 MW, and is capable of transporting electricity directly from 1 out of 4 units of VVER-1200 nuclear reactors of the New Leningrad NPP-2. The cable will bypass the limitations in the transmission lines around St Petersburg, and allow a more direct access to the international electricity market via Finland.  In the last years Russian-Finnish transfer of electricity has been about 10-11 TWh/year. This is about the equivalent of the electricity production of the 2 oldest Chernobyl type reactors of Leningrad NPP. These reactors have received a license for the prolonged operation after reaching their 30 years design limit. This political decision was adopted without public participation and EIA.

The High Voltage Direct Current power link-project will decrease environmental safety in the Baltic part of Russia by promoting the prolongation of old and unsafe nuclear reactors and the accumulation of nuclear and radioactive waste on the coastline of our common Baltic Sea. It will lead to environmental dumping, due to lower safety and environmental standards in Russia.

The transport of nuclear electricity is not solely a bilateral decision between Russia and Finland. Also other Nordic and EU countries will be influenced, as electricity imported to Finland will reach the common Nordic and EU market.

1. The new cable leads to environmental dumping

- Electricity import from Russia represents the dumping of cheaper electricity produced with lower environmental and safety standards, on the Nordic market.
Northwest Russia has excess electric generating capacity because of prolonged operation of the first generation nuclear reactors. The reactors have not only passed their 30 year of designed lifetime, but they are also built with serious safety design deficits that make it impossible to meet European safety standards. For instance, EU told Lithuania to close down Ignalina nuclear power plant for safety reasons, although its reactors were newer and better than the two oldest reactors at Leningrad Nuclear Power Plant.  

- A common market should have common standards.
EU’s position in the energy dialogue with Russia has been that a common EU and Russia electricity market should have common environmental standards. Therefore EU has shown reluctance to import Russian electricity before environmental and safety conditions are improved. As members of EU, Finland should not act in a way that contradicts this position. 

- Environmental dumping is bad both for the environment and for competition.
The prolonged operation of Russia’s first generation nuclear power reactors will decrease the level of environmental safety in the whole Baltic Region populated by more than 90 million people. In addition to harming the environment by decreasing the level of environmental safety, different standards in the same market is unfair competition.

2. The new cable helps prolongation of old and unsafe nuclear reactors

- Electricity import provides money for the Russian nuclear industry.
Russia’s nuclear operator RosEnergoAtom is one of the companies that will receive increased income from the electricity export. Earning money from electricity export, the operator of the old reactors will be more likely to continue operation. Even though there is surplus capacity of electricity generation in North West Russia, old nuclear reactors that have reached the end of their planned lifetime have received permission for prolongation of operations. This is done without public debate or necessary environmental impact assessments (EIA).

- Electricity import from Russia results in prolongation of old reactors.
Thus the proposed cable will decrease the level of environmental safety in the whole Baltic Region populated by more than 90 million people.

- Electricity import makes the work for decommissioning even more difficult.
Environmental NGOs in Russia work for decommissioning of old reactors, but face a tough challenge in today’s Russia, where organisational freedom is limited. The court system is also not working in our favour. Electricity import from Russia will counteract their efforts.

- The Russian courts have denied the right of NGOs to stop unlawful lifetime extension
Russian NGOs have attempted to use the legal system to stop the unlawful lifetime extension of the old reactors at the Leningrad nuclear power plant, but the effort has not been successful. The courts have so far blocked any discussion of this problem with Russian NPP operators and regulators of nuclear safety.

- Setting conditions for electricity import is a way to help decommissioning.
The Nordic countries, EBRD (The European Bank of Reconstruction and Development) and others have given financial and technical support for safety measures at the old reactors, on the condition that they close at the end of their designed lifetime. Nevertheless, RosEnergoAtom has chosen to prolong their operation. By unconditionally buying the power from RosEnergoAtom, the Nordic countries undermine their own possibilities for actual influence on Russian authorities on this issue.

In China, there are two storage facilities for intermediate-level waste and a centralized facility for high-level waste. A geological disposal repository for high-level waste will start operation in 2050 at the earliest.

Reprocessing
When China started to develop nuclear power, a 'closed fuel cycle' strategy was formulated and declared at an International Atomic Energy Agency conference in 1987: at-reactor storage; away-from-reactor storage; and reprocessing. China National Nuclear Corporation (CNNC)  has drafted a state regulation on civil spent fuel treatment as the basis for a long-term government program. There is a levy of CNY 2.6 cents/kWh on used fuel, to pay for its management, reprocessing, and the eventual disposal of HLW.(*01)

China began construction of a multi-purpose reprocessing pilot plant at Lanzhou nuclear complex in July 1997. This project was approved in July 1986 and began receiving spent fuels from Daya Bay reactors in September 2004. The plant is fully operational.

Moreover, a commercial reprocessing plant (800 tHM/a) is planned to be in commission around 2020 at the Lanzhou Nuclear Complex, and site selection has already begun.(*02) However, as of December 2009, no final agreement had been reached between China and France on the transfer of the relevant technologies; the plant construction appears to remain on hold.(*03)

Interim storage and final disposal
In the 1980’s, radioactive waste disposal work was initiated in China. The former Ministry of Nuclear Industry (MNI) subsidiary Science and Technology Committee set up a panel of radioactive waste treatment and disposal. The siting of solid LILW disposal site began in the 1980’s and was implemented under the auspice of the former Ministry of Nuclear Industry. Industrial-scale disposal of low- and intermediate-level wastes is at two sites, near Yumen in northwest Gansu province, and at the Beilong repository in Guangdong province, near the Daya Bay nuclear plant. These are the first two of five planned regional low- and intermediate-level waste disposal facilities.(*04)

A centralized used fuel storage facility has been built at Lanzhou Nuclear Fuel Complex, 25 km northeast of Lanzhou in central Gansu province. The initial stage of that project has a storage capacity of 550 tons and could be doubled.(*05) However, most used fuel is stored at reactor sites. New Chinese plant designs include on-site spent fuel storage with a capacity of 20 years worth of spent fuel.(*06)

Although most of China’s nuclear power plants are located in the more populated eastern regions, storage facilities are located in the far west. This policy is likely aimed at avoiding local opposition to locating these facilities near populated areas, signaling at least a marginal impact that public opinion might have on Chinese policies.

However, as one Chinese nuclear expert observed, unlike democratic systems where public opinion holds significant sway, the decision of the Chinese government is really “the only decisive factor for spent fuel management in China.”(*07) Since 2003, the spent fuel from two nuclear power plants in the southeastern province of Guangdong has been shipped to the Gansu facility – a distance of about 4000 kilometers. This is consistent with CNNC policy to ship spent fuel by rail to centralized storage facilities for interim storage and reprocessing.(*08)

In 1985, CNNC worked out an R&D program for the deep geological disposal of high/level waste. The preliminary repository concept is a shaft-tunnel model, located in saturated zones in granite.(*09)

Site selection and evaluation has been under way since then and is focused on three candidate locations in the Beishan area of Gansu province and will be completed by 2020. All are in granite. An underground research laboratory will then be built 2015-20 and operate for 20 years. The third step is to construct the final repository from 2040 and to carry out demonstration disposal. Acceptance of high-level wastes into a national repository is anticipated from 2050.(*10)

The regulatory authorities of high-level radioactive waste disposal projects are Ministry of Environmental Protection (MEP) and the National Nuclear Safety Administration (NNSA). The China Atomic Energy Agency (CAEA) is in charge of the project control and financial management. CNNC deals with implementation, and four CNNC subsidiaries are key players: Beijing Research Institute of Uranium Geology (BRIUG) handles site investigation and evaluation, engineered barrier study and performance analyses, with the China Institute of Atomic Energy (CIAE) undertaking radionuclide migration studies. The China Institute for Radiation Protection (CIRP) is responsible for safety assessment, and the China Nuclear Power Engineering Company (CNPE) works on engineering design.(*11)

State-owned utility CEZ is fully responsible for storage and management of its spent fuel until it is handed over to the state organization SURAO (RAWRA in English: Radioactive Waste Repository Authority), founded on 1 June 1997.(*01) Eventual provision of a high-level waste repository is the responsibility of RAWRA. Most of low and intermediate level waste is stored on site or moved to the near-surface repository in operation at Dukovany.(*02)

Long-term interim storage
The concept preferred at the moment is the long-term interim storage of spent fuel in container interim storage facilities at the sites of the nuclear power plants at Temelin and Dukovany. Problem concerning this is that the spent fuel must be stored in an interim storage facility for a very long period of time, because the final disposal in a repository is only planned after 2065. The condition of the nuclear waste or the level of the hazard potential of the waste at that stage is unforeseeable.(*03)

In agreement with the Policy for radioactive waste and spent fuel management of 2002 the Czech Republic anticipates to develop a national deep geological repository in magmatic crystallytic rocks (granites or homogenous gneiss massifs) after 2050 and it should start operation in 2065.

The program of the repository development started back in 1992 (in the first year jointly with the Slovak Republic). Thirty potential locations were gradually identified, of which 12 potential locations were selected with varied geological conditions and diverse host rocks. The first geological survey was performed on six locations with granitic massifs in 2003 – 2005, without utilization of surface survey methods, and areas were selected for future prospecting stage of the geological survey. The works were suspended in 2005 due to public resistance.(*04) On 17 December 2009 “as a gesture of goodwill”, RAWRA announced that it will make it possible for communities to claim a financial compensation for geological research work of potentially CZK 100 million in total.(*05)

On November 25, 2010 a working group for dialogue was established to “strengthen the transparency of the process of selection a suitable site for a deep geological repository of spent nuclear fuel and high level waste, with respect to the public interests and to facilitate the active participation of the public and the communities in particular in the related decision-making process.”(*06)

Based on results of the completed stage of negotiations with the general public the Administration anticipates the start of surveying works start gradually after “negotiations with the general public are completed" and “only if the affected municipalities get involved on a voluntary basis in the selection process of the future deep geological repository location.”(*07) One possible site is at Skalka in southern Moravia. In the late 1990s, this site was considered for a centralized used fuel interim storage facility as an alternative to the Temelin storage facility and to the storage capacity expansion at Dukovany (beyond the 600 t facility).(*08)

In 1994, the Nuclear Energy Act came into force, according to which all nuclear waste must be treated, stored and disposed of in Finland. Before that some of the spent fuel was sent to Russia.(*01) Posiva Oy is responsible for the final disposal of spent nuclear fuel. It is established in 1995 by TVO and Fortum, two owners of nuclear power plants.(*02) Storage of spent fuel takes place on site until the final repository is finished. Finland hopes to begin with final disposal in granite around 2020-2025.

