UK uses bullying tactics to save Hinkley

UK Prime Minister David Cameron has threatened to retaliate over Austria's plans to mount a legal challenge to the Hinkley Point nuclear project, according to a document written by Vienna's ambassador to London. Britain's concerns are highlighted in Mr Eichtinger's account of a meeting with Vijay Rangarajan, a senior official at the Foreign Office. According to the letter, the UK has said that it could retaliate in several ways, with officials working on a "systematic creation of countermeasures" against the country.1

Austria confirmed that it would launch a legal challenge against the European Union's (EU) decision to allow billions of pounds of subsidies for Hinkley on 21st January.2

The UK could retaliate by mounting a legal challenge to Austria's electricity (source) labelling on the basis that this breaches common market rules. It could also apply pressure on Austria to shoulder a higher burden in EU "internal effort-sharing" in the bloc's transition to a low-carbon economy. Britain could also begin an investigation into whether Austria's suit violated the Euratom treaty on nuclear power.

Doug Parr, chief scientist at Greenpeace, criticised the government for bullying the Austrians for daring to question the "huge and wasteful energy project", which would raise bills for British consumers. Thankfully the Austrian Government has said it won't be intimidated by threats.3

A spokeswoman for Mr Cameron said he believed that Britain had the right to choose its own energy mix. The UK government said it had no reason to believe that Austria was preparing a legal case that had any merit.4 On the other hand Dr Dörte Fouquet, a lawyer for the Brussels-based law firm Becker Büttner, which specialises in energy and competition law, said she thought that Austria's chances of success were "pretty high."5 And as the Nuclear Free Local Authorities pointed out in letters to the Guardian and Independent, if Hinkley Point goes ahead, with a £17 billion state aid package between the UK Government and EDF Energy, it could see other EU states like the Czech Republic, Poland and Slovakia − all close to Austria − seek to replicate such contractual operations for their own new nuclear ambitions.

It is important to note in 2006 the then Chancellor Alasdair Darling said it will be up to the private sector to "initiate, fund, construct and operate" the nuclear plants. And the UK Coalition Agreement between the Tories and Liberal Democrats allowed the Government to promote the construction of new nuclear reactors provided they receive "no public subsidy".

Councillor Mark Hackett for the NFLA says the UK Government's churlish response is mainly due to it knowing that the writing is on the wall − Hinkley Point will be subject to another long delay, and this makes it ever less likely to be built. Austria should be commended for bringing us to our senses and forcing us to see the necessity of a quite different low carbon strategy; where renewables, energy efficiency and decentralised energy can become the norm.

Investment decision delayed

The Times reported on February 7 that an investment decision would be delayed until several months after the general election because the project's Chinese backers have demanded that the French government protect them if it goes bust.6 The Chinese were reported to have serious concerns about the EPR reactor design and are refusing to invest unless the French government promises to bail out Areva, if necessary, and cover their share of any cost overruns.

Complex negotiations involving British ministers, their opposite numbers in Paris, EDF Energy and the Chinese have been complicated still further by the legal challenge brought by Austria against Hinkley Point. Now EDF Energy is seeking assurances from the UK Government that if Austria wins the case and the project has to be abandoned halfway through, the company will receive compensation for the money invested up to that point.

At first, according to the Burnham-on-sea.com website, EDF Energy denied reports that an investment decision would be delayed until the Autumn. And the Stop Hinkley Campaign pointed out that if EDF Energy or the Chinese demanded any new financial guarantees these would require approval from the European Competition Commissioner.7

Just two days later, The Telegraph reported that EDF Energy appears to have abandoned its March 2015 deadline for making an investment decision and has warned that talks on the project may still take a "considerable" time. EDF described finalising agreement on Hinkley as a "major challenge" facing the company in 2015. EDF said that before it could take a decision it needed to sign deals with co-investors, gain European Commission and UK government approval of waste transfer contract arrangements, finalise a £10 billion loan guarantee from the Treasury and finalise a subsidy contract that was provisionally agreed with the UK Government in 2013.8

Earlier the Financial Times reported that several potential investors have backed away from the project despite the promise of a 35-year index-linked price guarantee backed by the UK taxpayer.9 The Kuwaitis, the Qataris, the Saudi Electric Company and even Hermes, the UK based investment fund, have all been mentioned as possible investors but none has signed up.

On top of all this Areva, the French, mainly State-owned company which would be the main equipment supplier, will have difficulty funding its expected 10% share of the project. Areva is struggling to survive the ongoing mess of the Olkiluoto nuclear plant in Finland, which is years behind schedule and billions over budget. Areva's losses in Finland are currently estimated at €3.9bn. The loss of Areva's share of Nuclear Management Partners Consortium's contract to decommission the Sellafield will not have helped.

Areva's share price has collapsed. It ended its market year with a decline of 52% as a result of financial difficulties caused by mismanagement, hazardous speculations and acquisitions, repeated technical fiascos (i.e. the EPRs in Finland and France), the regression of global nuclear market, and especially the cessation of the Japanese market since the Fukushima nuclear disaster.10

Chinese investment

Meanwhile, the government is refusing to say whether it has followed its own rules in allowing the Chinese to invest in Hinkley, citing questions of national security. Chinese involvement in UK energy schemes remains controversial, not least because of the historical links between its industry and the military. The National Security Council (NSC) is supposed to review critical projects. But ministers have consistently refused to say whether this has been the case. The BBC requested information, under Freedom of Information laws, about whether the NSC had discussed China's investment in Hinkley and if it had, whether it had been approved.

In a delayed response, the government confirmed the information was held by the Cabinet Office but refused to say whether the NSC had approved or even discussed China's expected 30−40% stake. Labour MP Dr Alan Whitehead, a member of the Energy and Climate Change Committee, said the government's refusal to say whether it had followed its own rules was "not acceptable".11

Nuclear-free Austria stops import of nuclear electricity

Austria’s people decided in a national referendum in 1978 against the start-up of the nuclear power plant in Zwentendorf, which resulted in a constitutional law (Bundesverfassungsgesetz Atomfreies Österreich, 1998). On the other hand, Austrian utilities recently imported large amounts of “dirty” electricity, in particular from the Czech Republic as well as from Germany – including at least 5 % of nuclear electricity.

Electricity in the EU can be traded separately from its guarantee of origin. On the first impression, this system sounds complicated as it makes the process of trading much more complex (issue of certificate, trading of certificate and cancellation of certificate as well as de-labelling the original source of the certificate). On second thoughts the system is simply not working – the general idea of electricity certificates was that by making certificates (guarantees of origin) tradeable separately from the electricity itself, extra revenue would be generated for renewable electricity and hence the investment in renewable energy sources would be supported. As the experiences with renewable electricity certificate systems show not just in the EU, but also in the US, there is no noticeable extra support for “new renewables” through this system, rather customers who are willing to pay a premium buy the renewable parts of the electricity mix, and in particular industry customers buy just anything they can get cheap, including nuclear electricity (as long as it is still heavily subsidized). Electricity certificates are mostly issued for renewable sources, but also for nuclear and fossil generation.

