Berkeley Energia uranium mining project in Spain ‒ the EU's only new uranium mine?

Since early 2017, the mayor of Villavieja de Yeltes municipality in Salamanca, north-west Spain, has been instrumental in calling Australian-incorporated Berkeley Energia (formerly Berkeley Resources) to account and in calling local residents and people from neighbouring towns to monthly rallies against the company's proposed Retortillo uranium project.1

Retortillo is planned as an open-cast uranium mine, heap leaching and processing or 'milling' plant, said to be ready to begin production in late 2018 but lacking necessary permits and facing four public interest litigation suits from the municipality and from national non-governmental organisations.

The project has sparked a wave of opposition arising from concerns about potential impacts on the environment and local people. These risks include its location very near a school area, possible impacts on a protected ecological zone, and its permit to discharge waste-water five kilometres upstream of established drinking water extraction sites for Villavieja de Yeltes. The water discharge permit contradicts a European Commission-funded regional five-river biodiversity project because it has transboundary significance.2,3 Close to 40 municipalities are opposed to the company's plan to develop the Retortillo project, which has potential impacts on the existing economy including spa tourism facilities.

Berkeley has renamed itself, changed some of its personnel, reduced its website information, changed its AIM nominated adviser (the AIM is a sub-market of the London Stock Exchange), and negotiated a potential 'take-off' contract with a commodity trader, which has 'phoenixed' itself; that is, one small company was liquidated and replaced by another (InterAlloys to Curzon Resources) run by the same individual. This has allowed Berkeley to raise capital, because it has obtained the support of Euratom to develop the European Union's only open-cast uranium mine.

European Commission involvement will not help provide sufficient environmental information in a timely manner to assist public participation in decision-making.4 With the need for more transparency, the continued involvement of former Spanish state officials Cañete and Lamela creates at best unfavourable impressions.5 While the Commission in its 2012 report on former uranium mining sites in Spain, some of which are under reclamation, had been informative about applicable costs, methods and requirements for treating toxic waste, it did however raise questions about the relationships between Berkeley and state uranium mining agency ENUSA.6

Potential radiation impacts are being identified by the growing social movement, who argue that the EIA process omitted consideration of ore processing. It is clear that a number of human rights are being abused or put at risk including the right to information7, the right to health8, the right to livelihood and an adequate standard of living9, and the right to a safe and healthy natural environment.10

What the company says11

Berkeley Energia claims on its website to have developed 'a good neighbour and business partner relationship with the local community' and to have local and regional support and major community investment and environmental rehabilitation plans for the project area. The website makes no mention of community opposition, health risks from uranium or other potentially negative social or environmental impacts, apart from initial felling of trees.

Berkeley's 2017 Annual Report cites 'highly supportive' local municipalities and sizeable community investments to date, and commits Berkeley to improve the ecological and agricultural value of the area through a reforestation programme. There is no mention of environmental risks from, or public concerns about, uranium. The Annual Report notes in passing that 'various appeals' against the necessary licences have been unsuccessful. It is quoted on Mining.com as emphasizing the mine's job creation potential, adherence to 'the highest EU environmental and safety standards' and 'overwhelming support' from local and regional communities.

Berkeley is reported in the press as signing an agreement that 'will provide construction capital' with the Oman Sovereign Wealth Fund, an institution that has been evaluated as having a transparency rating of 4 out of 10.12

In 2016, Berkeley published a 'definitive feasibility study' on its website. As the International Atomic Energy Agency (IAEA) has stated, however, the best approach advised by the UN is to evaluate the full, clearly disaggregated costs of 'economic and social viability'.13 Berkeley has not done this.

Listing on the London Stock Exchange

Berkeley Energia announced on May 2 its intention to delist from AIM and instead list on the full London Stock Exchange14 and that it intends to seek investment only from institutions. It also said it plans to list on the Spanish Stock Exchange or bolsa.

In the UK, NGO London Mining Network wrote to the London Stock Exchange, a private company and regulator the Financial Conduct Authority, arguing that the listing should be frozen because of Berkeley's wrongful claims of strong community support and that challenges to its regional permits have failed.15 In Spain, the Stop Uranio campaign protested to the bolsa and financial regulator, which avoided decision-making in deference to the London Stock Exchange.

The UK agencies declined to respond, and decided to accord full listing to Berkeley. In Spain a corruption crisis has engulfed the ruling Partida Popular16 and the expected political upheaval is taking place with a new left coalition coming to power. The upheaval has contributed to the bolsa delaying Berkeley's listing17, ostensibly on the basis of the incompleteness of its prospectus.

Existing parliamentary moves18 to freeze the Retortillo project by congress committee members in Unido-Podemos, now the main coalition partner in the new PSOE government led by President Pedro Sanchez, may well have changed the mine's prospects. Also, the Ombudsman has declared that Berkeley failed to give information about its water discharge permit19, and again coalition partner Unido-Podemos is seeking to block the permit, demanding transparency. June in Spain will be a busy month!

Berkeley hopes to attract German and Polish institutional investors, and the UK exchange's lack of insistence on rigorous risk assessments may mean that the project's risks are hidden. The UK has inadequately implemented the post financial crash 2013 Directive 34/EU on company reporting, so most mining companies like Berkeley avoid necessary non-financial reporting. The prospects for the project depend on political20 and legal developments in Spain.

Spain: Garoña nuclear plant to be decommissioned

Santa María de Garoña is the oldest Spanish nuclear power plant, having begun commercial operation in 1971. It is located in the north of Burgos, very close to the Baske Country, and it is in the beginning of Ebro river, one of the most important Spanish rivers. The Garoña reactor is a 466 MW boiling water reactor, identical to reactor #1 at Fukushima-Daiichi. The nuclear plant is operated by NUCLENOR, which is owned by the main Spanish electricity enterprises ENDESA and IBERDROLA.

Garoña was stopped unilaterally by NUCLENOR in December 2012 to pressure the government for more favorable tax arrangements. This was a real advantage for the anti-nuclear side since it demonstrated that Garoña is not necessary at all. Since that date, a strong debate has ensued between the companies, the government, and anti-nuclear NGOs.

Garoña is affected by serious safety problems as described in reports by the Spanish regulator, the Consejo de Seguridad Nuclear (Nuclear Safety Council). In spite of this, this regulator issued a positive report in February 2017 for the continuation of Garoña. This was a scandal, but not new, since the regulator has been issuing positive reports since 2009 despite Garoña's safety problems.

The report issued in 2017 allowed for the continuation of Garoña provided a large number of refurbishments are performed. The cost of this work could be more than €300 million ... and it would still be an aging plant that could fail again at any time. Given these economic and technical uncertainties, IBERDROLA announced that it did not want to continue with Garoña, but ENDESA was in favour of restarting the reactor.

On top of that, Spanish society is demanding more transparency, more democracy and a fair distribution of benefits and risks. Therefore, social pressure increased and became political pressure: the Spanish Parliament voted for the closure of Garoña after the regional parliaments of Baske Country, La Rioja and Aragon called for its closure.

Finally, under the weight of all these social and political pressures, the Spanish government took the decision to definitively stop Garoña. Energy Minister Álvaro Nadal announced on August 1 that the government had decided not to approve the renewal of Garoña's operating licence after studying 17 opinions submitted by institutions, associations and companies involved in the process, including Ecologistas en Acción and the Iberian Antinuclear Movement, and also taking into account the government's energy and climate plans.

It is a clear victory for the anti-nuclear movement that brings energy and enthusiasm to the ongoing fight to end nuclear power in Spain, in Europe, and all over the world. Spain's seven operating power reactors all date from the 1980s and the operating licences of all seven reactors expire between June 2020 and November 2024.

Czech Republic – Dukovany and Temelín

German environmentalists have started a petition to demand their government to take action on faulty welding work in the first reactor of the Temelín nuclear power station in the south of the Czech Republic. Over 75,000 signatures will be handed over before summer to environment minister Hendricks. More information is posted at www.change.org/p/stop-temelin-investigate-dangerous-welding-seams

During the European Nuclear Energy Forum (ENEF) in Prague on 23 May, Czech Prime Minister Bohuslav Sobotka declared that he saw no other way for the country's energy mix other than nuclear power. He criticised attempts to diminish its role, hinting at criticism from neighbouring Austria and Germany about Czech plans to expand its nuclear fleet with new reactors in Dukovany and Temelín. He expected the environmental impact assessment for new capacity in Dukovany to be finalised in 2018.

Slovakia – Mochovce 3,4 and New Bohunice

The Slovak Prime Minister Robert Fico announced during the same ENEF meeting that Slovakia will finalise the Mochovce 3,4 project no matter what. According to Euractiv on 26 May, he said that Slovakia will always strive for the further development of nuclear energy: "Our government will never abandon this policy and will always fight for the right to choose the way for the production of energy in the future." The Slovak Industry Minister Peter Žiga said at the same event that although the plan for new reactors at the Jaslovské Bohunice site is technically prepared, current economic conditions are not favourable: "We are waiting for better times, when the prices of electricity at the wholesale market will be a bit higher."

In the run-up to this year's Chernobyl anniversary, Global2000, the Austrian member of Friends of the Earth, found elevated tritium levels near the Mochovce nuclear power station in Slovakia. In the Malé Kozmálovce reservoir they found 1347 Bq/l, around 13 times higher than the drinking water limit.

Hungary – Paks II

According to sources, the Convention on Nuclear Safety (CNS) 7th Review Conference discussed the recent law changes in Hungary that could infringe on the independence of the nuclear regulator HAEA. Also the European Commission continued communication with Hungary on the issue. A final result of its inquiry is expected in the coming months.

The Hungarian government appointed former Paks director and mayor of the city of Paks János Süli as a special minister without portfolio for the Paks II project. Rosatom opened a tender procedure for the turbine building and related accessories.

EnergiaKlub and Greenpeace filed a court appeal on 24 May against the approval of the environmental license for Paks II.

Finland – Olkiluoto 3, Hanhikivi

The owner of the Olkiluoto 3 project, TVO, announced it will drop its compensation claims in the international arbitration court against Areva. This in an attempt to ensure that the Olkiluoto 3 reactor will go into a test phase in the coming year.

The town of Helsinki decided to try to get out of Fennovoima, the company behind the Hanhikivi project. This will not be easy, though, because it is only is a minority shareholder in Vantaan Energia, the company over which it owns shares in Fennovoima.

Nuclear regulator STUK announced recently that it will not be able to process the Fennovoima documentation before the end of 2018. Finland is facing parliamentary elections in April 2018.

Russia – the floating reactors of the "Akademik Lomonosov"

Greenpeace Russia made an assessment of the nuclear regulatory oversight over the construction of a floating nuclear power station in the centre of St. Petersburg, 3.5 km from the Hermitage. It came to the conclusion that there is only one annual pre-announced inspection visit by the Russian nuclear regulator Rostechnadzor. It calls for the same regulatory oversight of the entire project, including construction and transport, as other Russian nuclear power stations. A proposal along those lines from the Yablokov fraction in the town's parliament environmental committee was approved on 1 June and has to be confirmed later this month in a plenary session.

Spain – Santa Maria de Garoña, Almarez

During a seminar in the European Parliament, Spanish and Portuguese Parliament members asked that attention be given to the upcoming life-time extension of the Almarez nuclear power plant in Spain, as well as for the plans to restart Santa Maria de Garoña. They demanded public participation before the final decisions for these life-time extensions.

The restart of Santa Maria de Garoña by regulator CNS been conditional on upgrade investments. While 50% owner Iberdrola already said it wanted to refrain from re-opening the reactor, Endesa, the owner of the other 50%, prefers to wait for the decision of the Ministry of Energy.

Initially, the submission period for a request for life-time extension of the Almarez nuclear reactor would run out on 7 June. However, the Ministry of Energy with the support of CNS changed the procedure so that it now still has two years to do so.

Belgium – Tihange and Doel

Preparations for a human chain from Tihange (Belgium), over Maastricht (Netherlands) to Aachen (Germany) on 25 June over 90 km are in full swing. The event is receiving support from German and Dutch municipalities most affected by the power station, as well as from a broad range of people from culture and media, including the annual Dutch PinkPop rock festival. Belarus – Astravets

During the European Nuclear Energy Forum, 22 May in Prague, Lithuanian vice-minister for the environment Martynas Norbutas heavily criticised the Astravets project, 20 km from the border with Lithuania. He explained among others that the site choice happened without being informed by an environmental impact assessment, and based on population densities in Belarus but excluding Lithuania.

The Lithuanian – Belarussian tensions are expected to influence the Meeting of Parties of the Espoo Convention that takes place June 13‒16 in the Belarussian capital Minsk.

Hungary – Paks II

The Hungarian nuclear regulator issued the site approval for the Paks II nuclear power plant. The preliminary approval of the environmental permit has been sent to some foreign participants in the EIA procedure (e.g. the organisation Calla in the Czech Republic and Terra Mileniul III in Romania) but only in Hungarian. The responsible authority claims no translation is required under Hungarian law. A court case from Hungarian NGOs, among others Energia Klub and Greenpeace Hungary, against the approval of the environmental permit is pending.

The Hungarian government passed law changes in December 2016, including the possibility for the government, the de facto operator of the Paks II project, which is run from the Prime Minister's office, to divert per decree from licensing conditions for the construction of new nuclear capacity and nuclear waste management. The European Commission is currently investigating this under the allegation of breach of the independence of the nuclear regulator as defined under the Euratom Nuclear Safety Directive. Also, the 7th Review Conference of the Convention on Nuclear Safety at the IAEA in Vienna is discussing the matter.

Finland – Hanhikivi

The Finnish nuclear regulator STUK is currently scrutinising the construction documentation for the Hanhikivi nuclear project of the Finnish-Russian conglomerate Fennovoima. STUK criticised Fennovoima, constructor Rosatom and sub-contractors for having too little capacity to deliver the necessary documentation.