Onkalo
Preparations for the disposal of high level radioactive waste began in the late 1970s.(*03) In 1985, 102 potential sites were listed and in 1987 reduced to five for further research. This resulted in detailed site investigation at four sites from 1992 on, two of them at the Loviisa and Olkiluoto nuclear power plants. For all sites an environmental impact assessment was carried out and in May 1999, Posiva Oy proposed for a permit for the disposal at Olkiluoto in the municipality of Eurajoki. Local consent was highest in Olkiluoto and Loviisa, but at Olkiluoto a larger area was reserved for the repository and a larger part of the spent fuel was already stored there.

In January 2000 the town council of Eurajoki accepted the repository, followed by approval by the government and parliament in May 2001. In Finland the same disposal concept is applied as in Sweden.(*04) The construction application will be submitted in 2012, and operating license application in 2018. Posiva Oy expects that the first cannisters will go down in 2020 and final disposal will end in 2112. Around 2120, the repository is finally closed and sealed.(*05)

Construction of an underground rock characterization facility (called Onkalo) started in 2004. This will later become (part of) the final repository.(*06)

In May 2010 it was found that the time schedule might not be met. The Finnish TV showed that there is still much research to be done before the application for the permit (scheduled end of 2012) can take place. The Director of the Research Department of Posiva Oy, Juhani Vira, stated his willingness to request the permit at a later date.(*07)

However, in the planned facility will not have enough space for the spent fuel from the already approved nuclear reactor at Pyhäjoki. In October 2011, TVO and Fortum stated that the repository could not safely be expanded to accommodate used fuel from Fennovoima's planned plant.(*08) In March 2012, Despite pressure from the government to make a deal, Posiva Oy maintains that it could not be extended any further without compromising its long-term safety.(*09)

Because Finland has the same disposal concept as Sweden, there is the same criticism on the stability of the granite and on the use of copper. Dr. Johan Swahn, Director of the Swedish NGO office for nuclear waste review, wrote in December 2009: “There is no way that anyone can honestly claim that Posiva has a completed robust safety case. The Posiva safety case has not been developed independently, but relies entirely on the Swedish safety case work. The final test of the Swedish safety case will not be done until the Swedish Radiation Safety Authority gives an approval of the safety analysis…This will not be the case before 2013-2014.” “Already now there is concern from the authority about the barrier systems of copper and clay. It is not clear if all relevant copper corrosion processes are known and the risk for clay erosion is still not understood. So an approval is not at all certain. And nothing can today be claimed to be robust."(*10)

In 2010, the Swedish geologist Nils-Axel Mörner noted that there are many horizontal and vertical fractures around the planned repository. According to Mörner the safety is therefore not proven.(*11)

Geology Professor Matti Saarnisto, former Secretary-General of the Finnish Academy of Science and Letters, told in June 2010 Parliament that “an exaggeratedly positive image has been presented of the integrity of the structure of Olkiluoto’s bedrock”. He warns that a honeycomb of storage sites extending over an area of several square kilometres will weaken the bedrock, making it vulnerable to earthquakes, and that during an ice age permafrost could spread deep into the rock, potentially rupturing the canisters and releasing radioactivity into the groundwater.(*12)

The matter of fact is that to some extent all of the research institutes involved are suffering from a hostage syndrome. They see it as essential that spent fuel be disposed of at Olkiluoto, because it has been planned that way for decades. There is no scientific basis for it,” Saarnisto said in 2009.(*13)

France

As in almost all countries, in France, the storage of radioactive waste is controversial. Pressure groups believe the storage of high-level radioactive waste in clay, planned at Bure from 2025 at the earliest, is in violation of the legislation of the government, because there is only one underground laboratory and a 1991 law requires at least two. All spent fuel is reprocessed in La Hague. France dumped low- and intermediate level waste in sea twice, from 1967-1969.(*01)

LLW
Low-level radioactive waste was stored at the above-ground site CSM (Centre de Stockage de la Manche) from 1969 till 1994. In 1996, the government-appointed commission 'Turpin' concluded that the site also contains long-living and higher radioactive waste and that the inventory was not exactly known. The commission also found that radioactivity from the site is leaking into the environment. It however concluded that dismantling and reconditioning the waste would cost too much and might generate a significant risk to the workers involved.(*02)

ANDRA is currently operating two disposal facilities: one for short-lived low-level and intermediate-level waste (CSFMA) and the other for very-low-level waste (CSTFA), both situated in the Aube district.(*03)

The 2006 Planning Act calls for the commissioning by 2013 of a storage facility for low-level long-lived wastes. The opening of this new sub-surface (15 m to 100 m depth) facility has been seriously delayed, to at least 2019, by massive protests in the areas considered as possible sites. ANDRA launched a public call to 3,115 communities in 2008 for volunteers to host the facility. Forty-one applied for consideration and, in June 2009, the government selected two small villages both in the Aube department that already houses the two operating disposal facilities for short-lived wastes. But both communities withdrew “under the pressure of the opponents.”(*04) Currently, the project is suspended and ANDRA and the government are looking for a new approach. Pending the creation of a suitable disposal facility, existing LLW-LL waste is stored at the production sites or in facilities which have traditionally used radioactive applications.

ILW-LL and HLW
Pending the commissioning of a deep repository, intermediate-level, long-lived waste (ILW-LL) and high-level waste is stored at their production sites, mainly La Hague, Marcoule and Cadarache.

In 1979, the French National Radioactive Waste Management Agency ANDRA was established to manage and provide storage of nuclear waste. From 1987 to 1990 field study was conducted but protest against four test drilling forced the government to stop research and develop new policy.(*05) In 1991 parliament passed the Nuclear Waste Act, which regulated the new policy. The law is meant as a legal instrument for the creation of underground research laboratories, where studies will be conducted in potential host formations, at least at two locations and a best site will be chosen in 2006. It clearly prohibits the actual storage of nuclear waste in these laboratories. For this a new law had to be adopted after 2006.(*06)

Shortly thereafter ANDRA began with research in three new locations, which met fierce resistance. The French government stopped the investigation and wanted to consult the population. The government contracted for this reference Christian Bataille, then a member of parliament and undisguised supporter of nuclear power.(*07) In his search for a department that wanted to host an underground laboratory he spoke with people from different locations, elected officials and associations, but that did not lead to a broad support. Sometimes the disposal plans caused big splits in small local communities. In 1994, this disagreement was the reason why the mayor Michel Faudry from the potential host community Chatain in the department of Vienne committed suicide.(*08)

On January 6 1994, after the consultations Bataille chose three candidate departments for the underground high-level waste laboratories: Meuse, Gard, Haute-Marne and Vienne. Whether that laboratory is converted into a HLW-repository is a choice that will be made later. If a permit for the construction of an underground lab is given, the host community receives a compensation of €10 million per year during construction and operation of the laboratory.(*09)

Local groups were very dissatisfied with the state of affairs. In December 1997, the Conseil d'Etat rejected a complaint laid down in 1994 by residents of Meuse and Vienne on the Bataille mission. They stated that there had never been a real involvement of the affected population, as required by law. With this decision the Conseil d'Etat did not follow the advice of the so-called government commissioner, who agreed with the plaintiffs.(*10) Elected officials near Bure organized a nation-wide committee of elected officials opposed to underground labs.(*11) Associations of winegrowers in several area's (Cotes-du-Rhone and Roussillon) fear that their sales market will collapse if a nuclear waste repository is constructed in their neighborhood.(*12)

In 1997, in response to the protests, the French government decided to commission the National Assessment Commission (CNE) to study retrievability.(*13) CNE, a group that reviews progress on HLW management for government and parliament, published its report 'Thoughts on retrievability' in June 1998. CNE proposes retrievable storage (for TRU waste: non-heat-generating transuranic wastes) be licensed for relatively short periods – 50 years - to ensure that a decision must be taken on a regular base on whether or not the facility should be kept open. It also recommends long-term interim storage for spent fuel on the grounds that the fuel contains valuable energy products.(*14) In August 1999, the government authorized ANDRA to start work on an underground waste lab in a clay formation in Bure and to begin the process of finding a second site in granite. The Bure license would expire at 31 December 2006 by which time the parliament has to decide whether to transform the Bure site into a repository.(*15)

In December 1998 the departments Gard en Vienne were considered unsuitable because of geological reasons. The French government okay'd the waste lab at Bure in clay, but called for a new granite site.(*16)

Before the end of 2006 the government had to find a way out of a tough situation. The Nuclear Waste Act from 1991 required that at least two research laboratories should have been established, from which - following similar research - a choice had to be made. But there is only one underground laboratory: Bure.

Many environmental groups think that the government and ANDRA therefor do not comply with the law. In a December 2009 email Markus Pflüger of the anti-nuclear group Stop Bure in Trier (Germany) emphasized that again.(*17) But he also points at the fact that geological fault lines in the subsurface of Bure are denied by ANDRA: and, according to Pflüger, these fault lines are definitely a safety risk.

In June 2006 Planning Act was published.(*18) Besides 'optimizing repository concepts' and complete experimental program with technological demonstrations, it states that all operators of nuclear installations must estimate the future costs for the management of their spent fuel, decommissioning operations and the management of radioactive waste, and must allocate “the required assets to the coverage of those provisions.”

Commercial reprocessing, although originally introduced to obtain plutonium fuel for starting up fast-neutron reactors, is now clearly established as the national policy for spent-fuel management. A disposal facility for long-lived intermediate and high-level wastes is required to be in operation by 2025. No license shall be granted, however, “if the reversibility of such a facility is not guaranteed.” While the conditions of reversibility will be defined in a subsequent law, its minimum duration is one hundred years.

The license for the underground research laboratory in Bure (officially called LSMHM URL, often Bure is not even referred to) was initially until the end of 2006, but was extended on 23 December 2006 by the Government until the end of 2011. Therefore ANDRA has filed an application to renew it until 2030. The public inquiry was held from October 26 to November 30 and the licensing decree was granted on December 20, 2011.(*19) By making retrievability compulsory and to commission longer research, the French Government is circumventing the 1991 Nuclear Waste Act.