We started off from the position of thinking that electricity certificate systems in general are a stupid and not functioning system, but as there is no major overhaul to the system on the EU-level in sight, we thought it better to reform the system (on a national level) than to carry on lamenting, at the same time closing the worst loophole in the electricity certificate law for the import of nuclear electricity:

Legal aspects of (nuclear) electricity certificates
The Renewables Directive of the EU (2009/28/EC) defines in Article 15 that electricity certificates can be traded separately from the electricity itself. The Electricity Internal Market Directive (2009/28/EC) regulates in Chapter II, Article 9 consumers’ rights for fuel mix disclosure – it is the right of customers to know what sources of electricity they consume (and hence pay for / support).

There is, however, a major snag to this: as electricity can be traded separately from its certificate, electricity bought from an electricity exchange does not as such have a certificate / guarantee of origin with it. (The electricity exchanges account for small amounts of total trade, in the case of the German exchange 17 %, in the case of the Austrian exchange 7 % – most electricity is traded in direct, Over The Counter (OTC)-contracts.)

For electricity bought from the exchanges, the Electricity Internal Market Directive allows suppliers to use aggregated figures for the electricity exchange – an average value, an assumption about the average mix rather than precise figures. This of course contradicts the right of customers for full disclosure of fuel sources.

On the national level of the member states, it got worse: The Austrian Electricity law (Elektrizitätswirtschafts- und Organisationsgesetz 2010) provided in § 79.3 a major loophole for hiding unwanted amounts of electricity: If suppliers were unable (or unwilling) to purchase certificates for electricity, as is the case of electricity bought from the electricity exchanges without buying accompanying certificates, the suppliers could still sell this electricity and label it according to average European values, assumed from data for the previous year / statistics of the European Transmission System Operators (excluding electricity generated from renewable sources, as it was rightly assumed that this would not be sold at the electricity exchanges, but rather for a premium in direct Over The Counter-contracts).

The situation in Austria
With the advent of electricity market reform, Austrian utilities exported more and more “green” electricity (or green electricity certificates) to countries where consumers were willing to pay a premium for this – and selling electricity generated from fossil, nuclear or unknown sources to the Austrian industry (that consumes 57 % of electricity).

Most recent data (2010) show that 14,7 % of Austria's total electricity consumption was either bought from the electricity exchanges without any electricity certificate, or its certificate was sold separately (mostly hydro certificates to Germany). There was no legal requirement for suppliers to provide electricity certificates for all electricity, amounts without certificate were simply called "Strom unbekannter Herkunft" (electricity with unknown origin) in § 79.3 of the Electricity law.

This meant that traders could easily hide the fossil and nuclear parts of their fuel mix behind the smokescreen of "Strom unbekannter Herkunft" – they could even buy electricity from known (dirty) sources, sell it at the exchange and buy it back – whereby it lost its certificate.

The campaign
GLOBAL 2000 and Greenpeace CEE had been campaigning on this issue / “hidden” nuclear electricity in Austria for years. When the majority state-controlled utility “Verbund” started a massive advertising campaign in 2010 positioning itself as “100 % hydro”, GLOBAL 2000 started a campaign outlining that a 100 % subsidiary of Verbund sold almost entirely dirty electricity to the industry. After the Fukushima-events in March 2011, the campaign gained momentum and the Austrian government, eager to demonstrate change, agreed to ban nuclear electricity at a first summit with the two NGOs in June 2011. Quite predictably, some utilities opposed these moves, so the NGOs had to provide detailed legal and financial expertise that a) the proposed legal changes are sound on basis of European and WTO law and b) electricity prices would not skyrocket – the average price increase for labelling all electricity in Austria without nuclear certificates would be in a very modest range from € 0.13–1.95 per average household per year.

We were lobbying for a legally binding prohibition to import nuclear electricity or certificates, but this stalled as the ministry of economics was fiercely opposed to this: The minister argued this would be an infringement to Art 34 TFEU (Treaty of the Functioning of the European Union, Free movement of goods) – we argued: yes it would, but this can be justified by Art 194.2 TFEU – the right of member states of the EU to choose their energy sources, that came into force with the Lisbon treaties.

The NGO campaign was backed by Austrian anti-nuclear initiatives, the Austrian Chamber of Labour and the major tabloid in Austria, Kronenzeitung – this helped a lot. When finally even the Catholic Church (in the person of the Klagenfurt bishop) signalled that nuclear electricity imports should be stopped, on April 16th we finally managed to achieve at least a compromise as follows:

Results
1) Labelling: legally binding obligation for disclosure of all electricity that is consumed in Austria -- this includes households and industry as well as pumped-storage hydro (which consumes large amounts of electricity in Austria). The legal changes to the national electricity law will make it mandatory that the entire electricity supplied is labelled, i. e. that electricity can only be sold together with an electricity certificate, and “Strom unbekannter Herkunft” is not applicable any more for fuel disclosure. These changes to § 79.3 are to be drafted this year and come into force by 2015.

2) Nuclear certificates & electricity: Austrian utilities voluntarily exclude certificates and direct contracts from nuclear generation from their portfolio immediately (it would be economic suicide to market explicitly labelled nuclear electricity in Austria anyway). Österreichs Energie (representing the largest utilities in Austria) also agreed that on a voluntary basis they will already start labelling their entire electricity supply by 1.1.2013 for household consumers and the – much larger amounts – for industry by 1.1.2015.

3) Label: there will be a certification label by the (federal) Issuing Body E-Control, developed together with the NGOs, that guarantees that the utility does not use any nuclear electricity or nuclear electricity certificates.

4) Transit: as electricity labelling is consumer/disclosure-oriented, the proposed changes do not affect the transit of electricity through Austria.

Regarding electricity certificates: The Austrian issuing body only acknowledges four types of electricity certificates, three national certificates under RES-law and one international – the EECS-GO (European Energy Certificate System-Guarantee of Origin), where the issuing body is nominated by the state and conforms to fairly tight rules (to prevent double counting of certificates). This excludes systems (RECS, TÜV, ...) that are not as strict, are set up by market players or cannot exclude double counting, which of course immediately perverts the entire system.

The above is a compromise, but a reliable disclosure of all electricity sources is a big victory for the campaign. Lots of people were involved in this campaign, on the NGO-side Friends of the Earth Austria/GLOBAL 2000 & Greenpeace CEE as well as the ÖKOBÜRO legal experts.

If – as we hope – this campaign can be copied to other European countries, full disclosure can give consumers more power in choosing the clean electricity sources they want to consume – and avoiding the ones they do not wish to pay for any more, namely nuclear electricity.

Mochove: further delays and Bank Austria withdraws

Bank Austria, the Austrian subsidiary of the Italian UniCredit banking group, has confirmed that by mutual agreement it will terminate a financial facility granted to Slovenske Elektrarne (SE). SE will be the operator of the Mochovce nuclear reactors 3 & 4, currently under construction.

The confirmation of the Bank Austria withdrawal came after enquiries by Global 2000 (Friends of the Earth Austria) and Greenpeace Austria."Slovenske Elektrarne has boasted in public presentations that the credit provided by private banks for its ongoing operations were in fact indirectly used to build the scrap nuclear reactors at Mochovce," said Patricia Lorenz, nuclear campaigner for Global 2000. "This is in direct contradiction with assurances made by Bank Austria earlier on the use of their credit."