Russia – the floating reactors of the "Akademik Lomonosov"

Rosatom is preparing to load two 35 MW power reactors on board the non-propelled barge "Akademik Lomonosov", which is moored at the Baltic Shipyard in the centre of St. Petersburg, 3.5 km from the Hermitage and 2.5 km from the St. Isaac Cathedral.

Greenpeace Russia, the Yablokov Party and Greenpeace Nordic are urging for a transboundary environmental impact assessment to be made before loading, testing and transport of the barge to its final destination in Chukotka. The transport will lead the barge through the exclusive economic zones and/or territorial waters of most countries around the Baltic Sea.

Slovakia – Mochovce 3,4

The shareholders of Slovenské elektrarne ‒ the Slovak state, Italian utility ENEL and the Czech energy holding EPH ‒ have officially increased the budget for the construction of Mochovce 3,4 with €800 million during their Annual General Meeting in late March 2017. Mochovce 3,4 consists of two Rosatom designed VVER440/213 reactors of the second generation that are not equipped with a secondary containment. The total budget is now €5.4 billion or €5620/kWe capacity, which is comparable to the construction costs of the French designed EPR reactors in Olkiluoto, Finland and Flamanville, France. It is unclear who has to finance these extra costs.

Spain – Santa Maria de Garoña

The Spanish government would like to have the EU's oldest nuclear reactor, the Fukushima type GE Mark 1 reactor at Santa Maria de Garoña, restarted. The reactor was shut down in 2015, when its operator Nuclenor (Endesa / ENEL and Iberdrola) did not see an economic future any longer after necessary upgrades. Political pressure on Nuclenor from the side of the Spanish conservative government has been mounting, however.

On the other side, resistance against a restart in the neighbouring Basque Country is growing. During a session of the Basque Parliament on 5 April 2017, legal steps, among others against the lack of public participation, environmental considerations and comparison with viable alternatives, were prepared with parliament-wide support.

Iberdrola has already made clear that it would rather not restart the aging reactor. Endesa and its owner ENEL have yet to react.

Belgium – Tihange and Doel

On 11 March, around 1,000 people demonstrated in Antwerp against the life-time extension of the Doel 1 and 2 and Tihange 1 reactors, for closure of the crack-ridden Doel 3 and Tihange 2 reactors, and phase-out of the remaining two reactors Doel 4 and Tihange 3 in 2025.

The lack of public participation and environmental impact assessment for the life-time extension of Doel 1,2 and Tihange 1 is currently pending before the Council of State as well as civil court on complaints from Greenpeace. The city of Aachen (Germany) and the State of North Rhine – Westphalia (Germany) have started legal proceedings in Belgium against the operation of Doel 3 and Tihange 2.

On 25 June, a human chain from Tihange to Aachen is to follow the protests from March 11.

Belarus – Astravetz

The government of Lithuania has stepped up its attempts to prevent the construction of the Belarussian-Russian Astravetz nuclear power station just 40 km from the Lithuanian capital Vilnius. Belarus has promised to submit the Astravetz project to a nuclear stress test under supervision of the European Commission and the European Nuclear Safety Regulators Group (ENSREG), in the framework of the European post-Fukushima nuclear stress tests. The watchdog group Nuclear Transparency Watch has asked the European Commission to also facilitate input from civil society in that exercise, as happened during the European stress tests and similar stress tests with European support in Taiwan.

Netherlands – Borssele

The Aarhus Convention Compliance Committee is receiving answers on its last question regarding the lack of proper public participation concerning environmental issues in the decisions leading to the 20-year life-time extension of the Borssele nuclear reactor in 2013. The Committee is expected to finalise its findings in April and submit them to the Meeting of Parties of the Aarhus Convention in September.

In the meantime, the owner of Borssele, EPZ, has sold its grid distribution and water businesses for €900 million. It now has to decide whether this one-off income will be used to operate Borssele with a loss until possibly improved electricity prices might turn a profit in the early 2020s, or to use it to close down the aging reactor.

Decommissioning costs are budgeted at €500 million, but the decommissioning fund currently faces a shortage of over €200 million.

The largest two parties coming out of the Dutch parliamentarian elections in March 2017, VVD and PVV, want to continue operation of Borssele. Potential government candidates D66 and GroenLinks want it closed. The other negotiating party, the christian-democrat CDA, did not mention Borssele in its election programme, whereas another potential government coalition candidate, the Christian Union (CU), would like to see closure.

Czech Republic – Dukovany and Temelín

The Dukovany nuclear power station is gradually receiving permission for 20 years' life-time extension. Austrian NGOs including among others Global2000, ÖkoBüro Wien and the ÖkoInstitut in Vienna have started procedures under the Espoo and Aarhus Conventions against the lack of transboundary EIA with public participation.

A conference of anti-nuclear groups in Germany and the Czech Republic in Munich in March 2017 continued investigations into alleged problems during primary circuit welding work in the Temelín unit 1 in 1993. Greens Fichtelgebirge organiser Brigitte Artmann announced the next steps to allow access for German experts to vital documentation and stated: "As long as we are alive and this issue has not been resolved, it is not closed."

UK – Hinkley Point C, Wylfa and Moorside

The Espoo Convention Implementation Committee found the UK in non-compliance with the Espoo Convention for not notifying other countries of its intention to build the Hinkley Point C nuclear reactors. The UK reacted with a notification to all Espoo Convention parties, and currently, at least the Netherlands, Norway and Germany asked for a transboundary EIA.

The Netherlands and Austria also informed WISE they had been notified by the UK of the intention to build new nuclear capacity at Wylfa in Wales and are awaiting the start of a transboundary EIA procedure. With this, legal complaints from the Friends of the Irish Environment, An Taisce (the Irish Trust), the German member of the Bundestag Greens Sylvia Kötting-Uhl and German citizen Brigitte Artmann, have been successful. The Espoo Implementation Committee even went a step further by calling on the UK to halt construction work at Hinkley Point C until the transboundary EIA has been finalised. Construction work at Hinkley Point has, however, continued with the pouring of the first safety-relevant concrete.

Finland – Olkiluoto 1,2

The aging reactors 1 and 2 at Olkiluoto have received a life-time extension without public participation or an EIA during the decision-making procedures. NGOs are considering legal options.

Espoo Convention – Meeting of Parties

During the Espoo Convention Meeting of Parties 13‒16 May 2017 in Minsk, Belarus, nuclear issues will receive prominent attention. Lithuania and Belarus are involved in an ingrained battle over the quality of the Astravetz EIA (see above). The NGO CEE Bankwatch is organising a side-event to highlight the lack of environmental impact assessment before decisions on life-time extension of nuclear projects in Ukraine, Netherlands, Belgium, Spain, Czech Republic and elsewhere. A special commission is to come with best practices around nuclear decisions, though draft documents do not address life-time extensions.

On June 11, more than 1,500 people, summoned by more than 45 organizations, participated in a demonstration for the closure of the Almaraz nuclear power plant in the town of Cáceres, in the south-west of Spain, close to Portugal. The participant groups were from both Portugal and Spain and included social, environmental and political organizations.

The call came from the recently created Movimiento Ibérico Antinuclear (Iberian Antinuclear Movement), aiming to join the efforts of Spanish and Portuguese activists in order to stop the Spanish nuclear power plants, which can affect the two countries, and to stop uranium mining projects close to the common border.

The demonstration was festive and colorful and included dancing, music, theatre, flash mobs, and other activities. The day culminated in a protest march.

The goal of the demonstration was to call for the closure of Almaraz when its present operating licence ends in 2020. We also called for the definitive closure of Garoña nuclear plant, which has been shut down since December 2012 and is the oldest of the Spanish nuclear plants, and for the closure of all the Spanish nuclear power plants when their current operating licences end. This means that the last plant would close in 2024.

Almaraz is composed of two PWR reactors with a total capacity of about 2,100 MW, with cooling water from the Arrocampo dam, in the Tajo river. The first reactor started in 1981 and the second in 1983, so they are 35 and 33 years old. Almaraz reactors have a long story of incidents, including two leakages of radioactive water and the corrosion of their six steam generators, which had to be changed in the 1990s. The new steam generators are supposed to be corrosion-proof, but the first symptoms of corrosion have been already detected. Almaraz has had several emissions of excessively hot water that have caused the death of a lot of fish, decreasing the quality of the river water.

The most recent and serious incident is related to the pumps of the essential services water (ESW). The ESW system is a basic element for the safe operation of the nuclear power plant. Among other important functions, the system guarantees that the reactor cooling works properly, since the primary circuit pumps are cooled by the ESW.

The plant has four identical ESW pumps that take water from the Arrocampo dam, plus a spare one. A common problem was detected in the five pumps: a piece that avoids the oil scape can break causing the pumps stop working. Two pumps failed in September 2015 and January 2016. Instead of stopping the plant, the operators decided to continue with the reactors operating at the highest power level and to repair the ESW pumps one by one, without stopping. This option was based on the report presented by Areva, after the scandal of the fake safety protocols and was approved by the Spanish regulator, the Consejo de Seguridad Nuclear (CSN, Nuclear Safety Council).

On top of that, the CSN did not force the operator to repair the floodgates of the reactors, which are not able to protect the cores of the two reactors in case of a dam break. The owners of Almaraz want to keep the plant working since it generates revenue of more than €1 million per day in the Spanish electricity market that favors the NPPs.

All these events have worried Portuguese citizens and politicians, since an accident in Almaraz would affect that country: radioactive isotopes can travel by the air and by the Tajo river. The Portuguese Parliament voted unanimously for the closure of Almaraz, as well as the Lisbon City Council.

After Garoña, Almaraz is the oldest one in Spain. In 2020, a decision will be taken on how long the plant should operate. There has been a political debate on how long nuclear plants can operate. The conservative People's Party wants to extend the lifespan to up to 60 years, but the Spanish Socialist Workers' Party wants to restrict the reactors to a 40-year lifespan. The position of the Citizens Party (Ciudadanos) is not clear, but they are not against nuclear power and probably have a similar position to the People's Party.

The Movimiento Ibérico Antinuclear argues against any lifespan extensions. This would result in the closure of Almaraz I and II in 2020 and the closure of the last nuclear plant in Spain in 2024. Unidos Podemos ‒ a left-wing electoral alliance ‒ supports this proposal. The results of the recent Spanish election make it difficult to promptly close the nuclear plants: the People's Party increased its parliamentary representation while the Workers' Party and Unidos Podemos did not do as well.

Nevertheless, we, the Iberian antinuclear activists, will continue trying to convince people and politicians that keeping the nuclear plants operating is a dangerous mistake.

Spain: We are all the Cofrentes 17

Seventeen people face trial in Spain on charges of public disorder, damage and injury. The punishment being demanded is nearly three years in prison. In addition, Greenpeace may have to pay a fine of 360,000 euros. Why? Because on February 15, 2011, 16 Greenpeace activists and a freelance photojournalist entered Spain's Cofrentes nuclear power plant, climbed one of the cooling towers and painted "Nuclear Danger" on it. Greenpeace's protests are peaceful actions. Is punishing the painting of a cooling tower with jail fair and proportionate? Defending the environment should not carry a cost that is higher than for destroying it.

In a time when peaceful protest is being questioned, Greenpeace points to Article 45 of Spain's constitution that establishes the right of everyone to "enjoy an environment suitable for the development of the individual as well as the duty to preserve it ". That is what Greenpeace does and it is a right our people exercised on February 15, 2011. So we have launched a campaign: COFRENTES MISSION: ARTICLE 45. Because when you have exhausted all other avenues, all you have left is peaceful protest. Three years ago we expected this trial to be held on 4 December, 2014. Today [November 19] we begin a campaign that will last 17 days. During these days we will be proposing 17 missions to make bring attention to the injustice the Cofrentes 17 are facing.

Australia: Kakadu Traditional Owner just wants a house on his country

Jeffrey Lee spoke powerfully about his work to protect Koongarra from mining at the closing plenary of the International Union for the Conservation of Nature (IUCN) World Parks Congress in Sydney, Australia on November 18. Kakadu, in the tropical Top End of the Northern Territory, is Australia's largest National Park and is dual World Heritage listed for both its natural and cultural values. Encompassing tropical wetlands, extensive savannah and soaring sandstone escarpments and waterfalls this region has been sculptured and shaped by people and nature for many tens of thousands of years. Jeffrey Lee, the Senior Traditional Owner of the Djok clan in Kakadu fought for many years to see his country at Koongarra protected from the threat of uranium mining. In 2011 he made the long journey from Kakadu to Paris to see the World Heritage Committee include Koongarra in the World Heritage estate and in 2013 the area was formally included within Kakadu National Park and permanently protected from uranium mining. [Areva is understood to be planning legal action against the Australian government over its 2013 decision to veto mining at Koongarra.]

For decades Jeffrey was pressured to allow uranium mining on his land at Koongarra and for decades he resisted – refusing millions of dollars in promised mining payments. Now he is seeking something. After generously allowing his land to be included in Kakadu National Park Jeffrey has a modest ask of the Australian Government in return: please build a house on his country. Jeffrey spoke to thousands of delegates at the closing plenary of the World Parks Congress in Sydney and told the story of his long fight to protect Koongarra. He concluded by calling on the Australian Government to come good on their promise to build him a house on his country. "I have said no to uranium mining at Koongarra because I believe that the land and my cultural beliefs are more important than mining and money. Money comes and goes, but the land is always here, it always stays if we look after it and it will look after us," he said. "While I'm down here at this Congress, I want to tell people about Koongarra and remind the Government that I did all that work to protect that country. All I'm asking is for a place to live on my country. I don't want to wait until I've passed away, I want to live on my county now. "I don't want the Government to forget me, they came to visit me, they congratulated me on my hard work and said they will support me in this. The Government knows how hard I worked, they gave me an Order of Australia and I'm happy for that. Now I just want a commitment from them for a house so I can live on that country that I fought for."