In early 2012 ANDRA signed a six-year contract with Gaiya as main contractor to project manage the conceptual and front-end phases of the Centre Industriel de Stockage Géologique project, dubbed “Cigeo”. The first conceptual study phase is to be conducted in 2012 and will lead on to a public consultation that will take place in 2013. The storage facility will be developed on a depth of 500 meters, and will exploit the properties of the Bure clay formation as a “geologic barrier to prevent any potential spread of radioactivity”. Although Cigeo will be designed to accommodate the wastes permanently, French law requires that storage can be reversible for at least 100 years.(*20)

Construction of Ohma nuclear plant indefinitely delayed.
Japan’s Electric Power Development Co has decided to delay the construction of its Ohma nuclear power plant indefinitely. The plant, which is under construction in Aomori prefecture (northern Honshu), was expected to be complete in late 2014. However, construction has been suspended since the Great East Japan Earthquake in March 2011. J-Power said in a statement that it is ‘moving ahead to review safety enhancement measures in response to the accident at Fukushima Daiichi’ and that it would incorporate any necessary measures.

Work started on the Ohma plant, a 1383 MW Advanced Boiling Water Reactor (ABWR) design, in May 2008. Originally due to start up in 2012, J-Power amended its scheduled start date to November 2014 towards the end of 2008. The Ohma plant has been designed to (eventually) run on a full mixed oxide (MOX) core. In 2009 J-Power entered into an agreement with Global Nuclear Fuel Japan to procure the MOX fuel for Ohman, which was to be manufactured in France.

Vermont Yankee: 130 arrests.
More than 1,000 people turned up in Brattleboro to march the 6 km from the town common to Entergy’s offices. Over 130 people trespassed on the company’s property and were arrested. Signs carried by the 1,000 protestors had messages like “time’s up” and “Entergy corporate greed”. March 22, was a monumental day for residents of the tri-state area near the Vermont Yankee nuclear power plant. Forty years after the plant opened, its license expired the day before, but the plant continued to operate pursuant to a federal court order.

The plant’s continued operation sets a precedent nationwide in the nuclear as well as in the legal realm. Earlier this year, federal Judge J. Garvan Murtha issued a ruling finding two Vermont laws requiring legislative approval for the plant to continue operating were unconstitutional as pre-empted by federal law. The plant hasn’t received a new license to replace the one that expired this March. The Vermont Public Service Board has yet to issue an order on the new license and no one has ordered the plant to cease operating in the interim. Entergy does have a license from the Nuclear Regulatory Commission, but its state license is expired. The company argues state law allows it to operate while the Public Service Board proceeding to approve a new license goes on.

Meanwhile the state and Entergy have appealed Judge Murtha’s decision to the Second Circuit Court of Appeals. Legal experts say the case could have national ramifications. (More in Nuclear Monitor 741, 3 Febr. 2012: Showdown time for Vermont Yankee).

Bidding process starts for Olkiluoto-4.
The Finnish nuclear power company Teollisuuden Voima (TVO) has started a bidding process for their Olkiluoto 4 project as a part of the bidding and engineering phase. Bids for the new nuclear power plant are expected at the beginning of 2013. TVO reported on March 23, that there are five plant supplier alternatives at the bidding phase of the OL4 project, namely the French installation company Areva, the American GE Hitachi, Korea Hydro & Nuclear Power in South Korea, as well as Mitsubishi Heavy Industries and Toshiba in Japan. TVO is not willing to take a stand on whether the difficulties and problems experienced by the Olkiluoto 3 project will have any influence on the possibilities of Areva's involvement.

TVO is to submit an application for a building permit by the summer of 2015. In April 2010, Finland's previous government decided to grant a permit to IVO for the construction of a new reactor in Olkiluoto. The decision was approved by Parliament in July 2010. According to TVO, the electric power of the new plant unit will be in the range of 1,450 to 1,750 MWe, while the projected operational life time of the new reactor is at least 60 years.

NRC approves COL for V.C.Summer.
The U.S. Nuclear Regulatory Commission (NRC) on March 30 approved the combined construction and operating licenses (COL) for the V.C. Summer nuclear power plant in South Carolina, just the second construction license approved for a nuclear plant since 1978. The NRC voted 4-1, just as the Commission did for the Plant Vogtle COLs. The NRC is expected to issue the COLs within 10 business days.

South Carolina Electric and Gas Co. and South Carolina Public Service Authority, or Santee Cooper, the owners and operators of the existing single-unit, 1,100 MW V.C. Summer plant, submitted the application for two new 1,117 MW Westinghouse AP1000 reactors to be built at the site in March 2008. The US$10 billion project, adjacent to the company’s existing reactor approximately 40 km northwest of Columbia, S.C., began in 2009 after receiving approval from the Public Service Commission of South Carolina.

The NRC did impose two conditions on the COLs, with the first requiring inspection and testing of squib valves, important components of the new reactors’ passive cooling system. The second requires the development of strategies to respond to extreme natural events resulting in the loss of power at the new reactors.

Search for Jordan's reactor site expands after protests.
The search for a potential site for Jordan's first nuclear reactor in Mafraq has expanded by a 40 kilometer radius. Officials are searching for a site near the Khirbet Samra Wastewater Treatment Plant, which, according to current plans, is to serve as the main water source to cool the 1,000 megawatt reactor.

According to a source close to the proceedings, the government directed the Jordan Atomic Energy Commission (JAEC) to find an alternative to the initially selected site, Balaama, near Mafraq, after coming under political pressure from tribal leaders and prominent local residents.  The announcement of the transferral of the planned site for the Kingdom's first nuclear reactor from Aqaba to Mafraq in late 2010 prompted a backlash from local residents, who held a series of protests and rallies over the past year urging decision makers to go back on their decision.

IAEA: safety concerns over aging nuclear fleet.
A 56-page IAEA document highlights safety concerns of an ageing nuclear fleet: 80%  of the world's nuclear power plants are more than 20 years old, and about 70 percent of the world's 254 research reactors have been in operation for more than 30 years "with many of them exceeding their original design life," the report said. But according IAEA Director General Yukiya Amano nuclear power is now safer than it was a year ago. The report said the "operational level of nuclear power plant safety around the world remains high".

"There are growing expectations that older nuclear reactors should meet enhanced safety objectives, closer to that of recent or future reactor designs," the Vienna-based U.N. agency's annual Nuclear Safety Review said. "There is a concern about the ability of the ageing nuclear fleet to fulfill these expectations."

Japan after Fukushima: 80% distrust government's nuke safety measures.
A whopping 80 percent of people in Japan do not trust the government's safety measures for nuclear power plants. The results are from a nationwide random telephone survey of 3,360 people conducted by The Asahi Shimbun on March 10-11. It received 1,892 valid responses. Fifty-seven percent of the respondents said they are opposed to restarting nuclear reactors currently off line for regular maintenance, compared to the 27 percent in favor. A gap between genders was conspicuous over whether to restart the reactors. Although men were almost evenly split, with 47 percent against and 41 percent in favor, 67 percent of women are opposed, compared with just 15 percent who support the restarts.

Regarding the government's safety steps for nuclear plants, 52 percent said they "do not trust so much," and 28 percent said they "do not trust at all." Although the government has been proceeding with computer-simulated stress tests on reactors, which are necessary steps to reactivate them, people apparently have a deep distrust of the government's nuclear safety provisions.

Tepco: water level reactor #2 wrong by 500%.
Tepco is reporting that the results of an endoscopy into reactor #2 at the Fukushima Daiichi nuclear plant show that water levels are far lower than previously thought. The utility had estimated that water in the reactor, which is required to keep melted fuel cool and prevent recriticality, was approximately three meters deep. In fact, it is only 60 cm deep. Tepco insists that the fuel is not in danger of overheating, and continues to pump in nine tons of water every hour. However, experts say that the low water levels show that leaks in the containment vessel are far greater than previously thought, and may make repairing and decommissioning the crippled reactors even more difficult. Tepco attempted an endoscopy in January, but the effort failed because the scope used was too short.

Tokyo soil samples would be considered nuclear waste in the US.
While traveling in Japan in February, Fairewinds’ Arnie Gundersen took soil samples in Tokyo. He explaines: "I did not look for the highest radiation spot. I just went around with five plastic bags and when I found an area, I just scooped up some dirt and put it in a bag. One of those samples was from a crack in the sidewalk. Another one of those samples was from a children's playground that had been previously decontaminated. Another sample had come from some moss on the side of the road. Another sample came from the roof of an office building that I was at. And the last sample was right across the street from the main judicial center in downtown Tokyo."

Gundersen (an energy advisor with 39-years of nuclear power engineering experience) brought those samples back to the US, declared them through Customs, and sent them to the laboratory. And the lab determined that all of them would be qualified as radioactive waste there in the United States and would have to be shipped to a radioactive waste facility to be disposed of.

Canada: court case against 2 new reactors Ontario.
A group of environmentalists has gone to court to challenge Ontario's plan to build new nuclear reactors, arguing the environmental risks and costs involved haven't been properly assessed. Lawyers for Ecojustice and the Canadian Environmental Law Association have filed arguments in Federal Court on behalf of several green agencies, saying a review panel failed to carry out a proper environmental assessment on building new reactors at the Darlington station in Clarington, Ontario. Despite a push for green energy projects, Ontario remains committed to nuclear energy, which makes up 50 per cent of its energy supply, and is moving forward with the construction of two new reactors. But the groups, which include Greenpeace, Lake Ontario Waterkeeper, Northwatch  and the Canadian Environmental Law Association, argue the government provided only vague plans to the federal government-appointed review panel, which nonetheless recommended the project be approved. They argue that, contrary to the requirements of the Canadian Environmental Assessment Act, the panel also didn't gather the evidence required to evaluate the project's need and possible alternatives.

The groups are asking Federal Court to order the review panel to take a second look at the project. A proper environmental study, the groups add, is especially important after lessons learned from the disaster at Japan's Fukushima nuclear plant. They also note that the government didn't select a specific type of nuclear reactor, making its possible impact difficult to assess. "Despite the profound lack of critical information regarding the project's design and specific means by which the radioactive waste it generates will be managed, the (joint review panel) report purports to conclude that no significant environmental effects are likely," said the court filing, obtained by The Canadian Press. That assumption implies that the "sizable information gaps" will be eventually considered by other bodies, and that "numerous to-be-determined mitigation measures" will be implemented. Such a "leap before you look" approach, the filing adds, "is the antithesis of the precautionary principle, and should not be upheld by this honourable court."