In a related development Mochovce NPP operator ENEL/SE also announced early March that the two nuclear units 3 and 4 will be completed one year later than previously planned. The construction of block 3 will now be completed by the end of 2013, and unit 4 not before the middle of 2014.

"We have warned the management of Bank Austria against this risky business for months and are pleased that our negotiations have now led to some results with the bank. The completion of Mochovce 3 and 4 is again pushed a bit further away," said Niklas Schinerl, nuclear expert for Greenpeace Austria.

The reactors planned for Mochovce 3 & 4 are Soviet-type VVER 440 2nd generation reactors, which are designed without a full containment building and cannot be upgraded. As such there is a higher probability of severe accidents and the release of radioactivity.

The building of Slovakia's Mochovce 3 and 4 nuclear reactors is the longest running nuclear construction project anywhere in Europe. The reactors were designed by the Soviet Union back in the 1970s. Construction began back in 1987 but in 1992, soon after the collapse of the communist regime, it was suspended. Economic studies in 2000 showed the project to be a financial disaster.

Although operating since the mid 1980s in the Czech Republic, Slovakia and Hungary, four of the same model of reactor as Mochovce 3 and 4 under construction in East Germany, were cancelled in 1990 after the German re-unification because the reactors did not meet basic safety standards.

Russia is the only supplier of nuclear fuel for this type of reactor which makes a mockery of the idea that nuclear power provides energy security. An estimated 22 tonnes of spent nuclear fuel is generated by each reactor every year.

The investment required to build Mochovce 3 and 4 is expected to reach 2.775 billion euros. This will devour a massive 77% of SE's investment for new electricity generation 2007 to 2013. Due to the high financial risks for investors, the Slovak government provides generous state aid that is very likely illegal under EU legislation.

"The credit freeze and construction delay are new hurdles for SE and signal a victory in the fight against the building of these reactors" said Yann Louvel, climate and energy campaign coordinator for BankTrack. "As all banks financing SE know, money is fungible. They should do the same as Bank Austria and close down their credit lines with Slovenske Elektrarne to prevent the completion of Mochovce 3 and 4". BankTrack is the global network of civil society organisations targeting the operations and investments of large, international operating  commercial banks.

Germany exporting electricity to France.
Germany has shut down many nuclear power plants after Fukushima. France, in contrast, has still a very large nuclear capacity. So one might expect (and that was highlighted by nuclear proponents in Germany and elsewhere many times) that Germany needs "to pull some power from the reliable French nuclear plants" to make up for the fact that German solar power is not contributing anything in this season. But that's not exactly what happened during the cold winter days in western-Europe early February. Though the day is short, PV power production is still peaking at an impressive level during the current cold spell in Germany.

Because France has so much nuclear power, the country has an inordinate number of electric heating systems (but what is cause and effect?). And because France has not added on enough additional capacity over the past decade, the country's current nuclear plants are starting to have trouble meeting demand, especially when it gets very cold in the winter. With each drop of 1 degree in the temperature, the demand for electricity rises with 2,300 MW. In the French Brittany, citizens were asked by EDF to reduce their consumption.

As a result, power exports from Germany to France reached 4 to 5 gigawatts – the equivalent of around four nuclear power plants – early February according to German journalist Bernward Janzing in a Taz article. And it was not exactly a time of low consumption in Germany either at 70 gigawatts around noon on February 3, but Janzing nonetheless reports that the grid operators said everything was under control, and the country's emergency reserves were not being tapped. On the contrary, he reports that a spokesperson for transit grid operator Amprion told him that "photovoltaics in southern Germany is currently helping us a lot."

UK: the powers that be.
Newly appointed Energy Secretary Ed Davey performed a spectacular U-turn on nuclear power, February 5, as he declared he would not block plans for a new generation of nuclear reactors. Liberal Democrat Davey was appointed to the Cabinet post on February 3,  after Chris Huhne resigned to fight criminal charges. In the past, Davey has condemned nuclear power as dangerous and expensive. As Lib Dem trade and industry spokesman in 2006 Mr Davey was the architect of the party's anti-nuclear policy. He launched the policy with a press release entitled "Say no to nuclear", which warned a new generation of nuclear power stations would cost taxpayers tens of billions of pounds. What's that with being in power and changing positions?

Ed Davey used his first day as Energy Secretary to send a warning to more than 100 Conservative MPs that he is not prepared to back down over the issue of onshore wind farms. He insisted he was a 'lifelong supporter' of wind power.

Australia: Ferguson's Dumping Ground Fights Back.
The Gillard Government is pushing ahead with plans to host a nuclear waste dump at Muckaty in the Northern Territory (NT), despite local opposition. Traditional Owners have vowed to fight on, according to Natalie Wasley. In February 2010, Resources Minister Martin Ferguson introduced the National Radioactive Waste Management Bill into the House of Representatives, saying it represented "a responsible and long overdue approach for an issue that impacts on all Australian communities". The legislation names Muckaty, 120 kilometers north of Tennant Creek in the Northern Territory, as the only site to remain under active consideration for a national nuclear waste dump. The proposal is highly contested by the NT Government and is also being challenged in the Federal Court by Traditional Owners. Despite this, the Bill is currently being debated in the Senate — and will likely pass.

Ferguson’s law is a crude cut and paste of the Howard government’s Commonwealth Radioactive Waste Management Act that it purports to replace. It limits the application of federal environmental protection legislation and it curtails appeal rights. The draft legislation overrides the Aboriginal Heritage Protection Act and it sidesteps the Aboriginal Land Rights Act. It allows for the imposition of a dump on Aboriginal land with no consultation with or consent from Traditional Owners. In fact, the Minister can now override any state or territory law that gets in the way of the dump plan.

Before it won government, Labor promised to address radioactive waste management issues in a manner that would "ensure full community consultation in radioactive waste decision-making processes", and to adopt a "consensual process of site selection". Yet despite many invitations, Martin Ferguson refuses to meet with Traditional Owners opposed the dump.

Medical professionals have called for federal politicians to stop using nuclear medicine as justification for the Muckaty proposal. Nuclear radiologist Dr Peter Karamoskos wrote in the NT News:

"…the contention that is most in error is that the radioactive waste to be disposed of there is largely nuclear medicine waste. Nearly all such waste is actually short-lived and decays in local storage and is subsequently disposed of safely in the normal waste systems without need for a repository. The vast bulk of the waste… is Lucas Heights nuclear reactor operational waste, and contaminated soil (10 thousand drums) from CSIRO research on ore processing in the 1950s and 1960s."

US: Watts Bar 2 schedule pushed back.
The Tennessee Valley Authority (TVA) has said that it is ‘experiencing challenges’ with the cost and schedule for completion of its Watts Bar 2 nuclear power plant. The revised completion date for the plant may extend beyond 2013 and the costs are expected to ‘significantly exceed’ TVA’s previous estimate of US$2.5 billion. TVA, which operates three nuclear power plants: Browns Ferry, Sequoyah and Watts Bar, decided to restart construction at Watts Bar 2 in 2007. It originally planned to finish the plant, which was 55% complete, within a five year window. Now, the completion date has been put back to 2013 and TVA says it is performing a root cause analysis to better understand the factors contributing to the project's extended schedule and cost. According to TVA the delays to the completion of Watts Bar unit 2 may also affect the timing of the Bellefonte 1 completion. Construction is set to resume at Bellefonte 1 after initial fuel loading at Watts Bar 2. (More in Nuclear Monitor 732, 9 September 2011).