Environmental Justice Organisations, Liabilities and Trade reports

Environmental Justice Organisations, Liabilities and Trade (EJOLT), a collaboration between 23 universities and civil society organisations, published two significant reports on nuclear and uranium issues in November.

'Expanded nuclear power capacity in Europe, impact of uranium mining and alternatives' tackles the myths that nuclear energy is clean, reliable, cheap and climate friendly. In reality, nuclear energy capacity in Eastern Europe is characterised by hidden externalised costs, technical problems and covered-up dangers. At the same time, alternative options for energy production and measures for managing energy demand already exist. The report focuses on Bulgaria and Slovenia, where the full range of issues with nuclear energy are exposed: from zombie mines to badly managed radioactive waste. Slovenia plans one new nuclear power plant and prolongs one other, while Bulgaria is planning two new nuclear power plants. The report concludes that projected Bulgarian and Slovenian energy demand is deliberately exaggerated by competent authorities, while nuclear costs are underestimated. This is despite the existence of an economically justifiable potential for renewable energy solutions, at lower cost per kWh.

'Uranium mining. Unveiling the impacts of the nuclear industry' argues that the EU should improve legislation and practices to limit the environmental and health impacts of uranium mining. Lead author Bruno Chareyron states: "Uranium mining is increasing the amount of radioactive substances in the biosphere and produces hundreds of millions of tonnes of long lived radioactive waste. The companies have no solutions for the confinement of this waste and for the appropriate management of contaminated water flowing from the mine sites, even decades after mine closure." The cost of remediation should be properly estimated and paid by the mining companies. Field studies done for this report reveal how zombie mines keep affecting the lives of thousands, even decades after the mines are closed.

The report draws from on-site studies performed in Bulgaria, Brazil, Namibia and Malawi in the course of the EJOLT project and from previous studies in France and Africa over the past 20 years. It gives examples of the various impacts of uranium mining and milling activities on the environment (air, soil, water) and provides recommendations to limit these impacts.

UK reactor plans face obstacles

Plans to build two giant nuclear reactors in south-west England are being reviewed as French energy companies now seek financial backing from China and Saudi Arabia − while the British government considers whether it has offered vast subsidies for a white elephant. A long-delayed final decision on whether the French electricity utility company EDF will build two 1.6 gigawatt European Pressurised water Reactors at Hinkley Point in Somerset − in what would be the biggest construction project in Europe − was due in the new year, but is likely to drift again. Construction estimates have already escalated to £25 billion (US$39.3b, €31.5b), which is £9 billion more than a year ago, and four times the cost of putting on the London Olympics last year. Two prototypes being built in Olikuoto, Finland, and Flamanville, France, were long ago expected to be finished and operational, but are years late and costs continue to escalate. Until at least one of these is shown to work as designed, it would seem a gamble to start building more, but neither of them is expected to produce power until 2017.

British experts, politicians and businessmen have begun to doubt that the new nuclear stations are a viable proposition. Steve Thomas, professor of energy policy at the University of Greenwich, London, said: "The project is at very serious risk of collapse at the moment. Only four of those reactors have ever been ordered. Two of them are in Europe, and both of those are about three times over budget. One is about five or six years late and the other is nine years late. Two more are in China and are doing a bit better, but are also running late." Tom Greatrex, the British Labour party opposition's energy spokesman, called on the National Audit Office to investigate whether the nuclear reactors were value for money for British consumers. Peter Atherton, of financial experts Liberum Capital, believes the enormous cost and appalling track record in the nuclear industry of doing things on time mean that ministers should scrap the Hinkley plans. Billionaire businessman Jim Ratcliffe, who wants to invest £640 million in shale gas extraction in the UK, said that the subsidy that the British government would pay for nuclear electricity is "outrageous". Finding the vast sums of capital needed to finance the project is proving a problem. Both EDF and its French partner company, Areva, which designed the European Pressurised water Reactor (EPR), have money troubles. In November, Areva suspended future profit predictions and shares fell by 20%.

Chinese power companies have offered to back the project, but want many of the jobs to go to supply companies back home − something the French are alarmed about because they need to support their own ailing nuclear industry. Saudi Arabia is offering to help too, but this may not go down well in Britain. On the surface, all is well. Preparation of the site is already under way on the south-west coast of England, with millions being spent on earthworks and new roads. ... But leaks from civil servants in Whitehall suggest that the government may be getting cold feet about its open-ended guarantees. ... The Treasury is having a review because of fears that, once this project begins, so much money will have been invested that the government will have to bail it out with billions more of taxpayers' money to finish it − or write off huge sums.

Belgium: Fire takes another reactor offline

Electrabel closed the Tihange 3 power reactor on November 30 after an electrical fire, leaving only three of the Belgian firm's seven nuclear plants in action. Several electrical cables outside the reactor caught fire. Electrabel operates seven nuclear reactors − four in Doel and three in Tihange − producing about half of Belgium's electricity demand.Doel 3 and Tihange 2 were off-line for almost a year in 2012−13, due to the discovery of thousands of cracks in the reactors' steel containment vessels, and they were shut down again in March 2014. Sabotage on August 5 by an unidentified staff member damaged the steam turbine of Doel 4, causing its automatic shut down.2

Uranium mine sludge discharge permit threatens Lake Malawi

Paladin Africa Ltd, which mines uranium ore in Malawi's northern district of Karonga, has come under fire from a coalition of Malawian civil society groups and chiefs over its proposal to discharge mining sludge into the Sere and North Rukuru rivers. The toxic substances that would flow from the tailings pond at the Kayelekera Uranium Mine into Lake Malawi 50 kms downstream include waste uranium rock, acids, arsenic and other chemicals used in processing the uranium ore, the coalition fears. A statement issued by the Natural Resources Justice Network (NRJN), a coalition of 33 civil society organisations active in the extractive industry sector, expressed grave concerns about a recommendation by the National Water Development and Management Technical Committee in the Ministry of Agriculture that the minister issue a discharge permit to Paladin Africa.

Officials from Paladin Africa at a November 4 meeting told participants, according to NRJN members present, "Paladin fears that if the water from the tailings dam is not released into Rukuru River then there is a high risk that the contaminated water from the dam would overflow as a result of the impending rains." The NRJN says it is "shocking and inhumane" for Paladin to put the lives of millions of Malawians at risk as a result of the company's failure to plan properly. "We therefore ask Paladin to build a second tailings dam as was the initial plan and consequently refrain from this malicious practice of discharging radioactive effluents into the river systems, which would subject lives of innocent Malawians to a series of acute and chronic health effects," the NRJN said in its statement. The coalition is calling for an independent team of chemists to conduct studies of the lake to ascertain whether effluents proposed for discharge from the mine are indeed safe. Paladin Africa issued a statement in February that due to the sustained low uranium price, processing would cease at Kayelekera and that the site would be placed on care and maintenance. Following a period of reagent run-down, processing was completed in early May.

USA: Mismanagement at nuclear weapons bases

Problems at nuclear weapons bases continue to attract widespread media commentary. Typical of this is a BloombergView editorial which states: "The shenanigans that have been going on at U.S. nuclear bases are almost too clownish to believe: officers running a drug ring across six facilities, widespread cheating on monthly proficiency tests, blast doors on missile silos too rusty to properly seal, six nuclear-armed missiles accidentally loaded onto a plane that then flew across the country, and a curious story of crews at three bases FedExing one another an apparently magical wrench used to connect warheads to intercontinental ballistic missiles."

Spain: Garoña plant closer to definitive end?
The nuclear power plant of Garoña (Burgos), the oldest of the Spanish nuclear plants, is a hostage of its owner Enterprise Nuclenor (itself owned by the large enterprises ENDESA and Iberdrola). Garoña, whose reactor is identical to Fukushima Daiichi reactor #1, has been used by the Spanish nuclear lobby to press on the Government.

The first part of this struggle, until December 2012, was public and Nuclenor used Garoña to try to stop the new Law on Fiscal Measures that introduced a tax on the spent fuel of Spanish nuclear power plants. The amount of this tax could be of the order of 1.6 euro-cents per kWh. As it was ordered by the European Commission, the tax was not modified and therefore Nuclenor decided to stop the plant and to put all the uranium into the spent fuel pool on 28 December 2012. So Garoña is now stopped with all the fuel in the pool.

The second part of the argument has been hidden and the citizens have had no information on the discussions. We know that the Industry Minister is preparing a new law covering the electricity sector but we do not know if any of the proposals of the large Spanish electrical enterprises will be taken into account. It is clear, nevertheless, that something has happened since Nuclenor surprisingly asked the Minister to keep Garoña 'frozen' for one more year, thus allowing for the possibility of restarting the plant.

This happened on May 24, only one month and ten days before the definitive closure of Garoña. Minister Soria decided to pass the request directly to the Spanish Regulator, the Consejo de Seguridad Nuclear (CSN). The CSN was heavily pressured by the nuclear lobby and approved an extension of Garoña's licence for one year. Three CSN members voted for the extension, two voted against.

This has damaged CSN's reputation, since it appears as a puppet that is able to approve a request in a very short time under pressure from the nuclear enterprises. Moreover, the CSN gave a new type of authorisation to keep the plant in its present status, with the fuel in the pool, but without starting the decommissioning.

The main spokespeople from Iberdrola, ENDESA and Unesa have been making public declarations that Garoña cannot stop or the investments of these enterprises will move from Spain to other countries like the US if they are not guaranteed by the new law under preparation. The CSN appears ready to accept the schedule imposed by the nuclear lobby.

Once the CSN has given its permission, the Government has only to issue an Order that allows Nuclenor to ask for the prolongation of the life of Garoña. This should have been published before June 6, that is the last day to start studying the documents issued by the CSN to proceed to the definitive stop of Garoña. Strange things happened again, since the Government did not publish such an order! So the CSN sent the documents related to the closure of the plant. Only a very strange and scandalous legal manoeuvre by the Government could avoid the definitive closure of Garoña.

We have a strange contradictory feeling now. On one hand, we are happy since we are closer to the end of this dangerous nuclear plant. On the other hand we have seen how the nuclear lobby is able to modify Government decisions and to press strongly on the regulator. Meanwhile, the public has been excluded from the debate. We would like to start thinking of future development of the area without Garoña.

UNSCEAR Fukushima propaganda
Since the last issue of the Monitor, the United Nations Scientific Committee on the Effect of Atomic Radiation (UNSCEAR) has published a media release, based on an as-yet unpublished report, trivialising the long-term cancer death toll from the Fukushima nuclear disaster. UNSCEAR states in its May 31 media release that: "It is unlikely to be able to attribute any health effects in the future among the general public and the vast majority of workers."

That tells us nothing we didn't already know: epidemiological studies are unlikely to produce statistically-significant results given the high incidence of cancers in the general population. As discussed in Nuclear Monitor #758 (15 March 2013, available at wiseinternational.org), early estimates of the long-term cancer death toll range from 130 to 3,000.

The media release says that actions taken to protect the public (evacuation and sheltering) significantly reduced radiation exposures. Wolfgang Weiss from UNSCEAR said: "These measures reduced the potential exposure by up to a factor of 10. If that had not been the case, we might have seen the cancer rates rising and other health problems emerging over the next several decades." Weiss's statement falsely implies that cancer rates will not rise due to Fukushima fallout.

Carl-Magnus Larsson, chair of UNSCEAR, said: "Families are suffering, and people have been uprooted and are concerned about their livelihoods and futures, the health of their children ... it is these issues that will be the long-lasting fallout of the accident." Again, the implication seems to be that radiation exposure is not an issue. Larsson's statement is also an invitation to nuclear apologists and propagandists to trot out tired old lies about how the problem is not radiation itself but fear of radiation. Responding to the UNSCEAR media release, a World Nuclear News item was titled: 'Fear and Stress Outweigh Fukushima Radiation Risk'.

The UNSCEAR media release has still more to offer nuclear apologists and propagandists, noting that additional exposures received by most Japanese people from Fukushima fallout are less than the doses received from natural background radiation. That is certainly true, but UNSCEAR should note that radiation doses below background levels can cause cancer. A 2010 UNSCEAR report states that "even at low doses of radiation it is likely that there is a very small but non-zero chance of the production of DNA mutations that increase the risk of cancer developing. Thus, the current balance of available evidence tends to favour a non-threshold response for the mutational component of radiation-associated cancer induction at low doses and low dose rates."

USA: San Onofre reactors permanently shut down
Both reactors at the San Onofre nuclear power plant in California are being retired after a long battle. "We have concluded that the continuing uncertainty about when or if San Onofre might return to service was not good for our customers, our investors or the need to plan for our region's long-term electricity needs," said Ted Craver from Edison International - the parent company of San Onofre owners Southern California Edison (SCE).

In January 2012, a fault in one of two new steam generators installed as part of an uprate program of reactor #3 resulted in an automatic shut down when radioactive material was detected coming from a worn tube in the steam generator. Reactor #2 was kept off-line after a maintenance outage because it shares the same steam generator design and also suffered from tube wear and vibration issues to a lesser degree.

A review process by the Nuclear Regulatory Commission, incomplete after eight months, will presumably be discontinued in light of the decision by Edison / SCE. The two reactors have licences to operate until 2022.

A well-organised local, state and national campaign fought against the restart of the reactors. Erich Pica, president of Friends of the Earth US, said: "This is very good news for the people of Southern California. We have long said that these reactors are too dangerous to operate and now Edison has agreed. The people of California now have the opportunity to move away from the failed promise of dirty and dangerous nuclear power and replace it with the safe and clean energy provided by the sun and the wind."

The two reactors — situated along the Pacific Coast in the densely populated corridor between San Diego and Los Angeles — are the largest to shut down permanently in the US in the past 50 years. San Onofre's two reactors are the third and fourth reactors to be retired so far this year in the US − Dominion shut its reactor in Wisconsin in May because of unfavourable economics, and Duke said in February that it would not restart Crystal River 3 because mechanical problems were too expensive to fix.