Alla A. Yaroshinskaya describes the human side of theApril 1986 Chernobyl disaster, with firsthand accounts. Dounreay: 'significant' hot particle found on beach.
Experts have discovered the most significant radioactive particle yet on a public beach two miles (approximately 3km) west of the redundant nuclear site of Dounreay, Scotland, UK. Dounreay clean-up contractor DSRL has informed the Scottish Environment Protection Agency of additional tests being carried out on a particle recovered during routine monitoring of a beach near the redundant nuclear site. The particle was detected at the water's edge at Sandside. The beach at Sandside is located. The particle - detected on February 14 - was the 208th to be recovered from the beach at Sandside in the last 15 years.

Provisional checks carried out on the beach indicated the particle had a higher than normal beta dose rate. A spokesman for DSRL said it was the first time a particle classed as significant - the highest classification in terms of radioactivity - had been found on the beach, although many had been found on the seabed and foreshore at Dounreay as well as on the site itself. Any particle with radioactivity above one million Becquerel (Bq) units is classed as significant.

Work is due to resume in May to clear particles from the seabed near the site. More than 1800 have been recovered so far from the seabed where there is evidence of a "plume" from historic effluent discharges dating back 50 years. Particles are fragments of irradiated nuclear fuel.

Defend democracy; Unite to shut Vermont Yankee down!
In 2010, the citizens and legislature of the State of Vermont, with support from their neighbors in Massachusetts and New Hampshire, decided to close the Vermont Yankee nuclear reactor permanently by March 21, 2012, when VY's 40-year license expires. In 2011, Entergy, the New Orleans mega-corporation that owns Vermont Yankee, sued the State of Vermont, defying the democratic will of the people, to keep their aged, accident-plagued reactor running for 20 more years. On January 19, 2012, federal district court judge J. Garvin Murtha sided with Entergy against the State of Vermont and the people of New England. On February 18, the State of Vermont appealed Murtha's ruling. With the future of VY still hanging in the balance, nonviolent citizen action is more important than ever.

Let us make clear: We will NOT allow unbridled corporate power to deprive us of our inalienable right to live in safety on our homes, and to determine our own energy future – a future that is safe and green for our children and our children's children. Many events have taken place and will take place to shut Vermont Yankee down. The most important one is 'Occupy Entergy HQ' on March 22. There will be a brief rally at the Brattleboro, VT Commons starting at 11:00am, then a walk to Entergy Headquarters on Old Ferry Rd. in Brattleboro (3.5 miles) where there be a direct action, likely to include civil disobedience.

Franco-British nuclear cooperation agreement.
On February 16, UK Prime Minister Cameron met his French counterpart Nicolas Sarkozy in Paris at a joint summit for the first time since their bitter clashes over Europe. The joint declaration on energy made contained a range of goals, the greatest of them being to encourage "the emergence of a Franco-British industry that is highly competitive across the whole supply chain at the international level." Most prominent in this will be the work of France's majority state-owned firms EDF and Areva and their cooperation with privately held UK firms for the construction of new reactors in Britain.

The agreement to co-operate on developing civil nuclear energy is meant to pave the way for the construction of new nuclear power plants. It was accompanied by the news of a deal between Rolls-Royce and French nuclear reactor developer Areva. Areva has asked Rolls to make complex components and provide engineering and technical services for two reactors to be built at Hinkley Point, Somerset.

But not everybody is confident that the agreement will bring much for Britian's industry. According to Tim Fox, head of energy at the Institution of Mechanical Engineers "Although some relatively small contracts are to be awarded to Rolls-Royce and BAM Kier, it looks increasingly likely that the vast majority of the contracts involved in the manufacture and construction of the new nuclear reactors at Hinkley Point and Sizewell will go to France rather than the UK." Friends of the Earth's Energy Campaigner Paul Steedman said: "Cameron's deal today will leave British taxpayers footing a massive bill for new nuclear plants we don't need and can't afford - while EDF continues to rake in huge profits."

From Febr. 12 on, following an occupation of trees a week earlier, activists are occupying a farmhouse close to Hinkley Point, to stop EDF Energy trashing land for the planned new nuclear power station. Anti-nuclear campaigners have been joined by members of Seize the Day as the first residents of Edf-Off Cottage which is on the 400-acre site earmarked for two new reactors.

At the High Court on February 27, EDF Energy failed in their bid to impose an injunction to stop an alliance of anti-nuclear groups from protesting on the 400-acre site set aside for two new mega-reactors at Hinkley Point. This injunction was being sought to remove these campaigners, but it was simultaneously designed to restrict future demonstrations. The Orwellian language even prohibits campaigning groups from 'encouraging other persons' to protest at the site. Speaking on behalf of the Stop New Nuclear alliance, Kate Hudson from CND stated "It should be inconceivable that private companies could restrict basic civil liberties in this way. They are not the arbiters of the nuclear debate, nor the guarantors of our freedoms. We will fight to ensure the rights of future generations to peaceful protest and to preserve essential democratic principles."

On 10 and  11 March, one year since the Fukushima nuclear disaster began, antinuclear groups call for a human chain/blockade around the station to show "our determined opposition to new nuclear".

Spain: OK for 41-year old Garona life extension. Spain's nuclear security agency CSN has determined that the country's oldest nuclear reactor, the 468 MW Santa Maria de Garona nuclear power plant, is safe to operate until 2019, in response to a request by the industry minister to review the installation. The approval, disclosed on February 17, clears the way for the recently installed Spanish conservative government to overturn the previous socialist government's 2009 order to have the generator closed in 2013. Although the CSN said there was "no safety or security issue that should impede continued operation of the power plant", the agency added that it would still have to review any formal application by the operator to extend the installation's license, including scrutiny of its latest operating data and future security measures being considered. Garona was first connected to the grid in March 1971!
The CSN in 2009 had given authorization for the station to operate for another 10 years, but the government at the time opted instead for an earlier expiration date. Since then, new regulations have been put in place, particularly following the accident at Japan's Fukushima nuclear power plant early last year.

World oldest reactor (44 years) closed. The world's oldest operating nuclear power reactor – Unit 1 of the Oldbury nuclear power plant in the UK - has been closed after 44 years of power generation on 29 February 2012. Unit 2 was shut down in June 2011, while unit 1 was expected to continue operating until the end of this year. Plant operator Magnox Ltd announced last October that it had decided to end operations ten months early as it was "no longer economically viable."

Beznau now oldest in world; call for closure.
After Oldbury's closure, Switzerland's Beznau nuclear plant holds the dubious record of being the oldest nuclear plant in the world and should be shut down, a group of environmental organizations said on February 23. Switzerland is phasing out nuclear energy but not fast enough, say the groups. They list a number of problems and point out that the company that runs it is planning to increase the earmarked CHF500 million (US$ 557m or 415m euro) to make it safe, money they believe could be better spent shutting it down and moving to safer energy sources.

U.S.: Fourth Legislative Attack on Grand Canyon Uranium Ban Fails… The fourth legislative attempt to block the Obama administration's ban on new uranium development across 1 million acres of public land surrounding Grand Canyon National Park died February 14, when the House rules committee ruled it out of order. The amendment was sponsored by the same three Republican congressmen who sponsored three previous failed anti-Grand Canyon legislative proposals - Jeff Flake, Trent Franks and Paul Gosar, all from Arizona. The most recent amendment sought to overturn a January decision by Interior Secretary Ken Salazar enacting a 20-year 'mineral withdrawal' that bans new mining claims and development on existing claims lacking rights-to-mine across Grand Canyon's million-acre watershed (see Nuclear Monitor 740, 13 January 2012, In Briefs).

In 2010 and again in 2011, Flake, Franks and Gosar sponsored legislation that would have prohibited the Interior Department from enacting the mining ban; in 2011 they attempted to add a rider to a budget bill - their third failed attempt prior to this most recent amendment.

Over the past few years, nearly 400,000 people from 90 countries wrote the Department of the Interior urging it to ban new uranium mining around the canyon after a uranium boom threatened to bring a new wave of destructive mining threatening recreation, tourism, wildlife habitat and waters in Grand Canyon National Park. The mining ban has won wide support among American Indian tribes, regional businesses, elected officials, hunting and angling groups, scientists and conservationists.

The withdrawal of lands in northern Arizona from mining activities is unconstitutional, unlawful and violates the National Environmental Policy Act, said organisations representing the US mining and nuclear industries in a lawsuit against US Interior Secretary Ken Salazar.

The suit has been filed with the US Federal District Court in Arizona by the National Mining Association (NMA) and the Nuclear Energy Institute (NEI), the US nuclear energy industry's organization. The Department of the Interior (DoI), US Bureau of Land Management (BLM), US Forest Service and US Department of Agriculture are named as co-defendants alongside Salazar, in his capacity as Interior Secretary.

The NEI and NMA argue that Salazar does not have the legal authority to make withdrawals of public lands in excess of 5000 acres, citing a landmark 1983 Supreme Court ruling that such withdrawals would be unconstitutional. Furthermore, they claim, the decision to withdraw the land is "arbitrary, capricious, and not in accordance with law." Finally, the environmental impact statement (EIS) and record of decision on the withdrawal violate the terms of the National Environmental Policy Act (NEPA) in failing to take a "hard look" at the economic and environmental consequences of the withdrawal.

Finland: Uranium mine granted permission.
The Finnish Talvivaara mine today gained permission to extract uranium and process it into uranium oxide. The UO4 would be transported away by rail and ships, possibly to Russia. The mine was opened a few years ago mainly as a zinc mine. It's using an experimental biosoaking process to extract small amounts of minerals from the ore. The company has been crippled by scandals from the beginning, with sulphuric acid and other chemicals continuously spilling all over nearby woods and lakes. The company has failed to make any profit so far and its CEO was forced to quit last year.

In a strange technocratic turn of events, the environmental authorities concluded that instead of closing down the mine, it would be beneficial to grant the mine a permission to separate the uranium from the rest of the waste so that the further spills bound to happen at least wouldn't contain radioactive materials. As a last minute effort, environmentalists tried to convince the government to at least demand a description of the separation process so as to ensure this doesn't just produce a lot more radioactive/toxic sludge. The government decided not to do so and instead just granted the permission "because it brings 40 million euros worth of investment to the area".