Russia: Fire at nuclear sub at Murmansk
Russia’s deputy prime minister in charge of the defense industry Dmitry Rogozin has indirectly admitted that the Yekaterinburg – one of the Northern Fleet’s strategic nuclear submarines – which caught fire on December 29 while in dry dock for repairs near Murmansk had “armaments” on board when the 20-hour-long blaze broke out, injuring 9. The deputy prime minister had previously vociferously denied this in both Russian and international media – even though evidence discovered by Bellona at the time suggested otherwise. Evidence that has emerged since the fire, however, suggests that the burning vessel was loaded not only with nuclear missiles but torpedoes as well.

The Yekaterinburg Delta IV class submarine – capable of carrying 16 intercontinental ballistic missiles with up to ten nuclear warheads apiece and 12 torpedoes – caught fire in Roslyakovo when welding works reportedly went awry, though the real cause of the fire remains unknown. The fire was concentrated in the bow area of the vessel.

Had Russia’s Emergency Services Ministry –which was primarily responsible for handling the crisis– not extinguished the flames in time, the torpedoes in the front chamber of the submarine would have detonated first. Many Russian fire and resuce workers would have been killed and the blaze’s intesity would have increased. The fire would have spread to the missile compartment, which also would have detonated as a result of the high temperatures. An explosion would have then damaged the Yekaterinburg’s two nuclear reactors, resulting in a release of radiation into the atmosphere.

Murmansk (300,000-strong population, just 6 kilometers away) should have been evacuated along with other towns in the surrounding area. The fire occurred just prior to Russia’s New Year’s holidays, and an evacuation would have causes panic and chaos. Yet had things gone as they very possibly could have, even more explosions releasing more radioactivity could have resulted, making – as shown in Fukushima – efforts to extinguish the fire even more arduous, as radioactivity continued to spread.

No More 'hot' waste in WIPP.
On January 31, the New Mexico Environment Department denied a federal Department of Energy's  request for permission to use new lead-lined drums for some of the more highly radioactive waste being shipped to the Waste Isolation Pilot Plant (WIPP) (see Nuclear Monitor 739, 23 December 2011). DOE applied to the New Mexico Environment Department for a modification of the hazardous waste permit in order to dispose of "shielded containers" of remote-handled (RH) waste. The shielded containers, which have never been used before, are lead-lined in order to contain the high gamma emissions from the RH waste. DOE was proposing to bring more "remote-handled" plutonium-contaminated waste to WIPP than will fit in the remaining designated space. It is another attempt by DOE to expand the mission of WIPP beyond its original purpose.

But the NMED denied the request. The denial does not close the door on the possibility, but the Environment Department said a more detailed review, likely including the possibility of public hearings, would be required before any change is permitted.

UK report: "A corruption of Governance?".
Parliament was kept in the dark and fed false information that boosted the case for nuclear power, campaigners claimed in a newly released report "A Corruption of Governance?" on February 3, 2012. MPs were handed a dossier which suggests that evidence given to ministers and Parliament promoting the use of nuclear power was "a false summary" of the analysis carried out by governmental departments. Specifically the report claims that on the basis of the government's own evidence there is no need for the controversial new generation of nuclear power stations if Britain is to achieve 80 per cent reductions in carbon dioxide by 2050. The report also alleges that government statements claiming that electricity supply will need to double or even triple in order to achieve a low-carbon economy are disproved by its own evidence. Katy Attwater, Stop Hinkley Point's spokesperson, said: "This scrupulously researched report shows that two of the National Policy Statements, EN-1 and EN-62, approved by Parliament, are based on false information and the public has no alternative but to deem them invalid. MPs have, likewise, no alternative but to consider them fraudulent, re-open the debate and bring those responsible for this corruption to account."

The EPR nuclear reactor: A dangerous waste of time and money.
The French EPR (European Pressurised Reactor, sometimes marketed as an ‘Evolutionary Power Reactor’) is a nuclear reactor design that is aggressively marketed by the French companies Areva and EDF. Despite the companies’ marketing spin, not only is the reactor hazardous, it is also more costly and takes longer to build than renewable-energy alternatives. While no EPR is currently operating anywhere in the world, four reactors are under construction in Finland (Olkiluoto 3, construction started in 2005), France (Flamanville 3, 2007) and China  (Taishan 1 and 2, 2009-10). The projects have failed to meet nuclear safety standards in design and  construction, with recurring construction defects and subsequent cover-ups, as well as ballooning costs and timelines that have already slipped significantly.

'The EPR nuclear reactor: A dangerous waste of time and money' is an update of the 2008 Greenpeace International briefing on this reactor. Added are some of the many new design and construction errors and the economic setbacks the EPR has run into. Greenpeace included more information on the tremendous gains in the cost performance of renewable energy and the increase level of investment.

Austrian NGOs: Ban on import nuclear electricty!
At a February 3, meeting with German, Czech and Austrian anti-nuclear activists in Passau, Germany, including members of The Left Party (Die Linke) faction in the German Bundestag and from the Ecological Democratic Party (ÖDP), support for an Austrian import ban on nuclear electricity was clearly signalled. Spokeswoman for the Left Party Eva Bulling-Schröter: "It is absurd that Austria, which for very good reasons abandoned nuclear energy, is exporting clean hydropower to Germany for instance and then imports nuclear power for its own use. The planned and very controversial new Czech Temelin reactors would loose important custumors if Austria and Germany woud ban the import and not buy its electricity. The campaign of the Austrian antinuclear groups is welcome and could be a model for a similar campaign in Germany."

No-nuke EU member state coalition in the making

For more than a decade, the idea that EU non-nuclear member states should cooperate to try to phase out nuclear power in Europe has haunted anti-nuclear activists, green politicians and lobbyists from the clean energy sector. In spite of the obvious benefits such cooperation might bring, nothing ever happened. However, the catastrophic events at the Fukushima Daiichi nuclear power plant might have changed that: At a meeting in Vienna late May, representatives of eight European non-nuclear countries decided to form a coalition to combat climate change and develop sustainable energy sources without relying on nuclear power.

On May 25, ministers and heads of delegations of Austria, Greece, Ireland, Latvia, Liechtenstein, Luxembourg, Malta and Portugal signed a common declaration [1] to be presented at the next meeting of the EU Environment Council on 21 June in Luxembourg. Among the principal issues under discussion were the environmental aspects of nuclear power and the potential for phasing it out in Europe. The eight countries emphasised their view that nuclear power is not compatible with sustainable development and that it is not a means to combat climate change. They also stressed the need to draw the lessons from the events in Japan in European energy policy. Among others, this means implementation of the highest possible standards for nuclear safety - including closure of nuclear reactors that cannot be upgraded within a reasonable time frame; but also that renewable energy and energy conservation must play a major role in the future.

Probably the real thing
Considering that it is not the first attempt to form an alliance against nuclear power, it seems appropriate to take critical look at its viability. Back in 2007, environment ministers from eight European countries launched a similar initiative to reduce the role of nuclear power in European climate policy and published a declaration much like the one from Vienna [2]. However, even though the initiative included large countries such as Germany and Italy and even non-EU member states such as Norway and Iceland, it quickly petered out. So what are the prospects of success this time around and what could be the role of the coalition?