In other shut-downs over the years, the Shoreham plant in New York was completed in 1984 for US$6 billion but never opened because of community opposition. Decaying generator tubes helped push San Onofre's original reactor into retirement in 1992, even though it was designed to run until 2004. In 1993, the Trojan plant in Oregon was closed years earlier than planned because of cracks in steam tubes.

The 2008 National Radioactive Waste Disposal Institute Act provides for the establishment of a National Radioactive Waste Disposal Institute which will manage radioactive waste disposal in South Africa. The responsibility for nuclear waste disposal has been discharged by the Nuclear Energy Corporation (Necsa) until now.  Necsa has been operating the national repository for low- and intermediate-level wastes at Vaalputs in the Northern Cape province. This was commissioned in 1986 for wastes from Koeberg and is financed by fees paid by Eskom. Some low- and intermediate-level waste from hospitals, industry and Necsa itself is disposed of at Necsa's Pelindaba site.(*01)

Koeberg spent fuel is currently stored in pools as well as in casks. The site has enough storage capacity for the spent fuel that will be generated during the current operational lifetime of Koeberg.

Pending the outcome of current investigations into possible reprocessing of spent fuel, it is not classified as radioactive waste. Rather than been in its final form for disposal used fuel is. Interim storage takes place on site, awaiting investigations into the best long term option for the management of spent fuel.(*02) If chosen as a preferred option in South Africa, geological disposal of radioactive waste shall take place with an option for retrieving the waste.(*03)

Plans by Eskom to seek contracts for reprocessing surfaced in August 2009. The stae owned utility and operator of Koeberg said the resulting MOX-fuel could be sold to other countries rather than used at home. It turned out to be a plan to try to finance new build.(*04) Not surprisingly it was never heard of again.

According to Nesca CEO Rob Adams South Africa would need a fully operational high-level waste management site by 2070 to deal with spent fuel. The negotiations with the National Nuclear Regulator to identify a high-level waste disposal site would likely start before 2015. Three possible disposal sites would have to be identified, and three individual environmental impact assessment studies would have to be conducted. Necsa would then argue the case of the most suitable site. Vaalputs will most likely be one of them.(*05)

No reprocessing of spent fuel takes place, but in the past spent fuel of Vandellos-1 reactor has been reprocessed.

Low-level Waste
In the 1950s, the El Cabril uranium mine was shut down and started to be used for storing low and intermediate level waste. In 1986 ENRESA took responsibility for El Cabril and moved the waste from the mines to new built buildings on the same site.(*01) It is planned to receive waste until 2015.(02) The state-owned radioactive Waste management organization ENRESA, created in 1984, is responsible for managing radioactive waste and decommissioning of nuclear plants.(*03)

High-level waste and spent fuel
ENRESA is since 1987 developing a disposal program aimed at providing a final solution for the spent fuel and high level waste. The program comprised of three areas: identification of suitable sites, conceptual design and performance assessment of a geological repository and research and development.(*04) At that time a repository was expected to be realized by 2020. By end-1990, some 25,000 km2 of possible regions were found. Finally, some 30 areas were identified for further research.(*05)

Although ENRESA had identified favorable areas for further underground research, work was halted in 1996 due to public opposition; or in the words of ENRESA: "the reaction of the public advised to discontinue any field work in 1996."(*06) In 1995, it had become known among environmental groups that ENRESA had plans for the construction of underground disposal laboraties and a list of possible locations was released. The groups accused ENRESA of not having informed the public and of having inspected possible sites. Large demonstrations were organized which culminated in a demonstration of 20,000 people in 1998 at Torrecampo.(*07)  At the end of 1996, the Senate Commission for Industry established an inquiry commission to develop a new waste policy. It had to study the difficulties in finding a site for waste disposal and should include socio-political and public acceptance aspects. The  commission’s work was expected to result in guidelines for the government to develop a legal framework for siting. The commission received contributions from groups and institutions and visited other countries for comparison.(*08)

In 1999 the 5th Radioactive Waste Plan was adopted with a new policy: construction of a centralized interim HLW storage by 2010 for reprocessing waste as well as spent fuel; and no decisions about final disposal before the year 2010.(*09)

In mid 2006 Parliament approved ENRESA's plans to develop an interim centralized high-level  waste and spent fuel storage facility by 2010, and the Nuclear Safety Council CSN approved its design, which was similar to the Habog facility near the Borssele power plant in the Netherlands. In December 2009 the government called for municipalities to volunteer to host this €700 million Almacen Temporal Centralizado (ATC) facility. The government offered to pay up to €7.8 million annually once the facility is operational. It is designed to hold for 100 years 6700 metric tons of used fuel and 2600 m3 of medium-level wastes, plus 12 m3 of high-level waste from reprocessing the Vandellos-1 fuel. The facility is to be built in three stages, each taking five years.  Fourteen towns volunteered, attracted by the prospect of a €700 million investment over 20 years and the annual direct payments, plus many jobs, but only eight were formally accepted.(*10)

In September 2011 the Ministry for Industry announced its selection and rankings: Zarra (Valencia) 736 points; Asco (Tarragona) 732 points; Yebra (Guadalajara) 714 points; Villar de Canas (Cuenca) 692 points. In December 2011 the Ministry announced that Villar de Canas had been selected, though only a 60-year storage period was mentioned. Pending construction, low- and medium-level wastes continues to be sent to ENRESA's storage facility at El Cabril, Cordoba, which has operated since 1961. Used fuel remains at individual power plants.(*11)

For Jose Maria Saiz, the mayor of Villar de Canas, the financial compensation and the promise of 300 jobs were compelling arguments to get the storage to his place. That doesn’t alter the fact that environmental groups and trade unions are against the storage.(*12)  And in March 2012 it turned out that promised regional jobs were not materializing and little is left of the initial optimism.(*13)

The General Plan on Radioactive Waste suggests that the operation of a deep repository in Spain would probably start in 2050. Therefore, the period between 2025 and 2040 would be focused on decision-making process and site characterisations, whereas from 2040 to 2050 construction would take place. A programme of activities between 2006 and 2025 to meet the objective of having a repository by 2050 is lacking (Fundación para Estudios sobre la Energía, 2007).

The high level of priority given to the interim storage facility has delayed the interest and the research efforts in deep geological disposal. Furthermore, the construction of the centralised storage facility allows decisions on final management to be postponed.(*14)

Since the mid-1970s spent nuclear fuel is to be disposed of in a geologic repository. Early plans for reprocessing the spent fuel were abandoned already in the early 1980’s. In the 1970's Svensk Kärnbränslehantering AB (Swedish Nuclear Fuel and Waste Management Company), SKB, was established to manage the waste (*01 Sweden once dumped low-level waste in the Atlantic Ocean (in 1969) and twice (1959 and 1961) in the Baltic Sea.(*02)

The country wants to dispose its nuclear waste, packed in copper to ensure long-term safety, in granite from 2023/25 on. But problems with copper and geological stability have been published widely. Awaiting final disposal spent fuel is stored in an interim facility in Oskarshamn, called Clab. Low and intermediate-level waste is currently stored in a final repository 50 meters deep in the crystalline basement near the nuclear power plant in Forsmark.(*03)

Long-lasting search
In Sweden, the Parliament decided to a Nuclear Power Act in 1977, which asked for an “absolutely safe solution” for final disposal of nuclear waste and makes the nuclear industry responsible for the management of the waste. The Swedish government started a procedure, called scientific mediation, to clarify the scientific differences. This was followed by discussions with the public, aimed at participation in the decision-making.(*04)

Research to find a final disposal site has taken place for since 1977. Eleven sites were examined, with extensive work undertaken at 7. Test-drillings was planned in 5, but only two of these allowed SKB to carry out even an initial feasibility study: Storuman and Malaa. Several possible locations for the final disposal have been dropped out after referendums, such as Storuman, Malaa(*05) and Gaellivare.(*06) It was obvious by then that the best chance for a repository would be in a municipality that has a nuclear power plant: Forsmark and Oskarshamn, or at the Studsvik research reactor.(*07) The idea is that in these locations such an initiative will most likely gain sufficient support, and SKB limited themselves to the choice of  a site with nuclear power activities. (*Sw08) Municipalities can present themselves voluntarily as a host location, but can also withdraw in a later stage. Although there is a law enabling the government under very specific conditions to overrule such a veto, but this provisions seems very hard to use for any government: this will not happen in practice.(*09)

In 1998, SKB director Peter Nygaards stated that the Swedish government should be prepared to offer financial incentives to a community willing to host the repository. He compared this with the money the government pays to local communities to take in refugees. Similarly, any disposal of nuclear waste must also be reimbursed. Nygaards also said he don’t want to fix the moment of permanently sealing a repository. If the repository is full one should consider if closing is not a better option so that "future generations can open it if they need to?" Nygaards said: "It is not wise to make a decision today for 100,000 years from now".(*10)
 Besides the locations with nuclear power plants, only Tierp volunteered to be a host community for the repository. (*11)

 In November 2001 the government approved research in Tierp, Forsmark and Oskarshamn,(*12) but in April 2002, the city council of Tierp decided to withdraw.(*13)  In June 2009 SKB selected Forsmark.(*14) The repository is proposed to be sited adjacent to the Forsmark nuclear power plant on the Baltic Sea coast. On 16 March 2011, SKB applied for a permit.(*15) It plans to begin site works in 2013, with full construction starting in 2015, and operation after 2020.(*16)

Criticism on safety
The KBS method was developed in the 1970s. The basis is a geologic repository at about 500 meter depth in granite bed-rock and the long-term safety is to be guaranteed by artificial barriers – copper canisters surrounded by a bentonite clay buffer.(*17)

There is severe criticism on the disposal method. The nuclear waste is disposed of at 500 meters depth in granite. According to SKB, this is a stable geological formation. But paleo-geophysicist Nils-Axel Mörner states that the stability is not true. Since the end of the last Ice Age the ground went upwards with a rate of one millimeter per day, there were 58 serious earthquakes and 16 tsunamis. As a consequence of these and other factors Mörner finds the repository unstable and not safe.(*18)
In November 2009 another problem arose: the use of copper. The nuclear waste is encased in a copper layer of five centimeters, which has to remain intact for 100,000 years.

Copper corrodes in environments where oxygen is present. The process is easy to observe on copper roof materials that turn green from oxidation. When the industry’s KBS-method was developed in the 1970’s the understanding was that copper does not corrode at all in an anoxic (oxygen-free) environment in the bedrock. During the 1980's a researcher from the Royal Institute of Technology (KTH) in Stockholm, Gunnar Hultquist, presented new findings that showed that copper could corrode in environments without oxygen, as long as there is water present. The new findings were denied by SKB and ignored by the authorities. During the autumn of 2007 Gunnar Hultquist and a colleague Peter Szakálos presented the findings again, this time with more experimental results.(*19) This is noticed by investigation of copper artifacts from the Swedish warship Vasa, which sunk in 1628: the copper had become much thinner than expected.(*20) Copper corrosion has caused a discussion about the KBS method in Sweden as the findings threaten basic assumptions underlying the long-term safety of the KBS method.

A geologic repository in Swedish bedrock at a depth of 500 m has groundwater flowing through the repository, says Dr. Johan Swahn, Director of the Swedish NGO Office for Nuclear Waste Review (MKG) at a hearing on the management of nuclear waste at the European Parliament’s Committee on Industry, Research and Energy.(*21) A repository using the KBS method therefore has to rely on manmade barriers (clay and copper) to isolate the nuclear waste from the environment. The chemical and biological environment will in the long term threaten the artificial barriers of copper and clay in ways that are difficult to foresee. The relatively dry rock (for the KBS method) chosen by SKB in Forsmark puts stress on the clay barrier and opens up for new questions on copper corrosion processes. In Sweden there will be one or more Ice Ages during the next 100,000 years and glaciation will lead to variations in the chemical and biological environment that will affect the man-made barriers.

The safety case for Swedish KBS method is severely questioned and licensing is uncertain. The problems for the KBS method has opened up for questioning whether disposal methods relying on artificial engineered barriers should be implemented at all. The Swedish and Finnish repository programs for spent nuclear are entirely interdependent. If the Swedish program fails, so does automatically the Finnish.(*22)

In short, also in Sweden, nuclear waste disposal is not a fait accompli.

The Swedish Radiation Safety Authority (SSM) has recommended a tripling of the fee paid by the country's nuclear power industry towards paying for management of the country's nuclear waste. Basing its assessment on information gathered from the relevant organizations - including cost estimates from SKB - SSM has recommended to the government that the fee should be set at 3 öre per kWh of nuclear electricity produced. The current level is 1 öre per kWh. (1 öre is worth approximately US$0.002)  According to SSM, much of the increase is down to new estimates from SKB indicating that the remaining costs of the country's planned final repository for used nuclear fuel have grown by about SEK 18 billion (US$2.7 billion) from previous estimates made in 2008. SSM also says it believes that SKB has underestimated future costs, and it has adjusted the proposed fee increase to reflect this.(*23)

Switzerland

In 1969, the first Swiss nuclear power plant, Beznau 1, entered service. As of 1 March 2012 this plant is the oldest nuclear plant in the world.(*01) A geological final repository for high level waste will not be available before 2040, at the earliest: 70 years after the first reactor began operation. Switzerland dumped low- and intermediate level radioactive waste in sea 12 times from 1969-1982.(*i02) It transported the waste by train to the Netherlands, from where it was dumped in the Atlantic Ocean together with the Dutch radioactive waste.(*i03) Spent fuel is temporary stored at the Zwilag central storage facility.