The local municipality and just about every major business in the area was opposed to the permission after the previous scandals and their trade being spoiled by the smelly pollution in the environment.

Rosatom-owned company accused of selling shoddy equipment to reactors.
Russian Federal Prosecutors have accused a company owned by the country’s nuclear energy corporation, Rosatom, with massive corruption and manufacturing substandard equipment for nuclear reactors under construction both at home and abroad.  The ZiO-Podolsk machine building plant’s procurement director, Sergei Shutov, has been arrested for buying low quality raw materials on the cheap and pocketing the difference as the result of an investigation by the Federal Security Service, or FSB, the successor organization to the KGB. It is not clear how many reactors have been impacted by the alleged crime, but reactors built by Russia in India, Bulgaria, Iran, China as well as several reactor construction and repair projects in Russia itself may have been affected by cheap equipment, given the time frame of works completed at the stations and the scope of the investigation as it has been revealed by authorities.

India: nuclear lobbyist heads national solar company.
India's prime minister has appointed Anil Kakodkar, former head of the Atomic Energy Commission to be in charge of the national solar mission. The Solar Energy Corporation of India was recently set up as a not-for-profit company and will work under the administrative control of the New and Renewable Energy Ministry (NREM).  The move to appoint Kakodkar will likely create somewhat of a controversy, as India Today points out, calling the decision "a bizarre move that smacks of unfair public policymaking," and a "clear case of conflict of interest." His appointment as head of the solar mission is bound to upset anti-nuclear activists in the country who want the government to actively promote alternatives such as solar and wind while giving up investments in nuclear energy.

Ignoring this contribution of renewable sources of energy, Kakodkar has constantly projected nuclear energy as the "inevitable and indispensable option" that addresses both sustainability as well as climate change issues. But despite huge investments during the past half a century, nuclear power contributes just a fraction of India's energy needs. The total installed capacity of nuclear power in the country is 4,780 MW, while the total installed capacity of renewable sources of energy is 20,162 MW, according to data collected by the Central Electricity Authority.

In his new role, Kakodkar will be responsible for turning around the fortunes of the government’s Jawaharlal Nehru National Solar Mission (JNNSM). The Solar Energy Corporation of India has been created to act as its executing arm. Although still in its infancy, its organization has already come under fire from both developers and politicians. In the first days of 2012 the findings of a Parliamentary panel were released, labeling the Ministry’s approach to the national solar mission as “disappointing” and “lackadaisical”. This research followed on from disappointing end-of-year installation figures, which saw just 400MW of the 1.2GW of installations forecasted by the government achieve grid connection.

Netherlands: Borssele 2 delayed; EDF no longer interested.
Delta, the regional utility wanting to build a nuclear reactor at Borssele, delayed its decision about investing 110 million in a new license by at least half a year. Furthermore they announced that Delta will no longer be the leading company in the project. Although it is hard to find out what that exactly means, it is clear that Delta will not have a majority stake in the reactor if the project continues. Many people expect this is the end of the project. However, in a press statement Delta is repeating its commitment towards nuclear energy.

Another surprising outcome was that the French state utility EDF (which signed a Memorandum of Understanding about investigating the possibilities for a new reactor in the Netherlands with Delta in 2010) is not longer involved in the project. Delta CEO Boerma, a passionate but clumsy nuclear advocate, left the company, but that cannot be seen as the end of the nuclear interest in nuclear power, either. It is a sacrifice to reassure the shareholders he offended several times in the last months.

German RWE (via the Dutch subsidiary ERH Essent) is another interested partner for a new reactor at Borssele. ERH is in the process to obtain a licence and has the same decision to make as Delta to invest 110 million euro in obtaining a license. If RWE is still interested at all, it is more likely they will cooperate with a large share in the Delta project.

Public support in Zeeland for a new reactor is plummeting according to several polls early December. This is another nail in the coffin, because Delta is very keen to point out there is almost a unanimously positive feeling in the Zeeland province about the second nuclear power plant.

If Delta can not present solid partners for the project at the next stakeholders meeting planned in June 2012, those stakeholders will decide to pull the plug.

US: Large area around the Grand Canyon protected from mining.
On January 9, 2012, after more than 2 years of environmental analysis and receiving many thousands of public comments from the American people, environmental and conservation groups, the outdoor recreation industry, mayors and tribal leaders, U.S. Interior Secretary Ken Salazar withdrew more than 1 million acres (400,000 hectares) of land around the canyon from new mining claims for the next twenty years -the longest period possible under the law.

In the months immediately leading up to this landmark decision, many environmental organizations worked with conservation advocates and outdoors enthusiasts around the country to urge the Administration to halt toxic uranium mining around the Grand Canyon. Interior Secretary Salazar received comments from nearly 300,000 citizens urging him to withdraw one million acres of land from new mining claims.

The decision however would allow a small number of existing uranium and other hard rock mining operations in the region to continue while barring the new claims. In 2009 Mr. Salazar suspended new uranium claims on public lands surrounding the Grand Canyon for two years, overturning a Bush administration policy that encouraged thousands of new claims when the price of uranium soared in 2006 and 2007. Many of the stakeholders are foreign interests, including Rosatom, Russia's state atomic energy corporation.

The landscape is not the only thing at stake. Uranium mining in western states has an abysmal track-record. In Colorado, New Mexico, Arizona and Utah, uranium mining has had undeniable health impacts on miners and nearby residents, including cancer, anemia and birth defects. Even the Grand Canyon itself bears the scars of uranium mining. Radioactive waste has poisoned streams and soil in and around the canyon, while abandoned and active mines are scars on the Arizona landscape. Soil levels around the abandoned Orphan Mine inside Grand Canyon National Park are 450 times more than normal levels, and visitors to the park are warned not to drink from Horn Creek. The closest mine currently in operation, Arizona 1, is less than 2 miles from the canyon’s rim. “Mining so close to the Grand Canyon could contaminate the Colorado River, which runs through the canyon, and put the drinking water for 25 million Americans at risk,” added Pyne. “Uranium mining has already left a toxic legacy across the West -every uranium mine ever opened has required some degree of toxic waste clean-up- it certainly doesn’t belong near the Grand Canyon.”

August 2014 is the date that Teollisuuden Voima Oyj (TVO) expects to see power flow from its new reactor, Olkiluoto 3, according to a single-line statement issued on 21 December. The announcement brought a little more clarity to the unit's schedule compared with TVO's last announcement, which specified only the year 2014. The Finnish utility said it had been informed by the Areva-Siemens consortium building the unit that August 2014 was scheduled for commercial operation.

Construction started in May 2005. A few days after the October announcement that Olkiluoto cannot achieve grid-connection before 2014 the French daily was citing a report stating that the costs for Areva are expected to 6.6 billion euro (then US$ 9.1 billion). The price mentioned (and decided on) in Finnish Parliament was 2.5 billion euro, the initial contract for Olkiluoto 3 was 3 billion euro.

France: 13 billion euro to upgrade safety of nuclear reactors.
In response to the Fukushima nuclear disaster, French nuclear safety regulator ASN has released a 524-page report on the state of nuclear reactors in France. The report says that government-controlled power provider Electricité de France SA (EDF) needs to make significant upgrades “as soon as possible” to its 58 reactors in order to protect them from potential natural disasters. The ASN gave reactor operators until June 30 to deliver proposals meeting the enhanced security standards of sites they run. Costs for the upgrades are estimated at 10 billion euros (US$13.5 billion); previously planned upgrades to extend the life of the nation’s reactors from 40 to 60 years are now expected to cost as much as 50 billion euros. Modifications include building flood-proof diesel pumps to cool reactors, creating bunkered control rooms, and establishing an emergency task force that can respond to nuclear disasters within 24 hours. Andre Claude Lacoste, the Chairman of ASN, said, “We are not asking the operator to make these investments. We are telling them to do so.” French Energy Minister Eric Besson plans to meet with EDF and reactor maker Areva, as well as CEA, the government-funded technological research organization, on January 9 to discuss implementation of ASN’s recommendations. Seventy-five percent of France’s energy comes from nuclear power, more than that of any other country. Experts say that the cost of nuclear power in France will almost certainly rise as a result of the required upgrades. EDF shares are down as much as 43 percent in the last 12 months.

Nuclear's bad image? James Bond's Dr. No is to blame!
James Bond movies are to blame for a negative public attitude to nuclear power, according to a leading scientist. Professor David Phillips, president of the Royal Society Of Chemistry, reckons that supervillains such as Dr No, the evil genius with his own nuclear reactor, has helped create a "remorselessly grim" perception of atomic energy. Speaking ahead of Bond's 50th anniversary celebrations, Phillips said he hopes to create a "renaissance" in nuclear power. In the first Bond film of the same name, Dr No is eventually defeated by Sean Connery's 007 who throws him into a cooling pool in the reactor. And Phillips claims that this set a precedent for nuclear power being sees as a "barely controllable force for evil", according to BBC News, since later villains hatched similar nuclear plots.

North Korea: halting enrichment for food?
On January 11, North Korea suggested it was open to halting its enrichment of uranium in return for concessions that are likely to include food assistance from the United States, the Washington Post reported. A statement said to be from a North Korean Foreign Ministry spokesman urged the Obama administration to "build confidence" by including a greater amount of food in a bilateral agreement reportedly struck late last year shortly before the sudden death of North Korean leader Kim Jong Il. Washington halted food assistance to the North after the regime carried out what was widely seen as a test of its long-range ballistic missile technology in spring 2009.

While rebuking the United States for connecting food assistance to security concerns, the statement was less bombastic than the proclamations that are typically issued by the Stalinist state. The statement marked the first time Pyongyang made a public pronouncement about the rumored talks with Washington on a deal for food assistance in exchange for some nuclear disarmament steps. Washington has demanded that Pyongyang halt uranium enrichment efforts unveiled in 2010 as one condition to the resumption of broader North Korean denuclearization negotiations that also involve China, Japan, Russia and South Korea (the socalled six-party talks).

The Obama administration has been exceedingly wary about agreeing to any concessions with Pyongyang, which has a long track record of agreeing to nuclear disarmament actions in return for foreign assistance only to reverse course once it has attained certain benefits.