At least three things are different - two of them beneficial for a no-nuke coalition and the third more complex: The first is of course the Fukushima disaster, which will not disappear any time soon and continues to undermine the so-called nuclear renaissance. The second is that Germany – the biggest economy in Europe – recently re-decided on a relatively quick nuclear phase-out, substituting nuclear with renewable energies. It is reasonable to assume that Germany, not to be put in a position of disadvantage, will be forced to strike a blow for renewables at the European level at the expense of nuclear power. Germany’s main priority will probably not be improvement of nuclear security or safety or environmental issues, but the need for a level playing field for renewable energy sources in the European energy markets. This could increase the pressure to reform or abolish the Euratom Treaty, which is considered the backbone of the European nuclear support infrastructure. In all circumstances, the probability of the no-nuke coalition having an impact will increase because of this development.

The coalition must walk on two legs
The third factor is that the coalition is not only a no-nuke, but also a non-nuclear coalition. None of the member states involved in the initiative have nuclear programs. This might warrant a common outlook, but at the same time constitutes an obvious weakness: The political capital needed to develop and push for a coherent policy on nuclear issues outside of the countries’ own borders is very small, considering that there is very little domestic interest in this subject. Furthermore, virtually no green NGOs in these countries have nuclear power on their agenda, so both the general level of motivation and knowledge is low. The only exception is Austria, whose NGOs and shifting governments have over the years taken a keen interest in the nuclear policies of its neighbouring countries and in Europe. It is not coincidental that the concept of a coalition of no-nuke EU member states was developed in Austria in the nineties [3].

On the plus-side, it must be recognised that the coalition constitutes an immense leap forward. Counting in the three countries that participated in the Vienna meeting as observers, but did not sign the declaration - Cyprus, Estonia and Denmark – the coalition covers 40 per cent of all EU member states. Its greatest asset could be its capability to transform into a coalition that is able ‘to walk on two legs’. This would imply putting together a political package combining nuclear issues of moderate political appeal – at least in non-nuclear countries - with issues pertaining to renewables that potentially could attract a lot of attention. Reforming or abolishing nuclear support infrastructures is not possible without at the same time developing an institutional framework furthering renewable energy sources. This might open the door for the newly developed concept of a European Community for Renewable Energy (ERENE) [4]. Such a community could be established on the basis of existing EU treaties as a co-operation between at least nine member states or on a new, separate treaty alongside EU and Euratom.

In all circumstances, we will know more when the coalition has its next meeting in Athens in the fall.

Austria: referendum on Euratom membership

In January 2007 five organizations expressed their discontent with the role of Austria within Euratom, the European Union’s nuclear energy authority. The press conference was held in Vienna with Greenpeace, Umweltdachverband, Global 2000, Salzburger Plattform gegen Atomgefahr and Atomstopp – and they all demanded that Austria should unilaterally withdraw its membership from Euratom if Austrian politicians are not willing to enforce the Austrian antinuclear consensus within Euratom. “Out of Euratom” became the slogan.

All five organizations, participating in the "Raus aus Euratom" campaign, agreed: Euratom is undemocratic because it excludes the European parliament from decisions on nuclear issues. Because all struggles for a Euratom revision conference failed, single countries should come up with initiatives to leave the Euratom-treaty.

The Austrian organizations were deeply frustrated that despite the Austrian antinuclear consensus in the population and the legendary fight against nuclear power plants near Austrian borders like Temelin in the Czech Republic, Mochovce in Slovakia or Isar 1 in Germany, the decisions of Austrian politicians in Brussels did not reflect this rejection of the population on nuclear energy.

Anyway – the press conference in January 2007 later turned out to be the beginning of a campaign having lasted now for more than four years, bringing together regional parliaments, municipalities, organizations, churches – with the demand to leave Euratom. So by gaining strength on the one hand, the campaign was more and more discussed, became  controversially and was attacked on the other hand. Atomstopp also had to face financial cuts being the driving force behind the campaign.

The campaign “Out of Euratom”
Starting with five organizations the campaign “Out of Euratom” comprises now 86 organizations with various background: antinuclear, renewable energies, ethics, environment – even the Catholic and the Evangelic Church in Upper Austria gave favorable statements on the campaign – showed solidarity with the demand that Austria should also leave Euratom because the membership of an organization that promotes the nuclear industry is not compatible with the Austrian rejection of nuclear energy. Opinion polls showed that in 2006 63% of Austrian population was in favor of a unilateral withdrawal from Euratom – in 2008 that number already rose to 78%. While 81% disapprove that Austria supports the European nuclear industry financially.

177 municipalities throughout Austria strengthened the campaign “Out of Euratom” by resolutions to the Austrian government saying with the end of the Austrian Euratom membership the financial means formerly spent on the nuclear industry should be transferred to renewable energies.

All nine regional parliaments in Austria treated the Euratom membership in critical resolutions, expressing at least their wish to prepare the requirements for a unilateral withdrawal from Euratom if a Euratom-revision conference is unlikely in the near future.

In the last four years the opposition parties in the Austrian parliament brought eleven (11!) applications on an unilateral withdrawal from Euratom – another eleven (11!) inquiries were addressed by the opposition parties to the Austrian government on the financial aspects of the Euratom membership and the question “how much pays Austria for its nuclear membership”?. The Austrian government refused all applications in parliament. Also the inquiries on the financial aspects remained unanswered.

The government did not show any motivation to end Austrian membership of Euratom and did not show any motivation to bring antinuclear aspects to Euratom.

Position of the Austrian government
Confronted with the demand for a unilateral withdrawal from Euratom, the Austrian  government says that (a) a unilateral withdrawal is not possible for legal reasons, (b) will result in a more pro-nuclear Europe as Austria does no longer take part in nuclear decisions, (c) the financial means of Euratom are mainly spent on fusion and safety issues, (d) Euratom covers vital aspects as radiation protection and non-proliferation of fissionable material and (e) Austria is and will always be keen on a Euratom revision conference.

These arguments are very weak when analyzing the influence of Austria on the European nuclear policy in the last 15 years. There is already a pro-nuclear Europe – even with Austrian Euratom-membership: the Euratom budget was trippled in 2006 – with Austria's approval! And Austria's representative in Brussels did not hesitate in summer 2010 to give his OK for another 1400 million euro to cover the additional costs for the planned fusion reactor ITER in Cadarache. Austria gave its approval also for weak directives on safety of nuclear installations (2008) and did not show any discontent with the controversial directive on nuclear waste disposal (2010). With Austria's approval 223,5 million euro were granted as a Euratom loan for the completion of the Romanian nuclear power plant Cernavoda (2004) – and by the way: Austria's radiation protection was more rigorous before the Euratom-membership.

For the legal possibility of a unilateral withdrawal from Euratom see: Heinz Stockinger – Euratom: Countries free to step out. (Nuclear Monitor 658, 13 July 2007, p. 4). With the Lisbon Treaty being in force since December 2010 the possibility of a unilateral withdrawal is seen in Art. 50 with a reference to Art. 106a of the Euratom treaty. And those in favor of a Euratom-revision conference have to remember that one single Euratom member state can block any initiative. Who really expects France, or Great Britain, or the Czech Republic to allow any changes of the Euratom treaty as it is still their basis and legitimation for their nuclear programs?