Nagra
In December 1972, the Nationale Genossenschaft fuer die Lagerung radioaktiver Abfaelle (Swiss organization responsible for the storage of nuclear waste) was created: Nagra:(*04) The operators of the nuclear power plants are 95% owned by Nagra, the government has a share of 5%.(*05) Nagra immediately began investigating the storage of low, intermediate and high-level radioactive waste. This resulted in the project "Gewähr" of 1985. In June 1988 the government decided to take the first steps for low and intermediate radioactive waste, but for high-level waste further research was needed. This was because siting feasibility, i.e. the demonstration that a suitable rock body of sufficient extent could be found at an actual site in Switzerland, had not been demonstrated.(*06)

Low and medium radioactive waste: Wellenberg drops out
In 1993, from a 1978 list of originally 100 sites, Nagra chose Wellenberg (in the canton of Nidwalden). Nagra found Wellenberg suitable for safety reasons, but also because there would be
sufficient storage available.(*07) In the Wellenberg-debate critics of the repository project articulated new concepts: the disposal should be retrievable and verifiable. The Nagra, however, did not agree with that and the debate culminated in a June 1995 referendum. A majority of the Nidwalden population voted against the storage. Given the distribution of powers in Switzerland, storage at Wellenberg was off.(*08) The Nagra then examined how the people of Nidwalden would have voted if the requirement of retrievability and monitoring would have been granted. It turned out that 60.8 percent would have voted 'yes'.(*09)

But Nagra wanted to hold on to Wellenberg and the government agreed to this. In 1998 the Department of Energy repeated that Wellenberg is suitable for retrievable and verifiable disposal of low and intermediate level waste.(*10) So another referendum was organized and on 22 September 2002, a majority (57.5%, turnout was 71%) of the population voted again against the disposal at WellenbergThe government reacted by saying that with this result disposal plans were canceled. This was a hard blow to the nuclear industry, which has spent 80 million francs (€55 million) for research and to propitiate the population.(*11)  But it turned out that Wellenberg was not off the table for ever.

Spent fuel policy
From July 2006 on , there is a 10-year moratorium on the export of spent fuel for reprocessing. Before the moratorium, utilities were free to choose between reprocessing and direct disposal of the spent fuel. The reprocessing took place abroad (France and UK). Dry storage buildings at the Beznau nuclear power plant and at the Zwilag central storage facility have been built for the interim storage of spent fuel and of radioactive waste returned from reprocessing abroad. In addition, a building for the wet storage of spent fuel at the Gösgen nuclear power plant was commissioned in 2008.(*12)

2008: new plan for high-level radioactive waste
On 6 November 2008, the Nagra came with a new waste disposal roadmap: 'Zeit zum handeln'.(*13) Surprisingly, Wellenberg was candidate again for storage of low and intermediate level. In February 2011, for the third time, the population Nidwalden voted against (74.5%) the storage.(*14) But unlike earlier, the district no longer has a right to veto: the government has abolished that in 2002.(*15) Therefore, Wellenberg remains on the list.

In the new roadmap, as a first step, there three regions were chosen: Zürcher Weinland, Nörlich Lägeren and Bözberg. These are three regions in northern Switzerland, where a certain kind of clay (opalinus clay) is found. From 2011 on, regional conferences (attended by 100-200 people) should be held several times per year.(*16) The costs, for each region 1.5 million francs (€1 million) is made available, of which 80% is paid by the Nagra.(*17) Somewhere between 2014 - 2016 two locations in each region should be selected and before 2020 a referendum can take place. After that one site will be chosen for the geological repository. After the repository is constructed and the procedures are completed, the storage can start in 2030 for low- and intermediate-level waste and for high-level waste in 2040 at the earliest. (*18)

The plans raised much protest, as extensively described in the May 2010 issue of Energie und Umwelt (Energy and Environment) of the Swiss Energy Foundation (SES).(*19) In all regions, groups work together to prevent that the nuclear waste goes to the site with the least resistance. Although the government announced it wants to give action groups financial support to make their own studies, this was not settled in May 2010. And while the Nagra asserts that a repository has regional benefits, a study of the canton of Schaffhausen shows the contrary: great regional economic damage is expected. Therefore, SES calls the participation a form of sham democracy.

The government, however, continued the plans and on 1 December, 2011, decided that those sites may remain appropriate on 1 December 2011.(*20) The next four years, further investigation will take place at all sites, and interested parties can participate in regional conferences. After those four years, so in 2016, one site is selected and an application process for a license will start. In 2040, Nagra expects, the actual disposal can start. The Swiss Energy Foundation (SES) together with local groups are protesting the continuation of the process. According to these groups there are 12 unresolved questions about safe disposal of nuclear waste.(*21) These 12 questions should first be resolved before the people can be involved in the disposal. Therefore, these groups are in favor of the suspension of the government's plans.(*22) On March 6, the government, however, sees no reason to stop the procedure and announced that a repository has positive outcomes on the regional economy.(*23)

Dounreay: 'significant' hot particle found on beach.
Experts have discovered the most significant radioactive particle yet on a public beach two miles (approximately 3km) west of the redundant nuclear site of Dounreay, Scotland, UK. Dounreay clean-up contractor DSRL has informed the Scottish Environment Protection Agency of additional tests being carried out on a particle recovered during routine monitoring of a beach near the redundant nuclear site. The particle was detected at the water's edge at Sandside. The beach at Sandside is located. The particle - detected on February 14 - was the 208th to be recovered from the beach at Sandside in the last 15 years.

Provisional checks carried out on the beach indicated the particle had a higher than normal beta dose rate. A spokesman for DSRL said it was the first time a particle classed as significant - the highest classification in terms of radioactivity - had been found on the beach, although many had been found on the seabed and foreshore at Dounreay as well as on the site itself. Any particle with radioactivity above one million Becquerel (Bq) units is classed as significant.

Work is due to resume in May to clear particles from the seabed near the site. More than 1800 have been recovered so far from the seabed where there is evidence of a "plume" from historic effluent discharges dating back 50 years. Particles are fragments of irradiated nuclear fuel.

Defend democracy; Unite to shut Vermont Yankee down!
In 2010, the citizens and legislature of the State of Vermont, with support from their neighbors in Massachusetts and New Hampshire, decided to close the Vermont Yankee nuclear reactor permanently by March 21, 2012, when VY's 40-year license expires. In 2011, Entergy, the New Orleans mega-corporation that owns Vermont Yankee, sued the State of Vermont, defying the democratic will of the people, to keep their aged, accident-plagued reactor running for 20 more years. On January 19, 2012, federal district court judge J. Garvin Murtha sided with Entergy against the State of Vermont and the people of New England. On February 18, the State of Vermont appealed Murtha's ruling. With the future of VY still hanging in the balance, nonviolent citizen action is more important than ever.

Let us make clear: We will NOT allow unbridled corporate power to deprive us of our inalienable right to live in safety on our homes, and to determine our own energy future – a future that is safe and green for our children and our children's children. Many events have taken place and will take place to shut Vermont Yankee down. The most important one is 'Occupy Entergy HQ' on March 22. There will be a brief rally at the Brattleboro, VT Commons starting at 11:00am, then a walk to Entergy Headquarters on Old Ferry Rd. in Brattleboro (3.5 miles) where there be a direct action, likely to include civil disobedience.

Franco-British nuclear cooperation agreement.
On February 16, UK Prime Minister Cameron met his French counterpart Nicolas Sarkozy in Paris at a joint summit for the first time since their bitter clashes over Europe. The joint declaration on energy made contained a range of goals, the greatest of them being to encourage "the emergence of a Franco-British industry that is highly competitive across the whole supply chain at the international level." Most prominent in this will be the work of France's majority state-owned firms EDF and Areva and their cooperation with privately held UK firms for the construction of new reactors in Britain.

The agreement to co-operate on developing civil nuclear energy is meant to pave the way for the construction of new nuclear power plants. It was accompanied by the news of a deal between Rolls-Royce and French nuclear reactor developer Areva. Areva has asked Rolls to make complex components and provide engineering and technical services for two reactors to be built at Hinkley Point, Somerset.

But not everybody is confident that the agreement will bring much for Britian's industry. According to Tim Fox, head of energy at the Institution of Mechanical Engineers "Although some relatively small contracts are to be awarded to Rolls-Royce and BAM Kier, it looks increasingly likely that the vast majority of the contracts involved in the manufacture and construction of the new nuclear reactors at Hinkley Point and Sizewell will go to France rather than the UK." Friends of the Earth's Energy Campaigner Paul Steedman said: "Cameron's deal today will leave British taxpayers footing a massive bill for new nuclear plants we don't need and can't afford - while EDF continues to rake in huge profits."

Meanwhile at Hinkley Point ….
From Febr. 12 on, following an occupation of trees a week earlier, activists are occupying a farmhouse close to Hinkley Point, to stop EDF Energy trashing land for the planned new nuclear power station. Anti-nuclear campaigners have been joined by members of Seize the Day as the first residents of Edf-Off Cottage which is on the 400-acre site earmarked for two new reactors.

At the High Court on February 27, EDF Energy failed in their bid to impose an injunction to stop an alliance of anti-nuclear groups from protesting on the 400-acre site set aside for two new mega-reactors at Hinkley Point. This injunction was being sought to remove these campaigners, but it was simultaneously designed to restrict future demonstrations. The Orwellian language even prohibits campaigning groups from 'encouraging other persons' to protest at the site. Speaking on behalf of the Stop New Nuclear alliance, Kate Hudson from CND stated "It should be inconceivable that private companies could restrict basic civil liberties in this way. They are not the arbiters of the nuclear debate, nor the guarantors of our freedoms. We will fight to ensure the rights of future generations to peaceful protest and to preserve essential democratic principles."

On 10 and  11 March, one year since the Fukushima nuclear disaster began, antinuclear groups call for a human chain/blockade around the station to show "our determined opposition to new nuclear".

Spain: OK for 41-year old Garona life extension. Spain's nuclear security agency CSN has determined that the country's oldest nuclear reactor, the 468 MW Santa Maria de Garona nuclear power plant, is safe to operate until 2019, in response to a request by the industry minister to review the installation. The approval, disclosed on February 17, clears the way for the recently installed Spanish conservative government to overturn the previous socialist government's 2009 order to have the generator closed in 2013. Although the CSN said there was "no safety or security issue that should impede continued operation of the power plant", the agency added that it would still have to review any formal application by the operator to extend the installation's license, including scrutiny of its latest operating data and future security measures being considered. Garona was first connected to the grid in March 1971!
The CSN in 2009 had given authorization for the station to operate for another 10 years, but the government at the time opted instead for an earlier expiration date. Since then, new regulations have been put in place, particularly following the accident at Japan's Fukushima nuclear power plant early last year.

World oldest reactor (44 years) closed. The world's oldest operating nuclear power reactor – Unit 1 of the Oldbury nuclear power plant in the UK - has been closed after 44 years of power generation on 29 February 2012. Unit 2 was shut down in June 2011, while unit 1 was expected to continue operating until the end of this year. Plant operator Magnox Ltd announced last October that it had decided to end operations ten months early as it was "no longer economically viable."

Beznau now oldest in world; call for closure.
After Oldbury's closure, Switzerland's Beznau nuclear plant holds the dubious record of being the oldest nuclear plant in the world and should be shut down, a group of environmental organizations said on February 23. Switzerland is phasing out nuclear energy but not fast enough, say the groups. They list a number of problems and point out that the company that runs it is planning to increase the earmarked CHF500 million (US$ 557m or 415m euro) to make it safe, money they believe could be better spent shutting it down and moving to safer energy sources.

U.S.: Fourth Legislative Attack on Grand Canyon Uranium Ban Fails… The fourth legislative attempt to block the Obama administration's ban on new uranium development across 1 million acres of public land surrounding Grand Canyon National Park died February 14, when the House rules committee ruled it out of order. The amendment was sponsored by the same three Republican congressmen who sponsored three previous failed anti-Grand Canyon legislative proposals - Jeff Flake, Trent Franks and Paul Gosar, all from Arizona. The most recent amendment sought to overturn a January decision by Interior Secretary Ken Salazar enacting a 20-year 'mineral withdrawal' that bans new mining claims and development on existing claims lacking rights-to-mine across Grand Canyon's million-acre watershed (see Nuclear Monitor 740, 13 January 2012, In Briefs).

In 2010 and again in 2011, Flake, Franks and Gosar sponsored legislation that would have prohibited the Interior Department from enacting the mining ban; in 2011 they attempted to add a rider to a budget bill - their third failed attempt prior to this most recent amendment.

Over the past few years, nearly 400,000 people from 90 countries wrote the Department of the Interior urging it to ban new uranium mining around the canyon after a uranium boom threatened to bring a new wave of destructive mining threatening recreation, tourism, wildlife habitat and waters in Grand Canyon National Park. The mining ban has won wide support among American Indian tribes, regional businesses, elected officials, hunting and angling groups, scientists and conservationists.

….but next attack imminent. The withdrawal of lands in northern Arizona from mining activities is unconstitutional, unlawful and violates the National Environmental Policy Act, said organisations representing the US mining and nuclear industries in a lawsuit against US Interior Secretary Ken Salazar.

The suit has been filed with the US Federal District Court in Arizona by the National Mining Association (NMA) and the Nuclear Energy Institute (NEI), the US nuclear energy industry's organization. The Department of the Interior (DoI), US Bureau of Land Management (BLM), US Forest Service and US Department of Agriculture are named as co-defendants alongside Salazar, in his capacity as Interior Secretary.

The NEI and NMA argue that Salazar does not have the legal authority to make withdrawals of public lands in excess of 5000 acres, citing a landmark 1983 Supreme Court ruling that such withdrawals would be unconstitutional. Furthermore, they claim, the decision to withdraw the land is "arbitrary, capricious, and not in accordance with law." Finally, the environmental impact statement (EIS) and record of decision on the withdrawal violate the terms of the National Environmental Policy Act (NEPA) in failing to take a "hard look" at the economic and environmental consequences of the withdrawal.