Support for nuclear is not 100% any more in CR and SR.
Both Czech and Slovak Republic until recently announced intentions of keeping nuclear power and even increasing capacity by constructing new nuclear power plants – more the less for export.  However, Fukushima and “nearby” Germany´s phase-out caused doubts.  Mr. Janiš, the Chairman of the Economic Committee of the Slovak Parliament said today: “I have not seen an objective study on the benefits of constructing a new nuclear power plant in Jaslovské Bohunice,” said Mr. Janiš. According to him it would be a wrong decision to make Slovakia into a nuclear superpower, when e.g. Germany and Switzerland are phasing out their plants. Mr. Janiš thinks that biomass and sun are the future. Contrary to him, the minister of economy Mr. Juraj Miškov still believes that the fifth unit in Jaslovské Bohunice has a future; the feasibility study will be ready by mid 2012. He is convinced that due to the phase-out in some countries, the electricity demand will increase and Slovakia might become an even more important electricity exporting country than until now.

This comes only days after the Czech Republic announced to downsize the Temelin tender from 5 to 2 reactors thereby losing the possibility to negotiate a 30% lower price. Also here a major question is: will Austria and Germany be interested in importing nuclear power?

Russia: 25,000 undersea radioactive waste sites.
There are nearly 25,000 hazardous underwater objects containing solid radioactive waste in Russia, an emergencies ministry official said on December 26. The ministry has compiled a register of so-called sea hazards, including underwater objects in the Baltic, Barents, White, Kara, and Black Seas as well as the Sea of Okhotsk and the Sea of Japan. These underwater objects include nuclear submarines that have sunk and ships with ammunition and oil products, chemicals and radioactive waste. Hazardous sites with solid radioactive waste sit on the sea bed mainly at a depth of 500 meters, Oleg Kuznetsov, deputy head of special projects at the ministry’s rescue service, said. Especially dangerous are reactor holds of nuclear submarines off the Novaya Zemlya Archipelago and a radio-isotope power units sunk near Sakhalin Island, he added.

Oppose Nigeria's nuclear plans.
On September 15, President Goodluck Jonathan formally inaugurated Nigeria's Atomic Energy Commission and urged its members headed by Erepamo Osaisai to quickly evolve implementable plans and timelines for the delivery of atomic energy for peaceful purposes in the country. We recall that the Nigeria Atomic Energy Commission was established in 1976 to investigate the development of nuclear energy but little progress was made. It was reactivated in 2006 and President Jonathan appointed a new team this year.

Nigeria has the world's seventh-largest natural gas reserves, yet the nation is blighted by persistent electricity outages which force businesses and individuals who can afford them to rely on generators. Much of this vast gas reserves sit untouched under the ground or are flared into the sky. Despite being Africa's biggest crude oil exporter, decades of corruption and mismanagement mean Nigeria has never built the infrastructure to farm its huge oil and gas resources for much-needed domestic use.

Deficits in our existing institutions remain a defining albatross on the path to meaningful development. Cut to the bone, this scenario suggests that Nigeria currently lacks the indigenous capacity, supporting infrastructure, discipline and security wherewithal to build and manage an atomic power plant. It simply is another way of courting disaster - one we cannot manage.

Let us explore and exploit other safer, rational options. These include solar, gas, hydro, wind and coal options. Nigeria has these resources in stupendous quantities. A presidential directive requesting timelines for the generation of electricity through these options is far better than the timelines he recently demanded from the newly-inaugurated Atomic Energy Commission. Our scientist-president should think again.

Belene construction agreement extended.
Russia's AtomStroyExport (ASE) and Bulgaria's National Electricity Company (NEK) have signed a supplement to their agreement on the construction of the Belene nuclear power plant, extending it until the end of March 2012. Under an earlier extension, the agreement - originally signed in 2006 - was extended until 30 September. According to ASE, the extension 'confirms the parties' interest in the continuation of the project.' NEK said that during the next six months, the two companies will continue their activities related to completing a market study, clarifying the financial model and studying the project finance proposal submitted by financial advisor HSBC. It added that the extra time will allow Bulgaria to conduct an analysis of the results and recommendations of stress tests being performed at nuclear power plants across the European Union. ASE said that work on the foundation pit for the first reactor at Belene has now been completed. It said that a concrete plant at the site has already been put into operation and that water treatment plants have been built.

UAE: Construction first unit will start mid-2012.
According to the Emirates Nuclear Energy Corporation (Enec), a government establishment created last year to oversee the ambitious nuclear construction project, said it would launch construction work for the infrastructure of four planned nuclear power plants in Barrakah in the western region in mid 2012 to pave the way for their operation in 2017. The UAE will award a contract in early 2012 for the supply of nuclear fuel to run its four nuclear reactors which the country is planning to construct as part of an ambitious nuclear power program.

Under the agreement to built 4 nuclear reactors, inked on December 27, the state-owned Korea Electric Power Corp (Kepco) and is partners in the consortium will design, build and run the reactors that will produce 5,600 MW of electricity. The contract to build the reactors is worth about US$20 billion (15bn euro).

The UAE has said the project is intended to diversify its energy supply sources and meet its rapid growing electricity demand, which is projected to surge to around 40,000 MW in 2020 from nearly 15,000 MW in 2009. The nuclear project will provide nearly 25 per cent of the UAE’s total energy needs of nearly 40,000 MW in 2020. Around seven per cent will be generated through renewable energy and the rest through conventional means.

Pyhäjoki location for Finland's sixth reactor.
Fennovoima has chosen Pyhäjoki as the site for its nuclear power plant. Pyhäjoki municipality is located in North Ostrobothnia and the nuclear power plant will be constructed on Hanhikivi peninsula on the coast of Bothnian Bay. For the basis of the site selection, assessments were carried out during some four years. In the beginning of Fennovoima project in summer 2007, the company had almost 40 alternative sites. The number of alternatives was decreased gradually based on assessments and in December 2009 Fennovoima ended up having two alternatives, both located in Northern Finland: Pyhäjoki and Simo municipalities. In the final site decision, safety, technical feasibility, environmental matters, construction costs and schedule were the main factors examined as well as the ability of the site region to support a project that will bring thousands of people to work and use services there.

Fennovoima continues now the planning work together with the municipality, authorities and the plant suppliers and prepares applying for various licences and permits. For example, more detailed bedrock, environmental and water studies will be carried out on the Hanhikivi peninsula. Simultaneously, other preparations for the future phases of the project are carried out together with Pyhäjoki and Raahe region. First preparatory works on Hanhikivi will be started in the end of 2012 at earliest. The construction schedule will be elaborated after the plant supplier has been selected. Fennovoima sent bid invitations for Areva and Toshiba in July 2011 and the plant supplier will be chosen in 2012-2013.

Fennovoima has two owners: Voimaosakeyhtiö SF and E.ON Kärnkraft Finland. Voimaosakeyhtiö SF owns 66 percent of Fennovoima and nuclear expert E.ON Kärnkraft Finland 34 percent. Altogether Fennovoima has 70 shareholders. Voimaosakeyhtiö SF is owned by 69 finnish regional and local energy companies as well as companies in trade and industry.

Finland has 4 reactors in operation (two at Lovisa and two at Olkiluoto). The fifth (Olkiluoto-3) in under construction; over budget and over time.

Health effects radiation suppressed by tobacco companies.
Tobacco companies knew that cigarette smoke contained radioactive alpha particles for more than four decades and developed "deep and intimate" knowledge of these particles' cancer-causing potential; however, they deliberately kept their findings from the public. The study, published online in Nicotine & Tobacco Research, the peer-reviewed journal of the Society for Research on Nicotine and Tobacco, adds to a growing body of research detailing the industry's knowledge of cigarette smoke radioactivity and its efforts to suppress that information. The UCLA researchers analysed  dozens of previously unexamined internal tobacco industry documents, made available in 1998 as the result of a legal settlement.

“The documents show that the industry was well aware of the presence of a radioactive substance in tobacco as early as 1959; furthermore, the industry was not only cognizant of the potential 'cancerous growth' in the lungs of regular smokers but also did quantitative radiobiological calculations to estimate the long-term lung radiation absorption dose of ionizing alpha particles emitted from cigarette smoke." The study’s first author, Hrayr S. Karagueuzian, a professor of cardiology who conducts research at UCLA's Cardiovascular Research Laboratory, said: ‘We show here that the industry used misleading statements to obfuscate the hazard of ionizing alpha particles to the lungs of smokers and, more importantly, banned any and all publication on tobacco smoke radioactivity.” 

The radioactive substance, which the UCLA study shows was first brought to the attention of the tobacco industry in 1959, was identified in 1964 as the isotope polonium-210, which emits carcinogenic alpha radiation. Polonium-210 can be found in all commercially available domestic and foreign cigarette brands, Karagueuzian said, and is absorbed by tobacco leaves through naturally occurring radon gas in the atmosphere and through high-phosphate chemical fertilizers used by tobacco growers. The substance is eventually inhaled by smokers into the lungs.

Dounreay: Belgium waste to be returned.
Dounreay has announced the return of reprocessing wastes from the BR2 research reactor in Belgium. The BR2 reactor in Mol was a good customer for Dounreay over the years, receiving new enriched uranium fuel from the reprocessed spent fuel. It planned to send considerably more spent fuel to Dounreay but the reprocessing plant was closed by a leak and never reopened. Wastes have already been returned to France and Spain. One Dounreay reprocessing customer has requested the substitution of vitrified high-level wastes for the intermediate level wastes at Dounreay (a consultation on this was held in 2010). However, Belgium wants to take back the intermediate level waste, as required by the original contract with Dounreay. Dounreay also had contracts with Australia, Germany and for Italian-owned fuel from Denmark.

There are 153 tons of BR2 reprocessing wastes cemented into 500-liter drums and this will involve an estimated 21 shipments over four years, starting this autumn. The shipments will be from Scrabster and will probably involve the former roll-on/roll-off ferry, the Atlantic Osprey.

IAEA Inspector exposed to radiation.
On October 5, the International Atomic Energy Agency (IAEA) reported that one of its nuclear inspectors had been exposed to radiation during a 4 October inspection of the Belgoprocess nuclear waste facility in Dessel, Belgium. The inspector, along with an inspector from Euratom and a Belgoprocess employee, apparently received a dose of radiation after a vial or flask of plutonium accidentally fell on the floor, according to releases from the company and the Belgian Federal Nuclear Control Agency (AFCN). Plutonium is dangerous if ingested, but the amount received by the inspectors was less than the legal limit, the AFCN says. No radiation has been released beyond the site.