To sum it up: If Austrian politicians made, and encouraged, a strong anti-nuclear policy within Euratom there would be no need for a campaign like “Austria -  Out of Euratom”. In such a case, all antinuclear organizations would be happy with the Austrian politicians and would have supported them in their struggle against the nuclear industry in Europe. Or will this remain a naive dream? Is it realistic to think Euratom will allow antinuclear positions? Is it realistic to hope to change Euratom from inside? Reality – and the experience of the past 15 years - shows a different picture.

The referendum
After four years campaigning, there is no sign that the Austrian government is willing to deal with the demand of regional parliaments, with the demand of the opposition parties, with the demand of 86 organizations joining the campaign and with the call from municipalities: “Out of Euratom”. A government not willing to meet NGO demands is a very common counterpart and in fact one of the reasons why we work on this topic in the first place, so to stop the campaign, as some suggested, was no option. Atomstopp_Upper Austria had no choice than to bring the campaign to a next level.

Because the Austrian government continues to ignore the demands of regional parliaments, organizations and municipalities, it was decided by atomstopp Upper Austria in spring 2010 to start with the preparation-work for a referendum on this issue to bring direct pressure on the government – direct pressure from the Austrian population. Starting the preparation-work turned out to be the end of some funding: one of the organizations stopped financial support for the "Out of Euratom" campaign.

Within a few months it was possible to collect 8.032 signatures (confirmed by municipalities) necessary to launch the referendum. Municipalities were part of this first (launching) phase. In every third municipality in Austria people signed the referendum in this phase. All political parties from the right (freedom party) to the left wing (communist party) supported this phase. Green groups supported it, mayors from the people's party supported it, too. And the socialist party in Upper Austria gave a strong signal: all delegates signed the referendum already in the launching phase, too.

100,000 signatures needed
During eight days between February 28 and March 7, it will be possible throughout Austria to sign the “Out of Euratom” referendum. When the referendum gets more than 100.000 signatures the parliament has again to handle with the demand. With this referendum we want a commitment from the Austrian government to follow the outcome and end the Austrian membership of Euratom. The unilateral withdrawal of Austria from Euratom can be the start of a Europe-wide campaign – with affects on the European nuclear and anti-nuclear policy. Every member state of the European Union should have the choice either to finance nuclear industry via Euratom or finance renewable energies.

Utility tries to 'block' sun in Hawaii.

In a popular Simpsons episode, the diabolical Mr. Burns builds a giant disc to eclipse the sun and force Springfield's residents into round-the-clock reliance on electricity from his nuclear power plant. It's pitch-perfect cartoon sarcasm, but with a foot firmly in reality: the fledgling U.S. solar industry faces an array of Burnsian obstacles to its growth across the country.

In Hawaii, for example, the state's largest utility Hawaiian Electric Company (HECO) is making a blatant effort to block homes and businesses from installing rooftop solar panels, a move that could strangle Hawaii's burgeoning homegrown solar industry, prevent residents and businesses from saving money, and keep the state addicted to imported oil. If there is anywhere that should be blazing the trail to a clean energy future, it is Hawaii. The islands are blessed with abundant sun, winds, and waves, yet today rely on imported fossil fuels for more than 96 percent of their energy. Hawaii consumers pay the highest electric rates in the nation. The state is trying to chart a new course, but the utility is resisting change and fighting to limit solar access to the local grid.

In so doing, HECO is holding back much more than just Hawaii. It is hindering an important experiment with solar energy that could provide valuable information to consumers, entrepreneurs, utility owners and policymakers throughout the U.S., because the program Hawaii is considering is the feed-in-tariff.

German minister lifts 10-year ban on Gorleben.

The political and technical battle over the fate of Germany’s repository for high-level nuclear waste accelerated, as German Environment Minister Norbert Roettgen announced he was lifting the 10-year moratorium on investigation of the Gorleben salt dome in Lower Saxony. The moratorium was declared in 2000 as part of the nuclear phase-out agreement between the nuclear industry and the then Socialist-Green government. On March 15, Roettgen promised "an open decision-making process and a safety analysis that would be subjected to international peer review". The Gorleben opponents allege that the government plans to privatize nuclear waste storage. "If these plans are implemented, those producing the waste would also be in charge of determining its ultimate repository,” the opponents argue.
Gorleben has been under consideration for the disposal of high- and intermediate-level waste and spent fuel since 1977, when it was selected by the Lower Saxony government as the only candidate for investigation, in a process that is still criticized for eliminating alternative sites too early. A total of about 1.5 billion Euro (US$2 billion) was spent on the site investigation between 1977 and 2007. Opponents have just presented to the media a CD compilation of leaked government documents from the 1970s and 1980s showing that expert studies showing Gorleben to be unsuitable were simply ignored.

First spontaneous protests about the resumption of work have taken place in Gorleben.
Immediately after the announcement of lifting the moratorium, some 300 people demonstrated and were forcibly evicted by the police using pepper spray. At the same day some 5.000 people demonstrated at the Neckarwestheim nuclear power plant in southern-germany against possible life-time extension. It was the biggest demonstration at the plant in over 20 years. The national anti-nuclear power movement is gearing up for Chernobyl day, when demonstrations in Biblis (southern Germany), Ahaus (middle Germany) and a 120 km (!) human chain in northern Germany will take place to show massive popular resistance against nuclear power.

Sellafield: Radioactive birds.

Seagull eggs at Sellafield (U.K.) are being destroyed in an attempt to control bird numbers because of fears they might spread contamination after landing and swimming in open nuclear waste ponds. Sellafield said the pricking of eggs was reducing gull numbers around the site and stressed there was no public health concerns. However Cumbrians Opposed to a Radioactive Environment (CORE) said the gulls could fly well away from the site and spread contamination. In 1998 there was a cull of pigeons because they landed on buildings around Sellafield and spread contamination off-site. One garden in Seascale had its soil declared as low level waste because of the problem.

S-Korea to build nuclear reactor in Turkey? 

On March 10, an agreement was reached between Turkey's state power company Elektrik Uretim (EUAS) and Korea Electric Power Corp (KEPCO), a state-controlled utility, on technical studies for the construction of a nuclear power plant to be built in Sinop, on Turkish northern coast of Black Sea. The South Korean company had earlier said it was in talks with Turkey to sell APR1400 (Advanced Power Reactor 1400), pressurized water reactor. Turkey, again, plans to build two nuclear power plants, one in Sinop on the northern coast of Black Sea and the other in Mersin on the southern coast. Construction of nuclear infrastructure could start in the short-term, said South Korean Deputy Prime Minister Young Hak Kim, speaking at a Turkish-South Korean business conference in Istanbul.

Turkey has long been eager to build nuclear power plants. A Turkish-Russian consortium led by Russia's Atomstroyexport had been the only bidder in a 2008 tender to build Turkey's first nuclear power plant in Mersin. However, Turkey's state-run electricity wholesaler TETAS canceled the tender following a court decision in November 2009. (See Nuclear Monitor 698, 27 November 2009: "Another setback on Turkey's nuclear dream"). Turkey has cancelled four previous attempts to build a nuclear plant, beginning in the late 1960s, due to the high cost and environmental concerns.