Finland: Uranium mine granted permission.
The Finnish Talvivaara mine today gained permission to extract uranium and process it into uranium oxide. The UO4 would be transported away by rail and ships, possibly to Russia. The mine was opened a few years ago mainly as a zinc mine. It's using an experimental biosoaking process to extract small amounts of minerals from the ore. The company has been crippled by scandals from the beginning, with sulphuric acid and other chemicals continuously spilling all over nearby woods and lakes. The company has failed to make any profit so far and its CEO was forced to quit last year.

In a strange technocratic turn of events, the environmental authorities concluded that instead of closing down the mine, it would be beneficial to grant the mine a permission to separate the uranium from the rest of the waste so that the further spills bound to happen at least wouldn't contain radioactive materials. As a last minute effort, environmentalists tried to convince the government to at least demand a description of the separation process so as to ensure this doesn't just produce a lot more radioactive/toxic sludge. The government decided not to do so and instead just granted the permission "because it brings 40 million euros worth of investment to the area".

The local municipality and just about every major business in the area was opposed to the permission after the previous scandals and their trade being spoiled by the smelly pollution in the environment.

Rosatom-owned company accused of selling shoddy equipment to reactors.
Russian Federal Prosecutors have accused a company owned by the country’s nuclear energy corporation, Rosatom, with massive corruption and manufacturing substandard equipment for nuclear reactors under construction both at home and abroad.  The ZiO-Podolsk machine building plant’s procurement director, Sergei Shutov, has been arrested for buying low quality raw materials on the cheap and pocketing the difference as the result of an investigation by the Federal Security Service, or FSB, the successor organization to the KGB. It is not clear how many reactors have been impacted by the alleged crime, but reactors built by Russia in India, Bulgaria, Iran, China as well as several reactor construction and repair projects in Russia itself may have been affected by cheap equipment, given the time frame of works completed at the stations and the scope of the investigation as it has been revealed by authorities.

Spain: large anti-nuclear campaigns after Fukushima

Fukushima has had a big impact in Spain, mainly in Catalonia, as this country is one of the most nuclearized countries of the world. In 2010, almost 50% of all the generated electricity in Catalonia was nuclear. The main issue is the extension of operational licenses of several reactors.

Despite the lack of serious information about the Fukushima nuclear accident in the main media, a coalition of antinuclear Catalan groups just after the Fukushima accident called for a sit-in in front of the Catalan government and City Council main buildings (17 March 2011). Also they succeed in organizing a big march (supported by more than 100 environmental, political, social and solidarity organisations), on Sunday 5 June 2011, the World Environment Day, from the Spanish Government Delegation building in Barcelona to the Endesa main office in the city. The Spanish Socialist Party won the elections with the commitment to establish a timetable to shutdown the nuclear reactors, but at present nothing has been decided and the only nuclear decision has been to extend the life of the oldest nuclear reactor operating in Spain (Santa María de Garoña, GE BWR, similar to Fukushima number 1 unit).

Endesa was the former public utility that was privatized by the conservative government in 1998 and is now owned by Enel. Endesa, as public utility, played a main role in late seventies and early eighties buying shares of many Spanish private utilities engaged in building nuclear power plants that experienced big financial problems. And now Endesa owns 45.3% of all the nuclear power capacity in Spain (Iberdrola 44,9%, GasNatural Fenosa 7.5% and HC 2.1%). The antinuclear Barcelona march was attended by many thousands of people from all ages, showing a 250 square meter banner (15x15m) with a gigantic Smiling Sun logo.

The antinuclear march was a big success because since November 1989, just after the serious accident that Vandellos I reactor experienced on October of that year, not one antinuclear demonstration had been organized any place in Spain. Only the Barcelona based Group of Scientists and Technicians for a Non Nuclear Future (founded in Barcelona at the end of 1980 and registered as NGO just after the Chernobyl accident) was able to organize an annual event called the Catalan Conference for a Future Without Nuclear Power (since 1992 it was renamed as Catalan Conference for a Sustainable Energy Future Without Nuclear Power). During the last edition of the conference (the 25th) two main energy studies were presented: the SolarCat and the SosTec, the first showing two scenarios on how Catalonia could have a 100% renewable electricity system between 2030 and 2045 and the second exploring how to shutdown the three remaining nuclear reactors operating in Catalonia before 2020. As invited guests, Walt Patterson (author of many books on energy) and Javier García Breva (former IDAE director and now chairman of Renewables Foundation) were able to give lectures.

To understand the success of the present antinuclear events it is necessary to remember that on occasion of the 20th anniversary of Chernobyl accident (2006) in Barcelona a big antinuclear music festival around Earth Day was organized. In Barcelona, Catalonia Earth Day is organizing since 1996, an annual Earth Fair and the last editions of the Earth Fair were attended by 100.000 people). Also, in 2010, at the same event, a successful demonstration was organized to show the rejection of the proposal of the Spanish Government plans to build a Nuclear Waste Centralised Storage facility. Many thousands of people with antinuclear face-masks, showed the opposition to the project. And a few weeks before the June 5 march, another massive antinuclear event during the Earth Fair was organized and attended by many thousands of people.

After the Fukushima nuclear disaster other antinuclear demonstrations were organised in Madrid (8 May, supported by 27 political, social and environmental organisations) and Bilbao (Basque Country, 23 June, supported by 20 social and environmental organisations).

On July 26, 2010 the Spanish government renewed the operational license of Vandellòs 2 nuclear reactor until 2020. On March 10, 2011 (one day before Fukushima) it did the same with Cofrentes nuclear reactor, renewing the operational license until 2021. Next October 1, 2011 the operational license of Ascó nuclear plant (with two reactors, Ascó 1 and Ascó 2) will end. Now there is a strong campaign to ask the Spanish government not to renew the Ascó operational license because it is the nuclear plant experiencing almost 50% of all the nuclear irregular events in Spain. Last July 22, 2011 the Catalan Parliament rejected a proposal introduced by ‘Solidaritat Catalana per a la Independència’ (a coalition of 5 political parties, including the Catalan green party ‘Els Verds – Alternativa Verda’), supported by the Socialist Party (PSC), the Republican Party (ERC) and the leftist party (ICV-EUA) asking the Catalan government to address a petition to the Spanish Government in order not to renew the operational license of Ascó, until the nuclear power plant will succeed with the stress tests adopted after the Fukushima nuclear catastrophe. The majority of votes from the Catalan center-rigth party CiU (ruling at present the Catalan government) with the support of the Spanish rightist party PP rejected the proposal, showing clearly their support for the nuclear industry.

The Spanish government has ratified a law removing a statutory 40-year limit on nuclear power plant operating life.
The wide-ranging Sustainable Energy Act, known by its Spanish acronym LES (Ley de Economía Sostenible), was approved by 323 votes to 19, with one abstention, in the lower house of the Spanish government on 15 February. The amendment on nuclear energy within the LES was approved by 334 votes to 10, with no abstentions. The law had already passed through the upper house.

The nuclear energy amendment states that the government will determine nuclear's share in Spanish generation and also the lifetimes of existing nuclear plants based on a variety of considerations including regulatory requirements for nuclear safety and radiological protection as advised by the Spanish nuclear regulator, plus trends in demand, the development of new technologies, security of supply, costs of electricity production and greenhouse gas emissions.
Previous legislation imposed a 40-year operating life on Spain's nuclear reactors, which would have seen all of Spain's eight operating reactors facing closure between 2011 and 2018. However, in 2009 the Spanish government granted a four-year life extension to the Garona nuclear power plant, extending its life to 42 years and signaling the start of a political shift from earlier plans by the ruling PSOE (Socialist Party) to progressively phase out nuclear.

'Peligro nuclear'

'Nuclear Danger’ is the message Greenpeace Spain took to the country’s Cofrentes nuclear energy plant on February 15, as activists scaled one of the plant’s cooling towers. Greenpeace are demanding that Spain’s Nuclear Security Council refuse to renew the plant’s permit to operate - which expires on March 19 – because of the extremely poor levels of security at Cofrentes. The aging Cofrentes reactor is in bad shape. It has an endless list of bugs and unresolved security issues. Among the many weaknesses it has identified, Greenpeace has expressed concerns about the fire-fighting systems, access to the control room, the increasing radioactivity received by maintenance workers, and delays in the analysis of events and incidents.

Meanwhile, take a look at the renewable energy sector in Spain. According to a study by the Institute for Energy Diversification and Saving of Energy released in November last year, the number of current direct jobs provided by the renewables industry is more than 75,000. Taking into account the official renewable growth forecast, Spain can expect to see a further 128,000 created by 2020. On the other hand, the nuclear sector in 2005 had just 4,124 employees, of which 52.8% were the permanent staff at nuclear power plants. Spain is a leading nation when it comes to the production of renewable energy. It is showing we can live in a world without nuclear energy.

The Spanish Ministry of Industry has started a process for the construction of a Centralized Temporary Storage of radioactive waste (Almacén Temporal Centralizado –ATC) to house waste from all nuclear power plants in Spain. Some municipalities in the country have submitted their applications to host the facility. Several sites have been proposed in the past, but at the moment it seems to be Zarra, in the province of Valencia, near Albacete.

When Zarra, a village with a population of 551 on Valencia's provincial boundary with Albacete, emerged as a likely candidate from a Cabinet meeting in Madrid as the site for nuclear waste storage, the anti-ATC protest group called for immediate action: "people are very angry".

Siting the nuclear cemetery in Zarra would compromise the safety of  the Valencians, said Juan Cotino, third vice-president of Valencia's regional government earlier, in a reversal of the initially mild opposition to the ATC. Zarra could not satisfy the safety requirements for such a sensitive installation, he says. Most of the subsoil in the area ia a combination of clay and loam and could be geologically erratic in steep areas prone to landslides. But a delegate to the Madrid government claims that none of Cotino's present objections were put forward by the Valencian government when it originally opposed the ATC.

Antinuclear activists, however, were always clear in their rejection. In March already 4,000 people protested against the nomination of Zarra. And also in Madrid the opposition to the waste storage mounts; on September 22, some 1500 people demonstrated at the Ministry of Industry, Commerce and Tourism.

During the last two weeks of September quite a few things happened in the proposed region.

On September 19, a caravan of more than 200 slow-moving vehicles protested against the possible siting, causing 12-kilometer tailbacks on the A31 Alicante-Madrid road. It was the first of a series of demonstrations staged that week against the nuclear power plant at  Cofrentes and the proposed waste storage center at Zarra

A few days later the police arrested 16 activists at the village of Ayora, close to Zarra.  Among those arrested was the mayor, Manuel López Gaviria. He was arrested by four uniformed Guardia Civil officers at the school while teaching his students. Apparently, officials have identified the detainees through photos of the protests, as most of those arrested are "neighbors of the town of Ayora, where everyone knows everyone." The Guardia Civil said they could arrest as much as 'over a hundred people'. The arrest were made in connection with alleged crimes such as disobedience, public disorder and breaching traffic safety regulations. The charges include roadblocks on access roads to the Cofrentes nuclear power station.

A townmeeting was held immediately after the arrests. These arrests and trials are "attempts to criminalize and silence an entirely peaceful protests" in order to "scare and frighten" the activists,  and "the purpose of detention is to scare the demonstrators to stop the protests". According to one activist the people at the meeting were committed: "rather than to discourage, the effect of the arrest is quite the opposite. The people are one". A "cyberaction" has been started demanding "the immediate withdrawal of charges against all". 

On 28 September about 300 people demonstrated in Valencia in solidarity with those accused.

Opposition mounting against refitting Gentilly-2.
More than 250 Quebec municipalities and regional municipal governments have banded together to demand the province shut the door on nuclear energy by mothballing Hydro-Quebec's Gentilly-2 nuclear reactor instead of rebuilding it. Copies of a resolution thus far adopted by 255 municipal bodies were presented to three opposition members of the Quebec legislature on September 10 by Mayor Gaetan Ruest of Amqui, Que., who has been spearheading a campaign launched in 2009. The thick stack of identically worded resolutions will be introduced in the full legislature after the assembly reconvenes Sept. 21. Public opinion polls show almost two-thirds of Quebecers are opposed to a plan by Hydro-Quebec to rebuild Gentilly-2.

China: people largely distrustful of the nuclear industry.
It is not any longer a European and North-American problem: now there is a shortage in nuclear professionals for their rapid expansion of nuclear power in China too. According to senior government officials, China's nuclear power industry is demanding more professionals than the country can produce, a potential threat to safety. China has six leading universities that train nuclear specialists. Neither Zhang or Li gave specific figures for the shortage, but an official with the China Nuclear Society estimated the country would need 5,000 to 6,000 professionals annually in the next decade or so, versus a yearly supply now of about 2,000. Li also stressed that "public education was critical because people were largely distrustful of the industry." A lack of professionals has often been identified as a reason that a rapid expansion of nuclear power is unrealistic.

An amendment has been made by the Greenland government to the standard terms for exploration licences under the country's Mineral Resources Act of 2009. The amendment allows the Bureau of Minerals and Petroleum (BMP) to approve that comprehensive feasibility studies can be undertaken on mineral projects that include radioactive elements as exploitable minerals. Within this framework, projects are considered on a case-by-case basis at the government's discretion. 
 
Australian-based Greenland Minerals and Energy has lodged an application under these new regulations that has been approved by the BMP. The company says that it is now in a position to commit to commence definitive feasibility studies in 2011 as planned. The studies, it said, will generate the necessary information to determine development parameters for the Kvanefjeld deposit. The Greenland government has stressed that although radioactive elements may now be surveyed, their extraction is still not permitted.

The Kvanefjeld deposit is eight kilometres inland from the coastal town of Narsaq, near the southern tip of the country. It has a deep water port. Uranium comprises about 20% of the value of minerals able to be produced from Kvanefjeld.