Atucha II, Argentina's third nuclear power plant.
President Cristina Kirchner inaugurated Atucha II, Argentina's third nuclear power plant on September 28. The German-designed reactor is expected to be fully operational in six to eight months after engineers run a series of tests. Construction of the plant began in July 1981, but work soon stopped and did not resume until 2006, when then-president Nestor Kirchner (2003-2007), the current leader's late husband, ordered the plant to be completed.

Argentina's other nuclear plants are Atucha I (335 megawatts) and the Embalse plant (600 megawatts). Once Atucha II is online 10 percent of Argentina's electricity will be produced by nuclear power. Plans are on the drawing board for Atucha III plant as well as an overhaul of the Embalse plant to add 30 years to its operational life, said Planning Minister Julio de Vido. Embalse was connected to the grid in 1983. Atucha II is located on the banks of the Parana river in the town of Zarate, some 100 kilometers north of the capital Buenos Aires. It was built at a cost of more than 2.4 billion dollars.

Another USEC deadline for DOE loan guarantee.
On September 30, USEC, announced morning it will reduce its spending on the American Centrifuge Project (ACP) in Piketon by 30 percent over the next month. It will also send out notices to its 450 employees Ohio, Tennessee and Maryland that layoffs are possible if the company doesn’t receive a loan guarantee before October 31. USEC has invested approximately US$2 billion in the ACP but needs significant additional financing to complete the plant. In 2008, USEC applied for a US$2 billion loan guarantee from Department of Energy for construction of the ACP. USEC significantly demobilized construction and machine manufacturing activities in 2009 due to delays in obtaining financing through DOE’s Loan Guarantee Program. Since then, many 'final' deadlines were set by USEC (three in the past half year: June 30, Sept. 30 and now Oct, 31) to obtain the loan guarantee.

In a call with investors, USEC President and CEO John Welch said the company must see a loan guarantee during the next month or risk the end of the project. USEC expects October “to be a month of intense interaction with the DOE,” in hopes of securing the loan guarantee.

The company had faced a September 30 deadline with two investors — Toshiba America Nuclear Energy Corporation and Babcock & Wilcox Investment Company — to receive a US$2 billion loan guarantee. They agreed September 30 to extend that deadline to October 31. If USEC receives the loan guarantee, the companies have promised US$50 million to support the project.

In a statement, DOE Spokesman Damien LaVera said, “The Department of Energy has been working closely with USEC as the company has continued to test and validate its innovative technology, obtain private financing and meet other benchmarks that would be required for a successful loan guarantee application. We are strongly committed to developing effective, domestic nuclear enrichment capabilities and are looking at all options on a path forward.”

The ACP will utilize USEC’s AC100 centrifuge machine, which has been developed, engineered and assembled in the US. The AC100 design is a disciplined evolution of classified U.S. centrifuge technology originally developed by DOE. DOE invested already US$3 billion over 10 years to develop the centrifuge technology.

Taiwan: nuclear accident compensation increased.
On September 30, the Taiwanese Cabinet approved an amendment to the Nuclear Damage Compensation Act that imposes heavier compensation liability on nuclear power operators in the event of natural disasters such as an earthquake or a typhoon. Under the amendment, the maximum amount of compensation for losses caused by a nuclear accident was increased from NT$4.2 billion (US$138 million or 103 million euro) to NT$15 billion (US$5 mln or 3.7 mln euro) and the allowed period for compensation claims was extended from 10 to 30 years.

The amendment came after the Atomic Energy Council reviewed the act, which had not been amended since it was first enacted in 1997, in the wake of the nuclear accident at Japan’s Fukushima Daiichi Nuclear Power Plant. Democratic Progressive Party Legislator Tien Chiu-chin said the amendment fell short of her expectations as she had suggested further lifting the ceiling on compensation liability.

36 year old construction permit extended. The US Nuclear Regulatory Commission (NRC) has extended the construction permit for the unfinished Bellefonte unit 1 in Alabama.
The construction permit was originally granted in 1974. It was suspended in 1988, when Tennessee Valley Authority (TVA) decided to halt work on the project, but the NRC agreed in 2009 to reinstate the permit. With the reinstated permit due to expire on 1 October 2011, TVA lodged an application for an extension in October 2010. The NRC has now agreed to that extension, meaning that the construction permit will remain valid until 1 October 2020. (see more in Nuclear Monitor 732, 9 September 2011)

Swiss parliament, no new reactors.
On September 28, the Council of States has followed the government’s lead by voting not to replace the country’s five nuclear power stations  and boost renewable energy resources. Switzerland currently has five nuclear power plants that will gradually come off the power grid at the end of their 50 year (!) lifespan: the first one in 2019 and the last one in 2034. The Senate followed the House of Representatives in calling on the government to ban new nuclear plants but keep parliament "informed about innovations in the field."

The clear result of the September 28 vote - with a three to one majority - came after a parliamentary committee prepared a compromise formula, promoted by the centre-right Christian Democratic Party, which will give parliament another chance to have a say at a later stage. “Even if we were to ban nuclear power plants now our successors in parliament could still one day decide on building on new reactors,” a Christian Democratic Senator, Filippo Lombardi from Ticino, said on behalf of the committee. Discussions on nuclear power are due to continue in the new parliament which is due to convene for the first time in December following general elections next month.

The Social Democrats, the Greens as well as the Christian Democratic Party hailed the Senate decision as an important step towards a new energy policy amid calls for further measures to switch to more renewable energy sources.

The government called for a withdrawal from nuclear energy in May – a proposal backed by the House of Representatives a month later.

Hinkley Blockaded: No New Nuclear Power!
More than 300 people (even up to 400, according to a BBC-report), successfully sealed off the main entrance to Hinkley Point nuclear power station in Somerset for nine hours on 3 October in opposition to EDF Energy's plans to build two new mega-reactors on the site. EDF said of 500 employees at the plant, only essential staff had been called in and had arrived by bus at dawn.

Blockaders were joined by a theatrical troupe who enacted a nuclear disaster scenario, while Seize the Day provided a musical backdrop to the event. 206 helium balloons were released to represent the number of days since the Fukushima meltdown. The balloons will be tracked, to show which areas of the West Country would be worst affected by a nuclear disaster at Hinkley.

French Nuclear Authority points to "weaknesses" of the EPR.
The construction of the EPR nuclear reactor being built in Flamanville, has many "weaknesses" that put the "final quality" into doubt. This is the conclusion drawn after a  thorough inspection conducted on site in May by the Nuclear Safety Authority (ASN). The report of this "inspection review", highlighted by Le Canard Enchaine on August 24, is posted on the site of the ASN (www.asn.fr). It is a 20 page letter sent by the ASN on June 24 to EDF, the prime contractor for the 1600 megawatt reactor designed by Areva. The inspection has was  carried out by fifteen experts, including an observer from the British regulator. The team found deviations from the construction requirements on essential parts of the reactor: the feed of the steam generators, water injection filters, the RIS batteries of the cooling system. "EDF has to make great efforts to show the final quality of the construction of Flamanville 3", judges the ASN, which points out: "inconsistencies between the requirements specified in sub-contracting and the demands mentioned in the preliminary safety report" - that is to say a non-compliance with initial prescriptions. Concerning an essential feature of the steam generators, experts estimate that "the quality of materials taking into account their importance for safety has not been demonstrated and their use in FLA3 is not possible". In two cases, they demand from EDF to "not engage in actions that are difficult to reverse before demonstrating" compliance.

Town produces 321% more energy than it uses.
A small Bavarian town in Germany called Wildpoldsried produces 321% more energy than it uses, from renewable and natural sources. By selling the excess energy, Wildpoldsried has eliminated all the towns debt and generates 4.0 million Euro (US$5.7 million) in annual income. The point they are at now in terms of energy production and independence was reached by starting a plan about fourteen years ago to develop more clean energy sources and green building projects. The town with a population of about 2,500 started work on a huge community initiative involving the construction of nine new buildings and energy sources. The new buildings included a school, community hall and gym, and they employ solar panels, as do 190 private households. Five biogas digesters, nine windmills, three hydroelectric projects,  ecological flood control and a natural waste water treatment system were part of the plan for energy independence. It all has worked well, and the town is debt-free. They actually formed several local companies to construct, install and manage their wind turbines, with local residents as investors.

Bushehr online after 36 years of construction.
Iran’s Bushehr nuclear power plant has been connected to the national grid. It began supplying around 60 MW of its 1000 MW capacity on Saturday 3 September at 11:29pm, the Atomic Energy Organization of Iran (AEOI) said. Construction on Bushehr by German company Siemens KWU started in 1975, but the work was stopped in 1979. Iran signed a deal with Russia in 1995, under which the plant was originally due to be finished in 1999, but the completion of the project was repeatedly delayed. The most recent delay, in February 2011, was caused by the discovery of damaged internals of a coolant pump supplied in the 1970s. To avoid potential consequences of metal debris getting on the fuel assemblies, they were unloaded and washed, while the reactor pressure vessel was cleaned. The fuel was reloaded in April and the plant achieved criticality in May 2011. In August 2011, the Government of Iran invited an International Atomic Energy Agency delegation to visit the country’s nuclear facilities, including nuclear power plant that has been built by Russia’s Atomstroyexport. According to Iran's nuclear officials, Bushehr power plant will reach 40% capacity during a ceremony that will be held on 12 September 2011. It is expected to reach full capacity in November or December 2011.

North Anna shut down after earthquake.
The largest earthquake to hit the eastern US in 67 years has raised concerns about the safety of the country's nuclear power plants. The 5.8 magnitude quake's epicenter in Virginia on August 23, was close to the North Anna plant, 130 kilometers southwest of Washington. The plant lost power and automatically halted operations after the quake. While the operator reported no 'major' damage to the facility, three diesel generators were required to kick in and keep the reactors' radioactive cores cool. A fourth diesel unit failed. While nuclear power plants can operate safely on back-up power, failure of generators was a key reason for the disaster at Japan's Fukushima Daiichi plant

A spokesman for the operator said the plant was designed to withstand an earthquake of up to 6.2 in magnitude. But some groups have expressed concern about the narrow margin between the design metrics and the quake's size. 'It was uncomfortably close to design basis,' said Edwin Lyman of the Union of Concerned Scientists, which has pushed for stronger nuclear regulations. 'If Fukushima wasn't a wake-up call, this really needs to be to get the NRC and industry moving to do seismic reviews of all the nuclear power plants in the country.' An article in the Washington Post reports that the earthquake moved dry casks (huge concrete containers holding spent nuclear fuel), weighing between 100 to 115 tons, by as much as four inches (10 centimeters).