RWE: U.K. hung parliament danger for new reactors.

RWE chief executive designate Volker Beckers has warned that a hung Westminster parliament following the forthcoming election could threaten the prospects of new reactors being built in the UK. He said a hung parliament might make it inconceivable that utility companies would invest the huge sums needed to build the reactors. The Liberal Democrats opposed any new reactors and they might be involved in a new government, he said.

A 'hung parliament' is one in which no one political party has an outright majority of seats. This situation is normal in many legislatures with proportional representation, or in legislatures with strong regional parties; in such legislatures the term 'hung parliament' is rarely used. However in nations in which single member districts are used to elect parliament, and there are weak regional parties, such as the United Kingdom, a hung parliament is a rarity, as in these circumstances one party will usually hold enough seats to form a majority. A hung parliament will force either a coalition government, a minority government or a dissolution of parliament.

Pakistan: US-India deal forces it to keep making weapons material.

Pakistan cannot participate in global negotiations to halt the production of high-enriched uranium and plutonium for nuclear weapons because the US-India nuclear cooperation agreement has tilted the regional strategic balance in India’s favour, a leading Pakistani nuclear diplomat said February 18. Zamir Akram, Pakistan’s Ambassador to the Conference on Disarmament in Geneva said that under the US-India deal on nuclear cooperation, India may now import uranium under IAEA safeguards for its civilian power reactors. Because of that, India can devote its domestic uranium resources to production of fissile material for nuclear weapons, he said.

Last year, the Nuclear Suppliers Group, NSG, representing 45 members of the Nuclear Non-proliferation Treaty, NPT, agreed to lift nuclear trade sanctions against India, a non-NPT party. That action permitted the US-India deal to enter into force. In coming months, the US-India deal will most likely cause friction at the 2010 NPT Review Conference. Every five years, the NPT’s 189 parties hold such a review conference. The 2005 event was bbitter and sharp in language and tone and resulted in no consensus conclusion between developing nations and advanced nuclear countries. How to deal with Israel and Pakistan (non-NPT-parties) in the wake of the US-India deal now deeply divides non-proliferation and disarmament advocates.

Not only is this a totally daft idea with heavy consequences, but it also diverting attention and investment way from the real solutions to climate chaos. Come and join us for a weekend of protest, networking and skill sharing. The camp will be held very near the existing power stations and the weekend will include a tour of the proposed site for Sizewell C and D reactors and anything else you would like to add.

Japanese islanders oppose nuke plant construction.

On Tuesday March 23 opponents of the construction of a nuclear power plant on an island in Kaminoseki, Yamaguchi Prefecture, Japan, forced Chugoku Electric Power Corporation to cancel an explanatory meeting. More than 100 residents of Iwaishima island refused to allow officials of the company to disembark after they arrived by boat at the harbor. Kaminoseki's jurisdiction includes several islands. The proposed construction will take place on the island Iwaishima.

The company has held 15 meetings in other areas under the Kaminoseki town jurisdiction after applying for construction approval in December. The Tuesday meeting was to be the first for Iwaishima island residents, many of whom are opposed to the plan first proposed in 1982. Chugoku Electric officials said they will try again.

Italian activists continue the anti-nuclear struggle.
“Ready to win again against Nuclear!” With this slogan Italian anti-nuclear activists organized on October 31, a new demonstration in the village of Montalto di Castro against the government, that intends to build eight new reactors in the country. This in spite of the 1987 referendum that succeeded in closing all existing nuclear plants. “In the late 80s Montalto was one of the locations chosen for a nuclear plant” reminds Legambiente, the association that promoted the demonstration, “but thanks to the referendum victory environmentalists managed to stop any project”. Today this little village situated in between Rome and Florence is again under the threat of nuclear. Its name recently appeared together with other 9 sites in an informal list indicating the places suitable for the authorities to host nuclear plants.

U.K.: Waste to stay at Dounreay?
The Scottish Government is considering allowing foreign intermediate level reprocessing wastes to remain at Dounreay instead of being return to the overseas customers. Instead vitrified high-level waste from Sellafield, contained in glass blocks, would be returned to the Dounreay customers. Until now Dounreay has insisted the wastes, from reprocessing overseas highly-enriched uranium spent fuel, would be sent back to the country of origin. The wastes have been mixed with concrete, like other wastes at the site, and there are about 500 drums weighting around 625 tonnes. Documents released under Freedom of Information Act show the Scottish Government favours the 'waste substitution' proposals and a public consultation is expected before the end of the year. There has already been a consultation on a 'waste substitution' policy for Sellafield's wastes and this has been approved by the Westminster government. The Dounreay proposal has been criticised as turning Scotland into a "nuclear dumping ground", in the words of Green MSP Patrick Garvie. The future of the overseas low level reprocessing wastes is uncertain, although it will probably also remain at Dounreay. In the past spent fuel from Dounreay has been sent to Sellafield for reprocessing, so the site already holds some wastes from the Scottish plant.

DPRK: more Pu-production for n-weapons.
On November 2, North Korea’s official news agency, K.C.N.A., announced that the country completed reprocessing the 8,000 fuel rods unloaded from its nuclear reactor in Yongbyon, two months ago and had made “significant achievements” in turning the plutonium into an atomic bomb. In early September, North Korea had told the United Nations Security Council that it was in the “final phase” of reprocessing the 8,000 rods and was “weaponizing” plutonium extracted from the rods. With this announcement North Korea put further pressure on the United States to start bilateral talks. “We have no option but to strengthen our self-defense nuclear deterrent in the face of increasing nuclear threats and military provocations from hostile forces,” the news agency said. North Korea conducted underground nuclear tests in October 2006 and in May this year. In April, it also test-fired a long-range rocket. North Korea has also said it was also enriching uranium. Highly-enriched uranium would give it another route to build nuclear bombs

The figure on this page shows background information on bare critical masses for some key fissile isotopes. A bare critical mass is the spherical mass of fissile metal barely large enough to sustain a fission chain reaction in the absence of any material around it. Uranium-235 and plutonium-239 are the key chain-reacting isotopes in highly enriched uranium and plutonium respectively. Uranium-233, neptunium-237 and americium-241 are, like plutonium-239, reactor-made fissile isotopes and could potentially be used to make nuclear weapons but have not, to our knowledge, been used to make other than experimental devices. U.K. Submarine radioactive wastes.
Up to five sites in Scotland have been considered by the Ministry of Defence for storing radioactive waste from decommissioned nuclear submarines - including Dounreay in Caithness, according to documents obtained by the Sunday Herald. In total 12 possible storage sites in the UK have been considered by the MoD.  There are already 15 decommissioning submarines lying at Rosyth or Devonport and a further 12 are due to leave active service by 2040. Rosyth and Devonport will be used to cut up and dismantle the submarines, but the MoD's problem is what to do with the waste, especially the large reactor compartments which are the most heavily contaminated. In Scotland the MoD is apparently considering Dounreay, Faslane, Coulport, Rosyth and Hunterston. Among possible sites in the England are Devonport, Aldermaston and Burghfield.