India: Further delay Kudankulam.
The commissioning of the first unit of the Kudankulam nuclear power project has been put off by a further three months from the previously revised scheduled date of completion. According to Nuclear Power Corporation of India, the first unit is expected to be commissioned in March 2011. Previously, it had mentioned December 2010 as the expected date of commercial operation. The 2,000 MW, two units of 1,000 MW each, nuclear project that is coming up at Kudankuklam, southern Tamil Nadu with Russian technology, reactors and fuel, has suffered a huge delay in commissioning.
The first of the two units was originally supposed to begin commercial operations in December 2007 which means, the project has already slipped by three years and three months. The second unit, initially scheduled to start commercial operations in December 2008, is now expected to go on stream in December 2011.

Spain: blockades after rumors decision waste storage. Spain delays the decision on nuclear storage site after news that the temporary dry-storage facility for high-level radioactive waste would be built in Valencia region revived long term opposition to the plan. According to a spokeswoman for the Valencia autonomous government, Spain's industry ministry announced on September 17 that the facility would be located in Zarra, a municipality in region. But the government was later forced to say it was not a final decision because of strong public opposition, according o statements to the Europe's environmental news and information service ENDS. The industry ministry rejects this interpretation, saying it only informed the regional government that Zarra was "well placed" to house the facility and that the decision would be "discussed" at the September 17 meeting of Spain's council of ministers. A spokesman said the government "hopes to have a decision soon".

Local residents and environmentalists responded to the news by blocking the Valencia-Madrid motorway on Sunday. The Spanish government has been trying to find a site since years. The search has become increasingly urgent since existing localized storage capacity is insufficient for the high-level waste produced in the country.

U.A.E.: Raising debt to finance nuclear project.
Abu Dhabi is expected to raise debt to finance more than half the cost of its initial US$20 billion nuclear project, defying a warning by the International Atomic Energy Agency (IAEA) that lenders could shy away from nuclear development. Yukiya Amano, the IAEA director general, said international lenders were “reluctant to support nuclear power projects”, amid a surge of interest in nuclear development by new countries.  Credit Suisse Group AG has been appointed as financial adviser for the United Arab Emirates’ nuclear power program, Emirates Nuclear Energy Corp. announced. So far no other banks have been appointed as advisers for the project, according to a report in Bloomberg. HSBC Holdings Plc may also be selected to advise state-run Emirates Nuclear Energy, although the bank is yet to be formally appointed for the role, which includes securing debt commitments for the project, Meed.com ('Middle East bussines intelligence since 1957') reported on its website September 15.

No firm plan for the financing exists yet but Abu Dhabi has already accessed debt markets to pay for energy infrastructure such as power plants and pipelines.  But the Abu Dhabi financing could be raised by a combination of export credit, syndicated loans and government bonds, depending on the appetite of global investors after the global recession. Credit Suisse will help develop a financing structure advantageous to Abu Dhabi.

Another way to subsidize nuclear power are export credit agencies. Those agencies from countries supplying the materials and parts are also expected to shoulder part of the financing. This would ease the pressure on Abu Dhabi’s government financing, which is already being funnelled into civic and industrial diversification projects, with a budget deficit forecast this year. Government guarantees on the loans, by contrast, can be a crucial ingredient to a 'successful financing'.

U.K.: The end of the towel controversy. Sellafield's towels controversy is over after a change of heart by management over plans to stop issuing and washing towels used by workers in the 'active' areas of the nuclear site. There had been protests by the site unions who feared contamination could be left on clothing and carried off the site. Sellafield Ltd wanted workers to help cut costs by bringing in their own towels and taking them back home for washing. Towels amount to more than half the site laundry wash load. Management still thinks too many towels are being used but is ready to talk to the unions about other cost-cutting options.

Bulgaria: beach contaminated by uranium mining.
The sand from the Bulgarian Black coast bay "Vromos" is radioactive and "harmful for beach goers", according to experts from the Environment and Health Ministries. A letter, send to the Governor of the Region of Burgas, Konstantin Grebenarov, asks local authorities to make people aware of the results and place signs warning visitors to not use the beach. The radiation level is twice as high than the norm for the southern Black Sea coast, but the danger is not in the air, rather in the sand which contains uranium and radium. The contamination is coming from the now-closed nearby mine which deposited large amounts of radioactive waste in the bay between 1954 and 1977. The increase of radiation levels in the area over the last three years is attributed to some radioactive waste that has not been completely removed.

In the beginning of August, Grebenarov, already issued an order banning the use of the beach located between the municipalities of the city of Burgas and the town of Sozopol, near the town of Chernomorets. At the time Grebenarov said he made the decision after consulting with experts from the Health Ministry and the Environmental Agency.

The order triggered large-scale protests among hotel and land owners around the bay, saying the order serves business interests and aims at lowering property prices in the area. The Governor says the warning signs, placed at "Vromos," and removed by local owners, but will be mounted again.

During a visit early August to Sozopol, Finance Minister, Simeon Djankov, promised the owners to make sure there would be a second measurement, and if it proves the radiation is within the norm, the ban would be lifted. But now it turns out that a separate measurement, done by the Executive Environmental Agency in mid-August, had the same results.

Germany: phasing out the phase-out. Utility companies and the government have agreed to allow two nuclear power plants which were scheduled for closure soon, to keep operating.

The two older reactors scheduled to be taken offline in the near future, Biblis A in Hesse and Neckarwestheim I in Baden-Württemberg, will remain operational until the current government finalizes its general energy program, expected in October. The move appears to be another step in reversing a 2001 plan passed by Germany's Social Democratic-Green party government under Gerhard Schröder to eventually phase out nuclear power in Germany. According to the media report, energy companies are using something of an accounting trick to enable the plants to stay online: unused allocations of electricity from newer plants will be transferred to the Biblis and Neckarwestheim facilities. The federal government met with the country's top four energy providers in Berlin on January 21 about possibly extending the life spans of nuclear power plants. While the government played down the meeting as "routine," anti-nuclear activists protested throughout the day.

UK: Higher-burnup fuel needs century cooling period.

The higher-burnup fuel proposed for new reactors being considered in the UK could require a spent fuel cooling period so long that a UK geologic repository, as currently planned, would close before some of the fuel was ready for disposal. The concern surfaced in a response from Westinghouse to a study by the UK Nuclear Decommissioning Authority’s Radioactive Waste Management Division, or RWMD, on the “disposability” of waste from the Westinghouse AP1000. In a similar study of the waste from the Areva EPR, the RWMD postulated that a 90- to 100-year cooling period would be necessary for the higher-burnup fuel planned for use in both companies’ reactors. As currently envisioned, a geologic repository is “assumed” to accept its first spent fuel and high-level waste around 2075, according to the UK Nuclear Decommissioning Authority, or NDA. A repository is expected to operate 90 years before it is closed in 2165. However, if an AP1000 or EPR begins operation in 2020 — the date assumed in the RWMD studies — and operates for 60 years and the fuel needs 100 years to cool, spent fuel from the final years of reactor operations would not be cool enough for disposal until 2180, after the repository had closed.

Nuclear lobby: 4 key issues for 2010. In the January 2010 issue of Nuclear Engineering International Dan Yurman (“Serving nuclear energy markets since 1989”) sees four key priorities for 2010 to let a nuclear renaissance in the United States happen. Priorities, because he sees problems and uncertainties ahead: “Critics are exploiting the fault lines that have already appeared, and some, under the guise of scholarship, cherry pick their sources to make the case for failure. Their objective is to sow fear, uncertainty, and doubt in the minds of business and government decision makers.” (January 28, 2010) Stating that “he is not prepared to accept a long term future for the U.S. as being an agnostic on nuclear energy while the U.K. France, Italy, India, China, and other countries put the pedal to the metal to build dozens of new reactors to meet the challenge of global climate change” he analyses four areas where things have to change.

1- US$200 billion loan guarantees for companies to build new reactors. “Without the loan guarantees, few utilities have the market capitalization to ‘bet the company’ on a multi-billion dollar investment in a new nuclear reactor.”

2- developing a “cadre of nuclear engineers and skilled trades capable of building new reactors on time and within budget”. Foreign competition will raid U.S. engineering programs for talent unless the “federal government” (again the government) puts in place a scholarship program.

3- The third priority is “revitalizing U.S. manufacturing capabilities including development of a facility to produce large forgings, e.g., 400 tons or more, for reactor vessels.” Because despite increases in capacity, Japan Steel Works (one of the few companies worldwide able to produce those large forgings) reports a three to- four year wait time for 400 ton reactor vessels. Currently three production facilities are under construction in the U.S.: by Areva in Virginia, Shaw in Louisiana, and Babcock & Wilcox/McDermott at locations in Ohio and Indiana.

4- If you think these three are difficult enough, read the fourth critical issue: re-invent the fuel cycle: two strategically located 500 ton/year reprocessing plants; a commercial MOX fuel manufacturing capability and the development of fast (breeder) reactors to “burn the MOX-fuel en complete the fuel cycle”.

It’s time to make clear that nuclear energy had its chance (after 50 years of pouring money in it),  admit it is something of the past and move forward to real energy solutions (but, that’s not Yurman’s conclusion).

Albania: Approval of Atomic Energy Agency.

On January 20, the government of Albania approved the creation of the country s National Atomic Agency, an institution that is suppose to supervise the development of nuclear projects. Earlier Prime Minister Sali Berisha had announced that the government was looking at the possibility of constructing a nuclear power plant. Albania’s power generation system has not seen major investment since the early 1980s, when the cash-strapped former communist regime stopped investing in new hydropower dams. Berisha's statements over constructing a nuclear power plant, have drawn interest from Italy Italian energy giant Enel who has expressed interest in locating a nuclear power generating project  in the Balkans, possibly in Albania or Montenegro. The Prime Minister said the government’s goal is to make his country a regional energy  superpower. However most commentators believe that Berisha’s statements are little more than hot air and will do little to help end electricity shortages.

Black workers got more radiation.

U.S.A.: A Tennessee company that processes nuclear waste has agreed to settle federal claims black employees were subjected to higher levels of radiation than others. The Studsvik Memphis Processing Facility, formerly known as Radiological Assistance Consulting and Engineering, or RACE, has signed a consent agreement with the Equal Employment Opportunity Commission, the Memphis Commercial Appeal reported. Under the agreement, 23 black employees are to receive a total of US$650,000 (461,000 Euro).  The EEOC alleged the company assigned black employees to work with radioactive waste and manipulated dosimeters to show lower levels of radiation than the actual ones. Black employees were also paid less and subjected to other kinds of discrimination. Lewis Johnson, president of Studsvik, said the alleged discrimination took place before the Swedish-based company bought the Memphis facility.

Radiation leak at Germany's uranium enrichment facility.

A radiation leak at Germany's sole uranium enrichment facility in Gronau (North Rhine Westphalia) has left one worker in hospital under observation. On January 21, in the preparation of a container at the Gronau uranium enrichment plant, a release of radioactive waste occurred. One employee of Urenco  Deutschland, who was operating at that time, has been admitted to hospital as a precaution for observation. He was contaminated on hands and feet with UF6 while opening a supposedly "empty and washed" container. It seems he also enhaled some. He was expected to be released within 24 hours on Friday, but had to stay over the weekend, when uranium was found in his urine. But press reports on Monday claim, he has to stay in hospital longer.According to the plant's operating company, Urenco Deutschland, there was no danger at any time to the local population. Urenco, is currently determining the cause of this incident, according to their press release.The national news in Germany reported widely on the accident. Even the prosecutor has started - on demand of local antinuclear organisations - an investigation against Urenco. On January 22 and 24 there were demonstrations in Gronau - with up to 100 people.

U.S.: Power to corporate society.

On January 21, the U.S. Supreme Court threw out six decades of established law by granting corporations the right to use their incredible wealth and power to influence elections -- thereby diminishing the power of voting.. Imagine ExxonMobil, AIG or Entergy-Louisiana for that matter, throwing huge sums of money directly into Congressional or Legislative attack ads. And this on top of the already unbelievable amount of influence corporations have on elections. Such a scenario used to be illegal. But no longer, since the Supreme Court ruled to lift the ban that kept corporations from contributing directly to campaigns and candidates. The tortured legal argument is this: We the People are infringing on corporations' "rights" by preventing them from using all of the special advantages they have over real human beings (like unlimited life, limited liability, and lots of other ways of amassing great wealth) to influence political elections. A corporation is not a person. Corporations cannot vote. They do not live, breathe or die - at least not in the way people do and are not a part of "We the People." Giving corporations the rights of people is a cynical political move that fundamentally changes democracy. Unless we stand up, the problem of corporate money in politics could go from bad to unimaginably worse.Thankfully, some legislators are working to strengthen our campaign finance laws to prevent this. Congress needs to prevent a flash flood of corporate money into elections and there is a need to move fast. The alternative is an undemocratic system in which large corporations have even more power to drown out the voices of regular voters

Spain: Nuclear law reformed.

Spain’s 1964 nuclear energy law is to be reformed to give nuclear plants greater possibility of functioning beyond the 40 years “useful life” for which they were designed, the Council of Ministers decided on December 23. The country’s eight nuclear plants must now be owned by a single limited company whose “exclusive object should be the management of the plants”, ministers decided. This is to “increase the transparency of the accounts and investments of the installations.” Ministers approved a series of measures to “clarify the criteria for the renewal” of operating licences. The 40-year “useful life” has been ratified, with extensions accepted “giving consideration to the general interest and the energy policy in effect, and the security of energy supply.” Utilities may now exchange participations to ensure that a nuclear plant belongs to a single company. Many of the eight are shared by two or three utilities, such as Garoña which is to be closed in 2013 shortly after completing 40 years’ operation. Garoña’s company, Nuclenor, was created by its 50-50 owners, utilities Iberdrola and Endesa. The ministers also approved tougher nuclear insurance conditions, increasing the obligatory insurance of a plant in case of an accident from 700 million Euro to 1.2 billion Euro (US$ 1.68 billion)

Scotland: New waste policy published.