Twelve other nuclear plants along the Eastern Seaboard declared an "unusual event" following the quake, the lowest of the NRC's emergency classification ratings. North Anna's "alert" status is one step further up on a four-step U.S. emergency scale.

North Anna's reactors are among 27 east of the Rockies that the NRC highlighted during a seismic review last year as presenting a potential hazard, due to the amount of ground-shaking they were designed to withstand. Many nuclear experts say plants in the United States were designed with big margins of error  built in, but last year's NRC survey found that the risks posed by earthquakes were higher than  previously thought.

Germany: no need for nuclear reserve capacity.
Germany's grid regulator Bundesnetzagentur (BNetzA) said August 31 that it has decided against keeping one idled nuclear reactor on standby as reserve capacity for the coming two winter seasons to ensure power grid stability after the government permanently closed eight older reactors in the wake of the Fukushima disaster in March. "Our investigations have shown that even in exceptional contingencies the transmission system will remain operational without the dispatch of a reserve nuclear power plant," BNetzA President Matthias Kurth said in a statement.

The government has asked the grid regulator to investigate the need for a nuclear reserve capacity during the winter after transmission system operators in May warned of possible blackouts during extreme winter weather should the eight older reactors remain shut permanently, removing at least 5,000 MW of nuclear capacity from the market.

International blockade Olkiluoto, Finland.
On August 20, 2011 a blockade of the Olkiluoto nuclear power plant under construction took place for the second time gathering people from several regions of Finland and from other European countries on the streets. One year ago, on August 28, 2010, it was the very first public street blockade of an atomic facility in Finland ever. It had been started with the support of a number of European and Finnish environmental and anti-nuclear groups. The gathering of the Nuclear Heritage Network, an international network of anti-nuclear activists, taking part in March 2010 in Helsinki had initiated the idea of the blockade and developed it together with the variety of Finnish NGOs and groups. The goal was to question the international reputation of Finland as the country of the so-called "renaissance of nuclear power", and to show that even in this country being under strong pressure of the nuclear lobby atomic power has noch support of the citizens.

For Finnish anti-nuclear activists the Olkiluoto Blockade was also an important occassion for meeting each other and exchanging as so far there doesn't exist any other nationwide organizing structures for a common anti-nuclear strategy. In the south as well as in the north strong networks of local initiatives and organizations exist and in some cases they successfully opposed to projects of uranium mining and new nuclear reactors constructions. However, cross connections between those groups and networks are created so far only in mutual big actions like the Olkiluoto Blockade or the anti-nuclear infotour around the Baltic Sea that also took place in 2010.

This year a blockade of about 100 activists from Finland, Sweden, Germany, Russia, France, United Kingdom and Belarus several times stopped the traffic on the access roads to the disputed Olkiluoto nuclear power plant in Finland. Police had announced to prevent the blockade of roads that were supposed to take place for the second time. They forced protesters from the streets again and again towards a bus stop nearby. Nevertheless, the activists succeeded several times to blockade the main access road to the nuclear power plant for some minutes, while an additional access street had been closed for some two hours by a wooden tripod construction with an activist on the top.

Donors agree to fund new Chernobyl shelter.
There appears to be enough money (at last after almost 15 years) for a new sarcophagus at the Chernobyl reactor in Ukraine. The Nuclear Safety Account and the Chernobyl Shelter Fund donors agreed to provide the necessary financial resources for the implementation of the Chernobyl projects. The decision was made at the Assembly of Contributors to the Chernobyl Shelter Fund meeting on July 7, 2011, in London. The new construction will help "neutralize any possible future threats to the environment from the Chernobyl nuclear plant in Ukraine".

The needed amount of financial resources for the Shelter Implementation Plan (SIP) funding is EUR 740 mln. On the 25th anniversary of the Chernobyl tragedy on April 26, 2011, a fundraiser was held resulting in donors' obligations of EUR 550 mln. The new decision of the world donors allows for the immediate start of the SIP execution and its completion by 2015. The SIP involves stabilization of the existing sarcophagus and the construction of a New Safe Confinement (NSC) for the damaged nuclear reactor.

In 1988 local scientists announced that the life time of the sarcophagus was 20 to 30 years. The Chernobyl Shelter Fund (CSF) was established nearly a decade later in December of 1997 to collect funds for the NSC project. Currently, the European Union, the United States, and Ukraine cooperate to help meet the CSF's objective while the EBRD is entrusted to manage the CSF and provide oversight of the funds disbursement.

The construction of the original Chernobyl sarcophagus began on May 20, 1986 - three weeks after the accident, and lasted for 206 days.

PSC shifts risks costs overruns to public.
US: Georgia utility regulators agreed on August 2, to scrap a proposal that would have eaten into Georgia Power’s profits should the costs for its nuclear expansion project exceed US$300 million. The Georgia Public Service Commission unanimously approved the plan after making sure the commissioners could review previously approved project costs if there is a budget increase. Customers would pay for cost overruns in their monthly bills unless the PSC determines the overruns are Georgia Power's fault.
Georgia Power is part of a group of utilities building two nuclear reactors at Plant Vogtle. The utility is responsible for US$6.1 billion of the estimated US$14 billion project. The company has been at odds with the PSC’s advocacy staff over how to handle potential cost overruns for the project. The advocacy staff wanted to cut into the utility’s profits if the costs exceeded US$300 million over budget. The advocacy staff agreed to drop its plan if Georgia Power allowed regulators to re-examine previously approved parts of the project if there is a budget increase. If regulators determine that Georgia Power's mistake led to the cost overruns, consumers would not have to pay the additional costs.
Consumer advocates have criticized the PSC's move as shifting all of the burden of the project's cost onto Georgia Power customers, who already are paying for the plant's financing costs.

Walk away from uranium mining.
Footprints for Peace, an international grassroots group that organizes walks, bike rides and runs around the world, invites families and people of all ages, background and cultures to come and support traditional owners in their opposition to uranium mining in Western Australia by taking part in the “Walk away from uranium mining” that began in Wiluna on August 19 and will finish in Perth on October 28. "We will demonstrate that we have the choice to walk away from this costly, toxic industry — which produces radioactive waste and weapons usable material — in favour of renewable energy options." Footprints for Peace are working together with the Western Australian Nuclear Free Alliance (WANFA) to organise this grassroots awareness-raising and action-based campaign. Everyone is welcome to join the walk for a few hours, a day, a few weeks or the whole way. Even if you cannot walk we still require financial assistance, drivers, kitchen crew members, media liaison volunteers, video operators and photographers, musicians, artists, singers and general support for daily events, such as camp set up and pack up, food shopping and water collection. The walkers will cover a distance of 20 to 25 kilometres a day, with a rest day every five days……… The walk’s conclusion in Perth will coincide with the Commonwealth Heads of Government Meeting. There we will deliver our well-supported and strong message that it is time to shut down the nuclear industry’s plans to expand in Western Australia and the rest of Australia.

Sellafield: No prosecutions for organ harvesting.
Recent correspondence has revealed that no one will be prosecuted over the body hacking scandal carried out by the nuclear industry for over 40 years in collusion with government, hospitals, coroners and doctors.

From 1960 to 1991, body parts were taken without consent from 64 former Sellafield workers and 12 workers from nuclear sites in Springfields, Capenhurst, Dounreay and Aldermaston. The liver was removed in all cases and one or both lungs in all but one incident. Vertebrae, sternum, ribs, lymph nodes, spleen, kidneys and fermur were also stripped in the majority of cases. Brains, tongues, hearts and testes were also taken on the advice of the medical officer at Sellafield.

Correspondence from Cumbria Constabulary has been seen which says that despite the findings of the Redfern Inquiry (into the scandal; see Nuclear Monitor 721, 17 December 2010)  that the relationship between the nuclear industry and fellow bodysnatching conspirators was "too close" no one will be prosecuted as it is not "in the public interest".

Extract from a letter sent by ‘Special Operations’ - Cumbria Constabulary: "the issues you raise which I have listed below;
1. That specific people and institutions have breached the Human Tissue Act and that this should be investigated.
2. That an investigation into whether there was any unlawful corruption of the coronial processes had taken place
3. The stipends made to mortuary attendants are also of particular concern.
This was a Government led review which involved both the Department for Energy and Climate Change and the Ministry of Justice. As such any requirement on the police to investigate identified breaches as outlined above would be made by the Government. No such request has been made". Floating Nuke Plant Seized in Bankruptcy
A St. Petersburg court seized the 70MW floating nuclear power station under construction at the Baltiisky Zavod shipyards after Rosenergoatom, the division of the Rosatom nuclear monopoly that commissioned it, demanded recognition of its right of ownership to the unfinished vessel. The July 26 court order gave the go-ahead for the seizure on the basis of "significant risk" that Rosenergoatom could lose its investment in the 9.8 billion ruble ($334 million) vessel if another claimant seized Baltiisky Zavod's assets during bankruptcy proceedings.

The ship yard, which is 88.3 percent owned by former Tuva governor Segei Pugachev's United Industrial Corporation is facing litigation from numerous disgruntled creditors. International Industrial Bank, also known as Mezhprombank, had its operating license revoked when it declared itself bankrupt in November. In January prosecutors launched a criminal case against the bank for intentional bankruptcy.

The dispute is not the first to hit Rosatom's ambitious plans to build a generation of floating nuclear power stations to serve remote coastal communities in Russia's north and Far East. Interfax on Thursday quoted an unidentified source at Rosatom saying the contract could be reassigned to another shipbuilder. If true, it would be the second time a contractor has lost the order from Rosatom, which originally commissioned the Sevmash shipyard to build the controversial floating nuclear plants in 2006. Rosenergoatom tore up that agreement in 2008 and signed a new deal with Baltiisky Zavod in 2009. Baltiisky Zavod is scheduled to finish the first station in 2012, according to the contract. The 70-megawatt plant is destined for Kamchatka.