The Nuclear Decommissioning Authority has warned that use of many of the sites would be "contentious". Highland Council, for example, is opposed to any non-Dounreay wastes being taken to the site and this is included in planning conditions for the new low level facility.

Austrian courts cannot shut Temelin.
The Austrian region of Oberoesterreich, backed by a number of local landowners, is not entitled to sue for the closure of Czech Temelin nuclear power plant, the European Court of Justice, Europe's highest court, ruled on October 27. The case had been brought under an Austrian law that states a landowner can prohibit his neighbor from causing nuisance emanating from the latter's land if it exceeds normal local levels and significantly interferes with the usual use of the land. If the nuisance is caused by an officially authorized installation, the landowner is entitled to bring court proceedings for compensation.

 In a bid to close the Temelin plant, the Land Oberösterreich (Province of Upper Austria) made an application under this law to the Landesgericht Linz (Linz Regional Court), claiming that ionizing radiation and the risk of an accident was spoiling use of its agricultural land. Oberoesterreich owns an agricultural school.

However, the regional court has now been told it has no power over organizations operating in another EU member state, after it sought clarification from the European Court of Justice (ECJ). In a statement, the ECJ said: "Austria cannot justify the discrimination practiced in respect of the official authorization granted in the Czech Republic for the operation of the Temelin nuclear power plant on the ground that it is necessary for protecting life, public health, the environment or property rights."

Iraq Plans New Nuclear Reactor Program.
The Iraqi government has approached the French nuclear industry about rebuilding at least one of the reactors that was bombed at the start of the first Gulf war. The government has also contacted the International Atomic Energy Agency and United Nations to seek ways around resolutions that ban Iraq’s re-entry into the nuclear field.

Iraqi Science and Technology Minister Raid Fahmi has insisted that a new Iraqi nuclear program would be solely for peaceful applications, “including the health sector, agriculture...and water treatment.”

However, many people fear that a nuclear reactor would be a tempting target for those who wish to cause significant death and destruction. Additionally, after widespread looting during the US invasion of Iraq in 2003, much nuclear material remains missing from the site of the Tuwaitha nuclear research center.

Covert network UK's nuclear police.
The UK's nuclear police force carries out surveillance on anti-nuclear activity and also uses informers. Details of the work of the 750-strong Civil Nuclear constabulary (CNC) are revealed in documents seen by the Guardian and in reports from the official watchdog released under Freedom of Information. The role of the CNC is to protect the UK's civil nuclear sites and guard nuclear material when it is transported by ship, rail, sea or air - including shipments to Japan and Europe.

However, the CNC has the power to use informers or infiltrate organisations under the Regulation of Investigatory Powers Act (RIPA). Access to data such as phone numbers and email address is also available to the CNC. The watchdog for RIPA, Sir Christopher Rose, says the aims of the CNC ares to counter the threat from terrorism and "public disquiet over nuclear matters". He said the level of CNC surveillance was "relatively modest".

EDF (not) out of U.S.A.?
There were some press-reports (rumours) coming out of France that said the new EDF CEO Henri Proglio wanted an out of the deal with Constellation Energy in Maryland that would solidify there commitment to build a new nuclear power plant in Maryland U.S.A. However, the reports turned out to be no more than rumours, because, the order on the deal was issued on Friday October 30 -approved with conditions- Constellation's board of directors promptly approved the deal and (state-owned) EDF's board followed suit. One of the terms is that EDF will establish a headquarters in Maryland. Looks like they are there to stay -at least for now. 

Ratings downgrades nearly pushed Constellation into bankruptcy last year, but the company agreed to merge with MidAmerican Energy Holdings Co. Constellation later ended that agreement in favor of the EDF deal, which, many people say, does not represent the best interests of consumers.

Increase in cancer for males exposed to above ground N-Tests.
A new study by the Radiation and Public Health Project reveals a 50% increase in cancer rates for boys who were exposed to above ground nuclear tests during the 1950s and early 1960s.  More than 100 nuclear bombs were detonated in the atmosphere over the Nevada Test Site between 1951 and 1962, which emitted radioactive Iodine-131, Strontium-90 and other toxic materials.  The results are based on analyses for Strontium-90 in baby teeth that were stored for over three decades at the University of Washington in St. Louis.  The baby teeth were collected through a program where children were given a little button with a gap tooth smiling boy that said, "I gave my tooth to science", in exchange for their tooth. The Radiation and Public Health Project is a nonprofit educational and scientific organization, established by scientists and physicians dedicated to understanding the relationships between low-level radiation and public health.

The Project said that the study has groundbreaking potential; declaring little information  exists on harm from Nevada above-ground nuclear weapons testing.  In 1997 and 2003, the federal government produced reports downplaying the human health impacts from exposure to the fallout. In his new book, 'Radioactive Baby Teeth: The Cancer Link,' Mangano describes the journey and how exposure to Strontium-90 increases the risk of childhood cancer. Restart go-ahead for refurbished Canadian units. Two reactors at Canada's Bruce A nuclear power plant that have been out of service for over a decade have been given regulatory approval for refuelling and restart.
Units 1 and 2 at the Bruce A plant have been undergoing a major refurbishment to replace their fuel channels and steam generators plus upgrade ancillary systems to current standards. The announcement by regulator CNSC that refuelling can go ahead means the project looks to be on line for the projected 2010 restarts.

Units 1 and 2 at the four-unit Bruce A plant started up in 1977, but unit 2 was shut down in 1995 because a steam generator suffered corrosion after a lead shielding blanket used during maintenance was mistakenly left inside. In the late 1990s then-owner Ontario Hydro decided to lay up all four units at the plant to concentrate resources on other reactors in its fleet, and unit 1 was taken out of service in December 1997 with units 3 and 4 in following in 1998. The four units at sister power station Bruce B continued to operate. Bruce Power took over the operations of both Bruce plants from Ontario Hydro in 2001 and restarted units 3 and 4 by early 2004. Bruce A units 3 and 4 are likely to undergo a similar refurbishment once units 1 and 2 are back in operation.

Bruce Power decided to withdraw its application for a third nuclear power station at Bruce in July, saying it would focus on the refurbishment of the existing Bruce plants rather than building Bruce C. It also announced it was scrapping plans for a second new nuclear plant at Nanticoke in Ontario. On June 29, the government in Ontario announced that it has suspended the procurement of two new reactors for the Darlington nuclear site: the bids were 'shockingly high' (see Nuclear Monitor, 691, 16 July 2009)

US nuclear industry calls for more federal support.
The Nuclear Energy Institute (NEI), which represents the nuclear industry in the US, is calling for a comprehensive package of federal policies, financing and tax incentives to support a major expansion. The NEI wants to see the creation of a Clean Energy Deployment Administration to act as a permanent financing mechanism for new plants. It is also calling for significant tax incentives to support industry development.

However, the Union of Concerned Scientists says the plans amount to a request for US$100 billion (Euro 67 bn) in new federal loan guarantees on top of the US$110 billion loan guarantees already agreed by Congress. “It is truly staggering that an industry this big and this mature can claim to need so much government help to survive and thrive in a world in which technologies that don’t emit global warming pollution will benefit,” says Ellen Vancko of the UCS. “If the nuclear industry gets its way, Christmas will come early this year – thanks to US taxpayers.”