The Scottish Government has published its proposed new intermediate level waste policy which is out to consultation until 9 April. In 2007 the Scottish Government broke away from the rest of the UK by rejecting the idea of a deep geological repository for its higher activity wastes. Instead it favoured long-term storage of waste in on- or near surface facilities, near the site where it was produced. The announcement was widely welcomed by environmental groups, the Nuclear Free Local Authorities and the Green and Liberal Democrat parties.Over the past two years Scottish Government officials have been consulting with stakeholders. The fact this consultation was almost entirely with regulators and the nuclear industry is reflected in changes to the original announcement that are likely to be widely questioned by the same people who initially supported the 2007 decision. It is now proposed that disposal of waste should be the preferred option, rather than storage, unless there are technical reasons why disposal of a waste stream is not possible. The concept of near-surface waste facilities has now been extended to depths of "tens of metres". The principle of waste facilities at or near where it is produced has also been widen to allow greater transport of material over longer distances. Surprisingly the Scottish Government has also revived a suggestion that storage or disposal facilities might be constructed under the seabed, but accessed from land. When this concept was proposed by the UK Government in the past there was considerable international opposition as its intended that any leakage would go into the marine environment. 'Export' of wastes to the UK or overseas is also explicitly allowed if treatment facilities are not available in Scotland.

Spain: Zapatero’s compromise.
As mentioned in issue 690 of the Nuclear Monitor, Spain's Socialist government, had to take a decision before July 5, on the future of Santa María de Garona, the countries oldest nuclear plant, which license expires in 2011. Spain’s Nuclear Safety Board (CSN) recommended a new 10-year license. Prime Minister Zapatero, promised in his election campaign to start a phase-out of nuclear energy. So he had to take a clear stand. It became more and more clear that he had not the guts to close the 38-year old plant, which provides 1.3 percent of Spain’s electricity, and was looking for a compromise. He decided to grant Garona a new license, but not for a 10 year period, but only for two years, so until 2013. Catch is that 2013 is after the next general elections. Noo one is pleased with this decision. The conservative Popular Party said it would overturn the government's decision if it wins the 2012 general elections. Environmental organizations and parties to the left – vital to Zapatero's governing coalition in Parliament – attacked the decision to postpone the closure of Garona and questioned the prime minister's credibility and integrity.

IAEA: Board Formally Appoints Yukiya Amano as Director General.
The International Atomic Energy Agency (IAEA) Board of Governors officially appointed Ambassador Mr. Yukiya Amano of Japan as the next Director General. Amano addressed the Board of Governors on July 3, following his successful bid to become the IAEA´s next Director General later this year. "I will dedicate my efforts to the acceleration and enlargement of the contribution of atomic energy to peace, health and prosperity throughout the world," he said.

The IAEA Director General is appointed by the Board of Governors with the approval of the General Conference for a term of four years. The General Conference meets in Vienna starting 14 September 2009. Ambassador Amano´s term as Director General would begin 1 December 2009.

Ambassador Amano, 62, is the Permanent Representative and Ambassador Extraordinary and Plenipotentiary of Japan to International Organizations in Vienna, and Governor on the IAEA Board of Governors. Amano is seen as the choice of the western industrialized countries. According to the IAEA he has "extensive experience in disarmament, non-proliferation and nuclear energy policy and has been involved in the negotiation of major international instruments." He has held senior positions in the Japanese Foreign Ministry, notably as Director of the Science Division, Director of the Nuclear Energy Division and Deputy Director General for Arms Control and Scientific Affairs.

In a notice published in the Federal Register, the Department of Energy (DoE) said that it had decided to cancel the GNEP (Global Nuclear Energy Partnership) programmatic environmental impact statement (PEIS) because it is no longer pursuing domestic commercial reprocessing, which was the primary focus of the prior administration's domestic GNEP program. Its decision follows a change in government policy on commercial reprocessing. Domestically, the GNEP program would promote technologies that support “economic, sustained production of nuclear-generated electricity, while reducing the impacts associated with used nuclear fuel disposal and reducing proliferation risks”. As yet, DoE has no specific proposed actions for the international component of the GNEP program. Rather, the USA, through the GNEP program, is considering various initiatives to work cooperatively with other countries. So far, 25 countries have joined the GNEP partnership.

Although the future of GNEP looks uncertain, with its budget having been cut to zero, the DoE will continue to study proliferation-resistant fuel cycles and waste management strategies. The Omnibus Appropriations Act of 2009 provides $145 million (105 million Euro) for such research and development (R&D). As described in the President Obama's 2010 budget request, the DoE's fuel cycle R&D's focus is on "long-term, science-based R&D of technologies with the potential to produce beneficial changes to the manner in which the nuclear fuel cycle and nuclear waste is managed." One outlet for this money is likely to be the Generation IV International Forum, which includes a research program on fast-breeder reactors, which in turn require reprocessing plants.

Greenland: continuation of the zero-tolerance policy towards uranium extraction. 
The government of Greenland has stated that the country’s stance on uranium mining remains clear and unchanged. Following a request from opposition party Atassut, Premier Kuupik Kleist ruled out opening up the possibility of broadening the policy towards the extraction of uranium as a by-product. The government pointed out that whilst it acknowledged the natural presence of uranium in Greenland, the 30-year-old policy of banning mineral extraction from areas with a high level of uranium content would continue to be disallowed. The issue emerged with the recent rejection of a mining proposal for Kvane Mountain, where the uranium content is so high that it is believed to be a potential risk to the residents of the nearby town of Narsaq, western Greenland. However, despite the zero-tolerance policy, areas where mining would involve extraction of uranium as a by-product within certain defined limitations would be allowed, according to Premier Kuupik Kleist.

Sweden: Ringhals under close scrutiny.
The Swedish Radiation Safety Authority (SSM) has placed the Ringhals nuclear plant, in the southwest of Sweden, under special supervision after a series (some sources say 60) of incidents, which could endanger the security at the nuclear plant. According to reports, the first incident occurred late in 2008 and involved the failure of an automatic safety system to switch on. The second, at the start of 2009, involved faulty control rods that are designed to regulate nuclear activity. The nuclear watchdog also cited weaknesses in how officials at the nuclear plant (operated by Vattenfall) carried out routines and how instructions were adhered to.

Ringhals' four reactors produce up to one-fifth of Sweden's electricity. It is not the first time that the SSM has placed a Swedish plant under special supervision. In July 2006, officials put the Forsmark nuclear plant under supervision after the shutdown of one of its reactors.

NSG Fail to Adopt Standards for Technology Trade.
The 46-member Nuclear Suppliers Group failed in its June meeting to adopt stricter rules governing the trade of technologies that can support nuclear-weapon development. According to Arms Control Today, NSG-member states had sought to establish specific standards for potential purchasers of equipment or technology that could be used to enrich uranium or reprocess spent reactor fuel. Standards proposed by the U.S. and Canada would address whether a potential state recipient of sensitive nuclear equipment has signed the Nuclear Nonproliferation Treaty and whether it has accepted the Additional Protocol to its safeguards agreement with the IAEA, according to sources familiar with the terms. The Additional Protocol gives U.N. inspectors access to more information about a signatory state's nuclear facilities and enables them to conduct snap inspections of the sites.

But concerns about the proposed criteria have been raised by other NSG members, including Turkey, Brazil, South Korea and South Africa, sources indicated. The proposed standards also include "subjective" criteria, including whether the sale could harm regional stability. Turkey has expressed concern that its nuclear purchases might be restricted if were deemed under the rules to be part of the volatile Middle East.

Sellafield (U.K.): 50 year leak stopped.
For about 50 years radioactive liquid has been leaking from a waste tank at Sellafield – but in June the operators, Nuclear Management Partners, said they had finally managed to solve the problem.

The leak was from one of four huge effluent tanks which held the waste before it was discharged into the Irish Sea. The leak from a crack in the concrete wall was first noticed in the 1970s and has contaminated not only a large area of ground but has resulted in contamination of the Sellafield beach. NMP said they had managed to empty 95 per cent of the radioactive sludge from the tank and it will now be treated as intermediate level waste. A spokesman said the tank had been a known environmental risk and its emptying was a great achievement.

France imports power.
France has been forced to import electricity from the UK this summer because of problems with its nuclear reactors. Fourteen of France's reactors use river water for cooling, rather than seawater, and there are regulatory limited on the temperature of water than can be discharged back into rivers.

Also the recent summer heat wave increased the river water temperature meaning it could not reduce the heat of reactor casings. The problems forced state-owned EDF to shutdown reactors. The company has encountered similar problems in the past.

USEC: “no loan guarantee; no enrichment plant”.
Usec could halt construction of its American Centrifuge Plant if the US Department of Energy (DOE) doesn’t give it a conditional commitment for a loan guarantee by early August. In a statement Philip Sewell, vice president of American Centrifuge and Russian HEU said a DoE decision is expected by early August. “As we have stated in the past, a DOE loan guarantee is our path forward for financing the American Centrifuge Plant. Therefore, we are making contingency plans for project demobilization should we not receive a conditional commitment or should a decision on a conditional commitment be further delayed, Sewell said. Demobilization, which would involve the partial or full halt of ACP activities and plant construction, could begin in August. So far Usec has invested $1.5 billion in the enrichment plant under construction in Piketon, Ohio. In February, due to the lack of certainty on DoE funding the company initiated cash conservation measures and delayed the ramp-up in hiring. It says it needs a loan guarantee to secure a substantial portion of the remaining financing needed to complete the project.

Italian Senate passed pro-nuclear law.
On July 9, after four readings in the upper house since November last year, the Italian Senate passed a bill which will pave the way for the return of nuclear power. The package, which also greenlights class action suits and the privatisation of state railways, was passed with an almost unanimous vote after the opposition Democratic Party and Italy of Values left the Senate in the hope that the legal minimum of votes required would not be reached. Under the new law, the government will have six months to choose sites for new nuclear energy plants, define the criteria for the storage of radioactive waste and work out compensatory measures for people who will be affected by the plants. A nuclear security agency will also be set up, although the actual building of the plants is expected to take years. Industry Minister Claudio Scajola said earlier this year that Italy would begin to build its first new generation nuclear power plant by 2013 and start producing energy by 2018. Italy abandoned nuclear energy after a 1987 referendum, one year after the Chernobyl accident.

Opposition politicians meanwhile slammed the new law. Roberto Della Seta, environmental pointman for the Democratic Party, said the cost of building four nuclear plants would be ''20-25 billion euros'', while they would contribute less than 5% to the country's energy consumption. ''This law ignores all the real problems that stand in the way of Italy having a renewable and efficient energy policy, such as closing the gap with other major European countries on renewable sources and promoting research into new technology,'' he said.

EU ministers rubber stamp weak nuclear safety rules.
On June 25, environment ministers meeting in Luxembourg rubber-stamped a Euratom Directive on Nuclear Safety. The law was meant to improve nuclear safety in Europe by setting EU-wide standards. However, the directive mainly refers to weak principles from the International Atomic Energy Agency (IAEA), which all EU countries are already bound to as signatories of the Convention on Nuclear Safety. Attempts to improve the independence of nuclear regulators have also been watered down. There is no provision in the directive to guarantee the accountability of nuclear regulators.

"There is nothing new in this law to improve nuclear safety in Europe. We are still faced with a nuclear industry that sees safety as an obstacle, rather than a paramount necessity," said Jan Haverkamp, EU nuclear energy expert for Greenpeace. Greenpeace calls on the EU to base its safety rules on the principles of best available technology and best regulatory practice.

Belgium bans investments in depleted uranium weapons.
On July 2, the Belgian Parliament unanimously approved a law forbidding investments in depleted uranium weapons. Belgium is now the first country to prevent the flow of money to producers of uranium weapons. This law complements the country's ban on their manufacture, testing, use, sale and stockpiling which came into force on June 21st last. The use of depleted uranium armour piercing munitions during combat causes the release of chemically toxic and radioactive particles which represent a long term hazard for the environment as well as for human health.

Senator Philippe Mahoux submitted the resolution in the Belgian Senate, where it was unanimously approved on the 2nd of April 2009. Approval in the Chamber of Representatives followed on the 2nd of July. The law forbids banks and investment funds operating on the Belgian market from offering credit to producers of armor and munitions that contain depleted uranium. The purchase of shares and bonds issued by these companies is also prohibited. This law implicates that financial institutions in Belgium must bring their investments in large weapon producers such as Alliant Techsystems (US), BAE Systems (UK) and General Dynamics (US) to an end. Only investments made via index funds, and the financing of projects of these companies that are clearly unrelated to cluster munitions will be allowed. The law also obliges the government to draw up a "black list" of uranium weapon producers.

India: National Alliance of Anti-nuclear Movements (NAAM) launched.
More than one hundred organizations, peoples’ movements and concerned citizens from across the country came together for a National Convention on “The Politics of Nuclear Energy and Resistance” on June 4-6, 2009 at Kanyakumari. They discussed all the different aspects of nuclear power generation and weapons production, the various stages of nuclearization from Uranium mining till waste management, and the commissions and the omissions of the government of India and the Department of Atomic Energy during the three-day-long convention.

Most importantly, nuclearism is a political ideology that cannot stomach any transparency, accountability or popular participation. It snubs dissent, denounces opponents and creates a political climate of fear and retribution. With the India-US nuclear deal, and the deals with Russia and France and likely private participation in nuclear energy generation, the situation is going to get out of hand in our country. The combination of profiteering companies, secretive state apparatuses and repressive nuclear department will be ruthless and this nexus of capitalism, statism and nuclearism does not augur well for the country. These forces gaining an upper hand in our national polity will mean a death knell for the country’s democracy, openness, and prospects for sustainable development.

In order to mobilize the Indian citizens against this growing nucolonization, to resist the nuclearization of the country, and to protect our people from nuclear threats and the environment from nuclear waste and radiation, an umbrella organization (tentatively named as the National Alliance of Anti-nuclear Movements) has been founded with eight committees on Documentation, Economic Analysis, Legal, Mass Media, International Liaison, Translation, Health, and Direct Action.
